Re: Status of the Avery County Transfer Facility
Dear Mr. Fletcher:
The purpose of this letter is to inform the County of the Division's concern regarding the
continued operation of the temporary transfer facility at the Avery County Landfill.
This facility was given -approval -to-o- per -ate -on a -temporary basis -in -accordance -with a policy
memorandum issued in May of 1993. The policy was developed as a short-term solution to a
situation created by the abrupt closure of many landfills prior to the effective date of the new,
more stringent federal requirements for municipal solid waste landfills. The policy gave approval
for the construction of temporary transfer facilities within the boundaries of the landfill thereby
allowing the timely transfer of waste to other landfills.
The Division is concerned with the continued operation of a facility built for short-term use and
operating under temporary approval. This concern has been reinforced by recent inspections of
the waste management specialist noting the deteriorating condition of the facility. In addition, the
temporary facility was constructed too close to the existing landfill and could have an adverse
impact on the closed landfill.
Accordingly, the Division requires the submittal of an implementation schedule detailing the
construction and operation of the permanent transfer facility and closure of the temporary
facility. The schedule should demonstrate a commitment by the County to begin operation of the
permanent facility as soon as possible.

Closure Certification for the closed Avery County Landfill

Dear Mr. Fletcher:
This letter is being sent as a reminder that AVERY COUNTY needs to notify the Solid
Waste Section of their assent to the post -closure conditions at the referenced landfill and that the
referenced landfill will be maintained in accordance with the Closure Letter dated December 29,
1995. Also, the initial five year ground water monitoring period begins on the date the Solid
Waste Section (the Section) receives the Notification letter from the County. As stated in
Condition 8 (c) under WATER QUALITY MONITORING AND REPORTING
REQUIREMENTS which states "Water quality detection monitoring shall continue for a
minimum for five years from the date of the Section's receipt of the owner/operator's notification
that the facility will be maintained in compliance with the post -closure conditions specified in this
letter"

appreciates the County's cooperation during the Closure process and is available to answer any
questions that may arise during the post -closure period for the referenced facility.
