Dear Mr. Hallowell:
The enclosed Amendment to Permit for the referenced facility is
approved in accordance with G.S. 130A-294, subject to the conditions
of the Permit.
This permit is for the property defined in the attached
description and amends the facility description to include the
demolition and asbestos areas as shown on the enclosed plans. The
Conditions of Permit supersede any conditions issued heretofore.
Please note General Condition No. 1 which states that in order
for this permit to be effective, the certified copy shall be
returned to the Solid Waste Section, indicating the page and book
number, date of recordation, and Register's seal.

SOLID WASTE PERMIT

CONDITIONS OF PERMIT:
1. This permit shall not be effective unless the certified copy
is filed in the Register of Deeds Office, in the grantor index
under the name of the owner of the land in the county or
counties in which the land is located. After recordation, the
certified copy shall be returned to the Solid Waste Section
and shall have indicated on it the page and book number, date
of recordation, and Register's seal.
2. When this property is sold, leased, conveyed or transferred,
the deed or other instrument of transfer shall contain in the
description section in no smaller type than used in the body
of the deed or instrument a statement that the property has
been used as a sanitary landfill.
3. This solid waste disposal site is permitted to receive solid
waste as defined in 10 NCAC 10G, .0101(5); stumps, limbs,
leaves, concrete, brick, wood, and uncontaminated earth.
4. This permit is for construction according to the attached
plans. Additional conditions and revisions of the approved
plans shall be approved by the North Carolina Solid Waste
Section.
5. This facility shall conform to operating procedures in Rule
.0507 of the Solid Waste Management Rules and the following
specific conditions:
a. Solid waste shall be restricted to the smallest area
possible and compacted as densely as practical. The
active area shall not exceed one (1) acre in size.
b. Adequate soil cover, a minimum of 6-inch layer, shall be
applied monthly.
C. The permit number and the words "NO UNAUTHORIZED DUMPING
ALLOWED" shall be posted on an entrance sign.
d. Access to the facility shall be secured by means of
gates, berms, etc.
6. Ground water quality at this facility is subject to the
classification and remedial action provisions of 15 NCAC 2L
(Attachment 2).
7. All earth -disturbing activities will be conducted in
accordance with the Sedimentation Pollution Control Act of
1973 (15 NCAC 4).

Dear Mr. Coffey:
With reference to our telephone conversation last week and the letter from
Jim Patterson (copy attached), this letter is to describe the operation of the
alternate fuels boiler currently being constructed at the Brevard site. Per
our conversation, we do not believe that this equipment requires a permit from
your division. We have obtained a modification.to our site's air permit from
the Air Quality Section of your department. This equipment is a boiler, not
an incinerator; and the-efore, we have not pursued any additional permitting.
We confirmed this with Righard Lasater of the Air Quality Section in a
10/16/90 telephone conversation. Mr. Lasater processed our application for the
air permit modification which was issued on December 18, 1990 (permit #3687R12).
The alternate fuels boiler consists of a conventional boiler tube bundle
(including mud drums and steam drum) mounted on top of a fludized bed
combustion chamber. Natural gas is used as the primary fuel. However, due to
the fluidized bed dcs47n, combustible shredded solid material can be fed to
the combustion chamber to reduce natural gas demand. The hot combustion
gases are used to produce steam as in our conventional, fossil fueled boilers.
The flue gases then pass through a bag filter system for particulate removal.
Constant draw down and replenishment of the bed material (a sand -type compound
high in lime content) allows for removal of non-combustible bed material.
This material, as well as the ash from the baghouse, will be either recycled
for its metal content or compounded into cement blocks.
Extensive tests -have been conducted to characterize the combustion gases and
ash composition from the limited fuels that we plan to feed the boiler. The
alternate fuels tested to date are wood, paper, cardboard, polyester, and
Butacite*. This data was included in our air permit application and is
available for your review.

As we discussed, we do not foresee the need to landfill the ash. If such a
need arises, we intend to contact your division and supply the appropriate
data as we do in other non -routine solids disposal circumstances.
If you have any other questions regarding the operation of the alternate fuels

AMENDMENT TO SOLID WASTE PERMIT

CONDITIONS OF PERMIT:
1. This amendment to permit, for the East Landfill, is issued for
a period not to exceed five years from the date of issuance.
Upcoming amendments to the Solid Waste Management Rules, in
accordance with EPA Subtitle D revisions, may necessitate the
modifications of the construction and operation plans or even
closure of this facility prior to this date.
2. This permit shall not be effective unless the certified copy
is filed in the Register of Deeds Office, in the grantor index
under the name of the owner of the land in the county or
counties in which the land is located. After recordation, the
certified copy shall be returned to the Solid Waste Section
and shall have indicated on it the page and book number, date
of recordation, and Register's seal.

CONSTRUCTION AND OPERATION PLANS

2. All sedimentation/erosion control activities will be conducted
in accordance with the Sedimentation Control Act (15 NCAC 4).
3. This facility shall conform to operating procedures in Rule
.0505 of the Solid Waste Management Rules, and the conditions
specified herein.
4. A closure and post -closure plan must be submitted for
approval at least 90 days prior to closure or partial closure.
The plan must include all steps and measures necessary to
close and maintain the facility in accordance with all rules
in effect at that time. The final cover will be evaluated
based upon performance and upgraded if necessary.

Enclosed are 3 copies of Reapplication for the 10 ft. vertical expansion of our East
Sanitary Landfill located adjacent to the Plant on Company property in Transylvania County.
This application has been supplemented in accordance with Ms. Suzanne Malloy's
letter of June 22:
1 Plans and specifications are by W. R. Okie, Professional Engineer
(NC 06618), and bear his registration seal.
2, 3 The landfill area has been surveyed showing its boundaries. The
plat and a legal description are included.
4 An erosion and sedimentation control program was prepared by
Numerical Methods Association of Asheville. This was based on
engineering calculations which are shown.
The plan also includes an appropriate catch basin design based
on runoff calculations and in keeping with needs of drainage,
soil conditions, erosion control, carrying capacity, and site
conditions.
5 Anticipated lifetime calculations are included. Note that these do
not take into account the expected effect of an Alternate Fuels
Boiler now under construction. This is projected eventually to
consume most of the waste material now entering the landfill.

RE: Completeness Review - East Landfill, Amendment to Permit #88-06
Dear Mr. Hallowell:
The Solid Waste Section has completed its preliminary review of the
referenced project, received September 18, 1989. In accordance with
the N.C. Solid Waste Management Rules and the corresponding
guidelines in the document, "Design Requirements for Vertical
Expansion of Existing Sanitary Landfills", the following requirements
must be completed to continue the agency's review:
1) .0202 (a) 3: Detailed plans and specifications shall be
prepared by a professional engineer. The plans shall bear
the imprint of the registration seal of the engineer.
2) .0504 (2)(h) (i): A copy of the deed of other legal
description of the landfill site should be provided.
3) .0504 (1)(b): Exact waste disposal boundaries need to be
shown on the plans.
4) .0504 (2)(d) and (e): A sediment and erosion control plan,
in compliance with NCAC Title 15 Chapter 4, based upon
engineering calculations shall be provided for review by
the Land Quality Section.
Calculations for depth and width of catch basins and
drainage ditches must substantiate "appropriateness"
of size related to needs of drainage, soil conditions,
erosion control, carrying capacity, and site conditions.
Slopes must be specified.
5) .0504 (2)(h)(iv): Anticipated lifetime of the project
must be substantiated through calculations based upon
existing and expected conditions.

These comments are intended to expedite the review of the application
and in no way restricts the Section's right to request additional
information following the technical review process.
I£ complete plans, with all required information, are not submitted
within 90 days, this application will be returned to the applicant as
"incomplete". Likewise, the applicant will be notified when a

Dear Mr. Hallowell:
The Solid Waste Section has completed its review for the above
reference amendment to Permit. The following information is required
for the issuance of a permit.
As per our phone conversation, the proposed demolition site and
asbestos area shall be permitted under the existing North Landfill
area. A deed description of this area is required to be included in
the Permit conditions for recordation procedures.
No deed description exists in our files. This written description
should coincide with the previously submitted attachment 2d, property
survey map showing proposed waste boundaries, of March 30, 1989 for
the above referenced amendment.

The enclosed Amendment to Permit for the referenced facility is
approved in accordance with G.S. 130A-294, subject to the conditions
of the Permit.
Please note General Condition No. 1 which states that
modifications of this permit may be required in accordance with
upcoming revisions to the Solid Waste Management Rules and revised
EPA Subtitle D criteria. Modifications to the construction and
operational plans or even closure of this landfill may be required
before the permit period expires. The Conditions of Permit
supersede any conditions issued heretofore.
Please note General Condition No. 2 which states that in order
for this permit to be effective, the certified copy shall be
returned to the Solid Waste Section, indicating the page and book
number, date of recordation, and Register's seal.

AMENDMENT TO SOLID WASTE PERMIT
E. I. du Pont De Nemours & Company, East Landfill
CONDITIONS OF PERMIT:
1. This amendment to permit, for the East Landfill, is issued for
a period not to exceed five years from the date of issuance.
Upcoming amendments to the Solid Waste Management Rules, in
accordance with EPA Subtitle D revisions, may necessitate the
modifications of the construction and operation plans or even
closure of this facility prior to this date.
2. This permit shall not be effective unless the certified copy
is filed in the Register of Deeds Office, in the grantor index
under the name of the owner of the land in the county or
counties in which the land is located. After recordation, the
certified copy shall be returned to the Solid Waste Section
and shall have indicated on it the page and book number, date
of recordation, and Register's seal.
3. When this property is sold, leased, conveyed or transferred,
the deed or other instrument of transfer shall contain in the
description section in no smaller type than used in the body
of the deed or instrument a statement that the property has
been used as a sanitary landfill.
CONSTRUCTION AND OPERATION PLANS
1. This permit is for construction according to the attached
plans. Additional conditions and revisions of the approved
plans shall be approved by the North Carolina Solid Waste
Section.
2. All sedimentation/erosion control activities will be conducted
in accordance with the Sedimentation Control Act (15 NCAC 4).
3. This facility shall conform to operating procedures in Rule
.0505 of the Solid Waste Management Rules, and the conditions
specified herein.
4. A closure and post -closure plan must be submitted for
approval at least 90 days prior to closure or partial closure.
The plan must include all steps and measures necessary to
close and maintain the facility in accordance with all rules
in effect at that time. The final cover will be evaluated
based upon performance and upgraded if necessary.

(4) EROSION CONTROL REQUIREMENTS
— (a) Adequate erosion control measures shall be practiced to pre-
vent silt from leaving the site.
(b) Adequate erosion control measures shall be practiced to pre-
vent excessive on -site erosion.
(5) DRAINAGE CONTROL REQUIREMENTS
(a) Surface water shall be diverted from the operational area.
(b) Surface water shall not be impounded over or in waste.
— (c) Completed areas shall be adequately sloped to allow surface
water runoff in a controlled manner.
(6) VEGETATION REQUIREMENTS
— (a) Within six months after final termination of disposal operations
at the site on a major part thereof or upon revocation of a
permit, the area shall be stabilized with native grasses.
(b) Temporary seeding will be utilized as necessary to stabilize the
site.
(7) WATER PROTECTION REQUIREMENTS
— (a) The separation distance of four (4) feet between waste and
water table shall be maintained unless otherwise specified by
the division in the permit.
(b) Solid waste shall not be disposed of in water.
— (c) Leachate shall be contained on site or properly treated prior to
discharge. An NPDES permit may be required prior to the dis-
charge of leachate to surface waters.
(8) ACCESS AND SECURITY REQUIREMENTS
(a) The site shall be adequately secured by means of gates chains

arrangements shall be made with the local fire protection
agency to immediately provide fire -fighting services when
needed.
— (c) Fires that occur at a sanitary landfill shall be reported to the
division within 24 hours and a written notification shall be
submitted within 15 days.
— (d) The removal of solid waste from a sanitary landfill is prohibited
unless the owner/operator approves and the removal is not
performed on the working face.
— (e) Barrels and drums shall not be disposed of unless they are empty
and perforated sufficiently to ensure that no liquid or hazard-
ous waste is contained therein.
(11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS
— (a) A site shall only accept those solid wastes which it is permitted to
receive.
— (b) No hazardous, liquid, or infectious waste shall be accepted or
disposed of in a sanitary landfill except as may be approved by
the division.
— (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste,
and other animal waste delivered to the disposal site shall be
covered immediately.
— (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as
amended through January 1,1985, may be disposed of separate
and apart from other solid wastes at the bottom of the working
face or in an area not contiguous with other disposal areas, in
either case, in virgin soil. Separate areas shall be clearly marked
so that asbestos is not exposed by future land -disturbing activi-

Purpose: G.S.130A-294 requires that an inspection program be established for the operation of solid

(a) Adequate erosion control measures shall be practiced to pre-

at the site on a major part thereof or upon revocation of a
permit, the area shall be stabilized with native grasses.
(b) Temporary seeding will be utilized as necessary to stabilize the
site.
(7) WATER PROTECTION REQUIREMENTS
— (a) The separation distance of four (4) feet between waste and
water table shall be maintained unless otherwise specified by
the division in the permit.
— (b) Solid waste shall not be disposed of in water.
— (c) Leachate shall be contained on site or properly treated prior to
discharge. An NPDES permit may be required prior to the dis-
charge of leachate to surface waters.
