Inspection of construction and demolition landfill and scrap tire collection site.
NOTICE OF VIOLATION(S) (citation and explanation)
15A North Carolina Administrative Code 13B .0505(4)(b) requires that adequate erosion control measures shall be
practiced to prevent excessive on -site erosion. The Macon County construction and demolition landfill was operating
in violation of this rule in that several large eroded areas were observed at the time of the inspection.
A compliance date of March 15, 2004 has been established for correcting the violation noted above.
You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $5,000 per day may be assessed for each
violation of the Solid Waste Statute or Regulations. If the violation(s) noted here continue, you may be subject to enforcement actions
including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such
further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

This letter and attachments are in response to your site visit and subsequent inspection
report associated with inadequate erosion control measures at the Highlands Construction
and Demolition landfill located off of Rich Gap Road in Highlands, North Carolina. The
following temporary and permanent proposed erosion control measures are submitted for
your review and approval. The proposed erosion control measures are designed to bring
the site into compliance with the erosion control plan submitted by Cranston, Robertson
& Whitehurst P.C., approved July, 1992.
Background
The Highlands C&D landfill has been in operation for approximately ten years. The
landfill began accepting C&D waste in a trench -fill method. Approximately 18-24
months ago, we began an area fill on top of the existing trenches. At this time we are
currently filling our second lift in the area fill. The soil at the site is very nutrient poor
and has very little cohesiveness. This has consistently led to a great deal of erosion at the
site. We have maintained erosion control through constant maintenance of sediment
basins, check dams and ditches, and by hydroseeding fill areas that will be closed for
several months. It often takes two or three applications of hydroseeding to establish any
vegetative ground cover. Further, in heavy rains, even established growth can be washed
away.
This past fall, we have experienced even larger than normal amounts of precipitation,
including over 10-inches twice as the remnants of Hurricanes Frances and Ivan passed
over the area. The storms not only added to our erosion problems from heavy
sedimentation, but also damaged two of our sediment basins. The combination of heavy
rains causing an enormous amount of erosion, and the resultin wet conditions that
prevented us from being able to access the sites with heavy equipment to make needed
repairs have resulted in the current condition at the landfill that you witnessed on your
visit, and in the photos taken by a complainant.
Current Actions
We have already begun to install temporary erosion control measures, and make repairs
to our facilities. We have placed stone at the exit point of the northwest sediment basin

where the storms washed part of the outer slope away, and we have installed two bands
of silt fencing below the area to filter sediment, and prevent it leaving the site.
Additionally, we have placed silt fencing below the large sediment basin where the
greatest evidence of sedimentation was visible during our inspection. The standpipe in
that basin was also damaged beyond use, and we are replacing it with a new standpipe
and culvert. Other measures are proceeding for temporary and permanent erosion control
at the site, and will be detailed in future correspondence as they are completed.
Additional rains and wet conditions at the site continue to hamper our progress, but we
will continue make repairs and install additional measures as we are able.
Future Actions
Attached are several details of current site plans dated April 2003. McGill and
Associates developed them as part of our permit renewal last year. The purpose of the
figures is to identify specific areas of the landfill at which additional erosion control
measures are required. Also attached is a list of proposed corrective actions to be
performed at each site.
Conclusions
Please review the proposed actions and notify me as to any deficiencies or additional
measures that you would recommend. We will try to identify and address the most
problematic areas first, but we will also be dictated to a large extent by the weather, and
try to work in more accessible areas during wet periods. I have estimated the cost of
materials to install these measures between $5,000.00 and $10,000.00. I am hopeful that
the cost will not further hamper our efforts to correct these issues. If some projects are
delayed, I will make every effort to complete the essential (discharge point) elements of
the projects first. Thank you for your consideration in these matters and I look forward to
future discussions and providing you positive updates as our work progresses.

Area 1: Access Road Between Yard Waste Treatment and Processing Area
and Landfill
1. Re -grade roadway with crown and cut down berms along the edges to allow
drainage from the roadway.
2. Place road matting and gravel along the roadway.
3. Line side slopes with ground mulch for ground cover and erosion control.
Area 2: Sediment Basin Below Borrow Area (Figure 2)
1. Enlarge sediment basin to a minimum size of 35' x 20' x 4' per original
specifications (Reference McGill and Associates Site Plan Amendment; 1995).
2. Place stone along slope exiting basin to filter sediment. Basin is of sufficient size
so that normal rain amounts do not overcome the capacity of the basin. May
install perforated standpipe and culvert under existing roadway accessing yard
waste area, placing stone around standpipe to filter sediment.
3. Add stone check dams at both points where run-off enters basin for filtration.
4. Install additional silt fencing and check dams as needed between borrow area and
drainage ditch entering sediment basin.
Area 3: Sediment Basin Along Branch Above and Below Landfill Access Road
Crossing (Figure 2)
1. Create channel along both sides of the branch above the road crossing with
earthen berms. Line inside of berms (facing branch) with stone to filter sediment
and stabilize slopes.
2. Backfill areas behind berms with soil and hydroseed for ground cover. Apply
mulch to steep side slopes for ground cover and soil stability.
3. Create stone -lined spillway through berms on each side to allow drainage of run-
off entering the area.
4. Below the roadway crossing: Hydroseed banks for vegetative cover. Apply
mulch to steep side slopes to stabilize banks. Add stone to exit point of basin for
filtration at spillway.
Area 4: Large Sediment Basin Below C&D Landfill (Figure 3)
1. Ensure that sediment basin is at least 24' x 24' x 8' in size per original
specifications (Reference Erosion Control Plan, Cranston, Robertson &
Whitehurst, P.C. 1992).
2. Re -install perforated standpipe and culvert in basin. W�ap standpipe with conical
stone pile to filter sediment.
3. Hydroseed slopes around sediment basin for vegetative ground cover. Apply
erosion control fabric to steep outer slopes of sediment basin.
4. May apply road matting and stone to roadway above sediment basin to access for
cleaning out the sediment basin. Otherwise, hydroseed for vegetative ground
cover.
5. Maintain/Repair stone check dams leading to sediment basin.
6. Check ditch above landfill access road at entrance to landfill. Ditch is growing in
size due to washing and may eventually undermine roadway. May want to

hydroseed or add stone to area to control size of ditch and prevent additional
erosion.
Area 5: Sediment Basin at North-West Corner of Landfill (Figure 4)
1. Ensure that sediment basin is at least 30' x 30' x 8' in size per original
specifications (Reference Erosion Control Plan, Cranston, Robertson &
Whitehurst, P.C. 1992).
2. Repair area damaged by heavy rains at exit of sediment basin.
3. Install perforated standpipe and culvert in sediment basin. Wrap standpipe with
conical pile of stone to filter sediment.
4. Hydroseed slopes of sediment basin for protective vegetative ground cover.
5. Maintain stone check dams in ditch spilling into sediment basin. Add additional
stone as needed.
Area 6: C&D Landfill Slopes Below Current Operating Area (Figure 5)
1. Construct small berm along top -of -slope on final grade slope. Grade and walk-in
final slope (may have to do in stages due to weather). Hydroseed slope and cover
with straw or alternative erosion control matting. Extend cover from toe -of -slope
to above berm. Create spillways through berm at three points (see Figure 5).
Install pipes at spillways that extend to drainage ditch. Line pipe influent points
with stone to filter sediment.
2. Hydroseed flat area (future fill area) above slope and apply straw for erosion
control. Add mulch as needed to any washed areas as temporary erosion control
ground cover.
3. Hydroseed and straw inner slope above access road along current fill area. Apply
mulch as needed to any washed areas as temporary erosion control ground cover.
4. All immediate hydroseeding will be sprayed with winter rye. Re-hydroseed this
spring with fescue or other perinanent groundcover.
5. Install additional silt fencing, as needed, outside bottom (western) boundary of
landfill between landfill and Rich Gap Road to prevent sediment from leaving the
site until vegetative cover is established.
Area 7: C&D Landfill Area Above Current Operating Area (Figure 6)
1. Hydroseed any washed or bare areas.
2. Apply additional fertilize and lime as top dressing for existing grassed areas.
