He says that he is aware of what you want them to do, and that they are in the process of accomplishing this. I advised him that the County's performance of your requirements is the key to obtaining the vertical permit for the site. We have not been requested to provide any additional services at this time. If you know of anything or become aware of anything that will expedite the issuance of the vertical permit or meeting the Compliance Order, please advise. Dear Mr. Fletcher: Pursuant to N.C.G.S. §130A-294 and 15A NCAC 13B, I conducted an inspection of the Avery County Sanit—ary7Landfill (Permit No. 0640 located on Brushy Creek Road on the 9th of March, 1993 for the purpose of evaluating Avery County's Compliance with general conditions and operational requirements for sanitary landfills. The inspection found that the Avery County Sanitary Landfill to be in violation of the following North Carolina Solid Waste Management Rules codified at 15A NCAC 13B. Specifically: 1. 15A NCAC 13B.0103(g) requires that all solid waste management facilities owned and operated by or on behalf of a local government shall weigh all solid waste when it is received at the facility. The Avery County Sanitary Landfill (Permit #06-01) was in violation of 15A NCAC 13B.0103(g) on March 9, 1993 in that all solid waste was not being weighed when received at this facility. 2. 15A NCAC 13B.050(2)(B) requires that solid waste shall be compacted as densely as practical into cells. The Avery County Sanitary Landfill (Permit #06-01) was in violation of 15A NCAC 13B.0505(2)(B) on March 9, 1993 in that solid waste was not being compacted as densely as practical into cells. 3. 15A NCAC 13B.050(3)(a) requires that solid waste shall be covered after each day of operation. The Avery County Sanitary Landfill (Permit #06-01) was in violation of 15A NCAC 13B.0505(3)(a) on March 9, 1993 in that waste was not covered after each day of operation. The Avery County Sanitary Landfill (Permit #06-01) was in violation of 15A NCAC 13B.0505(5)(b)_ on March 9, 1993-in- that surface water was being impounded over waste. its - 0505(I2)�b requires hat at a cone usion of each day of operation, all windblown materials resulting from the operation be collected and returned to the area. The Avery County Sanitary Landfill (Permit #06-01) was in violation of 15A NCAC 13B.0505(12)(b) on March 9, 1993 in that windblown materials had not been collected and returned to the area at the conclusion of each day. 7. 15A NCAC 13B.0902 states that as of January 1, 1993, the disposal of yard trash in a sanitary landfill is prohibited. The Avery County Sanitary Landfill (Permit #06-01) was in violation of 15A NCAC 1313.0-902 on March 9, 1993 in that yard trash was being landfilled. 8. 15A NCAC 13B.1104 states that the landfilling of whole scrap tires is prohibited. the Avery County Sanitary Landfill was in violation of 15A NCAC 13B.1104(a) on March 9, 1993 in that whole tires were being landfilled. Since Most of our bad weather is behind us, we can schedule and correct the different areas that we are lacking in to conform to the N.C. Solid Waste specifications. One site for the scales was no acceptable, but we have located another one -an d-a-r-e=a-w i=tfing---the=�&u-rve-you - 3) We are restricting the solid waste into small cells and keeping it covered as it comes into the landfill. 4) The landfill operator is a full time employee now, and this is his primary job for 8 hours a day. 5) Since the bad weather is almost over and the roads are getting dry, we will be hauling dirt regularly to cover the trash. 6) Last year we seeded the banks to control erosion. We did have some erosion and this year we plan to seed again in early spring. 7) To prevent site erosion, we are sloping the trash area so the run off will not stand on top of the trash. ) By ke e pi-n g-t he trash-i n sma l l-a-rce-11 s , this rs�keepl-q-the-water away from the work area. 9-10) By doing some extra ditching, surface water can be kept from standing on the trash area. 11) We will be seeding the slopes to control the erosion problem. 12) We are taking every precaution to retain the leachate from the landfill by correcting the drainage from the trash. 13) The W.C. Prison Department has agreed to send their landfill crew monthly to pick up the,wind blown materials. 14) As tires are hauled into the landfill in the containers, they are being picked up and placed on the outside of the garbage and then loaded onto a trailer and taken to be recycled. 15) We have the sedimentation ponds dipped out approximately two times a year. The Avery County Sanitary Landfill (Permit #06-01) was in violation of 15A NCAC 13B.0505(4)(b) in that adequate erosion control measures had not been practiced to prevent excessive on -site erosion. 3. 15A NCAC 13B 0505(5)(a) requires that surface water be diverted from the operational area. The Avery County Sanitary Landfill (Permit #06-01) was in violation of 15A NCAC 13B.0505(5)(a) on July 29, 1993 in that surface water was not being diverted from the waste area. 4. 15A NCAC 13B 0505(55)(b) requires that the surface water shall not be impounded over or in waste. The Avery County Sanitary Landfill (Permit #06-01) was operating in violation of 15A NCAC 13B.0505(5)(b) on July 29, 1993 in that surface water was impQunded over and in the waste. The Avery County Sanitary Landfill (Permit #06-01) was operating in violation of 15A NCAC 13B.0505(5)(c) on July 29 1993 -in-that-completed areas were not adequately sloped to allow _surface — water runoff. 6. 15A NCAC 13B.0505(12kb1 requires that at the conclusion of each day of operation, all windblown material resulting from the operation be collected and returned to the area by the owner or operator. The Avery County Sanitary Landfill was operating in violation of 15A NCAC 13B.0505(12)(b) on July 29, 1993 in that windblown material had not been collected and returned to the area at the conclusion of each day. 7. 15A NCAC 13B.1104(a) states that the landfilling of whole scrap tires is prohibited. The Avery County Sanitary Landfill was in violation of 15A NCAC 13B.1104(a) on July 29, 1993 in that whole tires were being landfilled.
