(4) EROSION CONTROL REQUIREMENTS (a) Adequate erosion control measures shall be practiced to pre- vent silt from leaving the site. — (b) Adequate erosion control measures shall be practiced to pre- vent excessive on -site erosion. (5) DRAINAGE CONTROL REQUIREMENTS (a) Surface water shall be diverted from the operational area. --X,(b) Surface water shall not be impounded over or in waste. (c) Completed areas shall be adequately sloped to allow surface water runoff in a controlled manner. (6) VEGETATION REQUIREMENTS — (a) Within six months after final termination of disposal operations at the site on a major part thereof or upon revocation of a permit, the area shall be stabilized with native grasses. — (b) Temporary seeding will be utilized as necessary to stabilize the site. (7) WATER PROTECTION REQUIREMENTS — (a) The separation distance of four (4) feet between waste and water table shall be maintained unless otherwise specified by the division in the permit. — (b) Solid waste shall not be disposed of in water. — (c) Leachate shall be contained on site or properly treated prior to discharge. An NPDES permit may be required prior to the dis- charge of leachate to surface waters. (8) ACCESS AND SECURITY REQUIREMENTS — (a) The site shall be adequately secured by means of gates, chains, berms, fences, and other security measures approved by the division, to prevent unauthorized entry. — (b) An attendant shall be on duty at the site at all times while it is open for public use to ensure compliance with operational requirements. — (c) The access road to the site shall be of all-weather construction and maintained in good condition. — (d) Dust control measures shall be implemented where necessary. (10) SAFETY REQUIREMENTS (a) Open burning of solid waste is prohibited. —(b) Equipment shall be provided to control accidental fires or arrangements shall be made with the local fire protection agency to immediately provide fire -fighting services when needed. — (c) Fires that occur at a sanitary landfill shall be reported to the division within 24 hours and a written notification shall be submitted within 15 days. — (d) The removal of solid waste from a sanitary landfill is prohibited unless the owner/operator approves and the removal is not performed on the working face. (e) Barrels and druns shall not be disposed of unless they are empty and perforated sufficiently to ensure that no liquid or hazard- ous waste is contained therein. (11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS — (a) A site shall only accept those solid wastes which it is permitted to receive. (b) No hazardous, liquid, or infectious waste shall be accepted or disposed of in a sanitary landfill except as may be approved by the division. — (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste, and other animal waste delivered to the disposal site shall be covered immediately. — (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as amended through January 1,1985, may be disposed of separate and apart from other solid wastes at the bottom of the working face or in an area not contiguous with other disposal areas, in either case, in virgin soil. Separate areas shall be clearly marked so that asbestos is not exposed by future land -disturbing activi- ties. The waste shall be covered immediately with soil in a manner that will not cause airborne conditions. Copies of 40 CFR 61 may be obtained and inspected at the Solid and Hazard- ous Waste Management Branch, Division of Health Services, P. O. Box 2091, Raleigh, NC, 27602. (12) MISCELLANEOUS REQUIREMENTS (a) Effective vector control measures shall be applied to control flies, rodents, and other insects or vermin when necessary. (b) Appropriate methods such as fencing and diking shall be pro- vided within the area to confine solid waste subject to be blown by the wind. At the conclusion of each day of operation, all windblown material resulting from the operation shall be col- lected and returned to the area by the owner or operator. William L. Meyer Director reviewed your request near the existing Avery Although none of the siting requirements for landfills in Section .0503 of the Solid Waste Management Rules have been addressed at this time, the County has asked.the Division to respond to one specific requirement regarding proximity to airports. Accordingly, the Division has made the following decisions concerning this specific requirement and its impact of this.proposed.site: (1) The site will be considered a "new site" for purposes of all siting and design requirements. (2) Section .0503(1)(c) states that "a new site disposing of putrescible wastes shall not be located within 10,000 feet of an airport runway used by turbojet aircraft or within 5000 feet of an airport runway used by piston -type aircraft". Therefore, (3) This site must comply with that requirement. The Division strongly encourages the County to consider a regional approach as a viable means of meeting their future solid waste management needs. (704) 7:33.2001 As the Attorney for Avery County, I am writing in regards to the April 23, 1990 correspondence of Mr. J. Gordon Layton to Mr. Randall Fletcher, Manager for Avery County. A copy of that correspondence is enclosed. On-July1-3, 1989, Avery -County- through Jimmy D. tNoodie-of--Muni-cipal Engineering -- wrote to Mr. Jim Coffey, requesting that the Division of Solid Waste Management (the Division) respond to Section .0503 (1)(c) which deals with the proximity of the landfill to the Avery County Airport. (See copy of Mr. Woodie's letter enclosed) This letter was sent following a meeting on April 26, 1989 between Mr. Woodie; Randall Fletcher, County Manager; Jim Coffey and Owen Setzer at the site in question. Mr. Laytons' letter of April 23, 1990 is the first response of the Division to this inquiry of the County. Avery County like the other counties in the State is facing the dilemma of running -out of landfill space. The problem is exacerbated in the mountain counties by the paucity of land suitable for a landfill. Preliminary studies show that the area in question has a good potential of meeting the Division requirements, and it is ideal because of its isolation from residential property, and its close proximity to the existing landfill. Avery County truly has no other alternative site except for the expansion of the present site. Accordingly we feel we have no alternative except to file the enclosed Petition for a Contested Hearing. This is being done only to protect our rights before the running of the time requirements. Prior to any formal hearing, we would appreciate the opportunity to meet with your personally to explain the history of the landfill, our attempts to locate other properties, and the critical situation we face. Additionally, we are formally requesting a variance purusant to 10 NCAC 10G .0205 in order to allow the expansion of the landfill or the construction of a "new site", as your office has categorized it. If a formal procedure is required for requesting the variance, please advise me accordingly and we will adher to that policy and procedure. We believe a variance can be justified in that one, the Division in the past has approved the present Mr. William L. Dear Mr. Fletcher: Director As discussed in our telephone conversation on May 23, 1990, our office has not received the Well Documentation Records for the installation of the ground -water monitoring wells at the Avery County Landfill. Nor have we received the results from the monitoring. Newly installed wells are required to be sampled twice the first year and annually thereafter. These requirements are outlined in the attached letter dated August 2, 1989 and in the North Carolina Water Quality Monitorinq Guidance Document For Solid Waste Facilities. Within the next 30 days, please provide our office with: well completion records, the name of the contractor performing the ground -water and surface -water monitoring, and the dates you intend to have the sampling done. C. 28657 Re: Surface Water Monitoring at the Avery County Landfill (Permit #06-01). Dear Mr. Fletcher: William L. Meyer Director Section .0602 (Surface Water Monitoring) of The Solid Waste Management Rules (10 NCAC 10G) states that "The division shall require a solid waste management facility to provide such surface water monitoring capability as the division determines to be necessary to detect the effects of the facility on surface water in the area.' As a result of the focus on ground -water monitoring in recent years, surface water monitoring has been overlooked at many solid waste management facilities. The Solid Waste Section is now in the process of re-establishing a surface water monitoring program at all sanitary landfills in North Carolina. Surface water monitoring should include a sample taken immediately upstream of the landfill facility as well as a sample taken immediately downstream of the facility. Each significant stream adjoining (or within) the landfill facility should be sampled. All ground and surface water monitoring should be performed according to the specifications in the "North Carolina Water Quality Monitoring Guidance Document for Solid Waste Facilities". Within the next 30 days, please submit to our office a surface water monitoring plan. This plan should include a map of the permitted landfill facility showing all streams within or adjoining the landfill property. Proposed stream monitoring locations should be indicated on the map with designations that can be correlated with future sample analytical data (e.g. SW-1, SW-2, etc.). You should also indicate which are upstream sampling locations, and which are downstream locations. The streams should be sampled at the same time and for the same parameters as the ground -water monitoring wells. Please include the surface water data along with the ground -water analysis for the next scheduled sampling episode and all future water quality samplings. (c) The access road to the site shall be of all-weather construction and maintained in good condition. (d) Dust control measures shall be implemented where necessary.
