Dear Mr. Coffey:
Following is our understanding of the decisions reached during conversations held June 14, 2004 between
representatives of the NC Hazardous Waste Section (HWS) and the NC Solid Waste Section (SWS). The
parties agreed that regulatory oversight of contamination at the closed solid waste landfills (RCRA
S WMUs # 11 and # 12) on the Dupont — Brevard facility would be the responsibility of the NCHWS. The
HWS understands the SWS may have physical inspection responsibilities remaining at these landfills. If
