SOLID WASTE PERM IT
Conditions of Permit: .
1. This permit may be subject to review at an administrative hearing upon
petition of anyone whose legal rights, privileges and duties may have been
affeeLed by, the issuance tbereof.
2. This permit shall not be effective unless the certified copy is filed in
the register of deeds' office, in the grantor index under the name of the
owner of the lard in the county or counties in which the land is located.
After recordation, the certified copy shall be returned to the Solid &
Hazardous Waste Management Branch aid shall have indicated on it the page
and book number, date of recordation and registrar's seal.
3. When this property is sold, leased, conveyed or transferred, the deed or
other instrument of transfer shall contain in the description section in
no smaller type than that used in the body of the dead or instrument a
statement that the property has been used as a sanitary landfill.
4. This solid ;caste disposal site is permitted to receive solid waste as
defined in 10 NCAC 10G, .0101(36), except that hazardous waste, liquid
waste -and- any- other -wastes- that may pose a threat to theenvironment or
public health are prohibited from disposal at this site unless prior
authorization is obtained from the Division of Health Services.
5. This permit is for construction according to attached plans. Any
modification or deviation from the approved plans shall be approved by the
North Carolina Solid and Hazardous Waste ;Management Branch.
6. Ground water monitoring wells and monitoring requirements:
Three additional wells shall be installed at locations as shown on
construction plans.
Installation shall conform to DHS well standard (Attachment 1).
A well completion record shall be submitted to DHS for each
monitoring well constructed (Attachment 2).
The location of the monitoring wells shall be physically located in
the field and approved by DHS prior to the well being constructed.
Ground water monitoring wells shall be constructed and sampled and
conform to specifications outlined in the N.C. rater Quality
Pbnitoring Guidance. Document for Solid Waste Facilities. Complete
specifications will be finalized in the document which will be
provided by DHS.
Surface water sampling shall be performed at the locations specified
on the construction plans.
Avery County shall sample monitoring wells and surface waters,
semi-annually, for the first year and annually thereafter.
A readily accessible unobstructed path shall be initially cleared
and maintained so that 4-wheel drive vehicles may have access to the
monitoring wells.
7. This facility shall conform to operating procedures in Rule .0505 of the
Solid Waste Management Rules.
8. Grourd water quality at this facility is subject to the classification and
remedial action provisions of 15 NCAC 2L (Attachment 3).

Tne location of monitoring wells at the proposed landfill site is the most
critical phase of the site development. Placement of the monitoring wells
will be based on ground water gradients established during the preliminary
site investigation. The selection of monitoring well locations must be
coordinated with the hydrogeologist for the Solid and Hazardous Waste
Management Branch. This is to assure uniformity of installation procedures
and conformance with EPA regulations.
The procedure for drilling through the unsaturated soil mantle to the water
bearing formation is a standard procedure with most consulting and well
drilling firms. The only precaution in this stage of the installation is
minimizing the use of drilling fluid (bentonite-gel mixture), flocculants
(mixtures of sodium pyrophosphate) and excessive use of lubricants. If any of
these or relating products are used in the drilling process, the hole should
be flushed to remove as much of the contaminants as possible.
installation of the monitoring well and placement of the well screen is
critical to assure that the ground water sample represents the aquifer zone
where contaminants may occur. A minimum well screen length of ten feet is
required. The specific depth of the screen interval will be established as a
condition of the permit based upon data collected during the site
investigation.
In connecting sections of PVC pipe, clamps or threaded fittings of pipe is
required. Epoxy cement or other PVC glues may contaminate ground water
samples and, as such, are not allowed.
Well -sorted sand, used as a pre-screening of influent ground water, should be
washed to remove all fines and prevent clogging of the well screen.
The remainder of materials used in the installation of the monitoring wells
are self-explanatory. Should questions arise as to the type of materials or
any phase of the installation, please contact the hydrogeologist for the Solid
and Hazardous Waste Management Branch in Raleigh, North Carolina, at (919)

(2) SPREADING AND COMPACTING REQUIREMENTS
(a) Solid waste shall be restricted into the smallest area feasible.
(b) Solid waste shall be compacted as densely as practical into cells.
(3) COVER REQUIREMENTS
— (a) Solid waste shall be covered after each day of operation, with a
compacted layer of at least six inches of suitable cover or as
specified by the division.
(b) Areas which will not have additional wastes placed on them for
12 months or more shall be covered with a minimum of one foot
of intermediate cover.
(c) After final termination of disposal operations at the site or a
major part thereof or upon revocation of a permit, the area shall
be covered with at least two feet of suitable compacted earth.
(4) EROSION CONTROL REQUIREMENTS
(a) Adequate erosion control measures shall be practiced to pre-
vent silt from leaving the site.
(b)—Adequate—erosion-control-measures shall be -practiced to pre -

(5) DRAINAGE CONTROL REQUIREMENTS
(a) Surface water shall be diverted from the operational area.
—.(b) Surface water shall not be impounded over or in waste. (11)

water runoff in a controlled manner.
(6) VEGETATION REQUIREMENTS
(a) Within six months after final termination of disposal operations
at the site on a major part thereof or upon revocation of a
permit, the area shall be stabilized with native grasses.
(b) Temporary seeding will be utilized as necessary to stabilize the
site.
(7) WATER PROTECTION REQUIREMENTS
(a) The separation distance of four (4) feet between waste and
water table shall be maintained unless otherwise specified by
the division in the permit.
(b) Solid waste shall not be disposed of in water.
(c) Leachate shall be contained on site or properly treated prior to
discharge. An NPDES permit may be required prior to the dis-
charge of leachate to surface waters.
(8) ACCESS AND SECURITY REQUIREMENTS
(a) The site shall be adequately secured by means of gates, chains,
berms, fences, and other security measures approved by the
division, to prevent unauthorized entry.
— (b) An attendant shall be on duty at the site at all times while it is
open for public use to ensure compliance with operational
requirements.
— (c) The access road to the site shall be of all-weather construction
and maintained in good condition.
(d) Dust control measures shall be implemented where necessary.

(c) Fires that occur at a sanitary landfill shall be reported to the
division within 24 hours and a written notification shall be
submitted within 15 days.
— (d) The removal of solid waste from a sanitary landfill is prohibited
unless the owner/operator approves and the removal is not
performed on the working face.
Vie) Barrels and drums shall not be disposed of dnless they are empty
and perforated sufficiently to ensure that no liquid or hazard-
ous waste is contained therein.
WASTE ACCEPTANCE AND DISPOSAL. REQUIREMENTS
— (a) A site shall only accept those solid wastes which it is permitted to
receive.
(b) No hazardous, liquid, or infectious waste shall be accepted or
disposed of in a sanitary landfill except as may be approved by
the division.
— (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste,
and other animal waste delivered to the disposal site shall be
covered immediately.
— (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as
amended through January 1,1985, may be disposed of separate
and apart from other solid wastes at the bottom of the working
face or in an area not contiguous with other disposal areas, in
either case, in virgin soil. Separate areas shall be clearly marked
so that asbestos is not exposed by future land -disturbing activi-
ties. The waste shall be covered immediately with soil in a
manner that will not cause airborne conditions. Copies of 40
CFR 61 may be obtained and inspected at the Solid and Hazard-
ous Waste Management Branch, Division of Health Services,
P. O. Box 2091, Raleigh, NC, 27602.
(12) MISCELLANEOUS REQUIREMENTS
— (a) Effective vector control measures shall be applied to control
flies, rodents, and other insects or vermin when necessary.
— (b) Appropriate methods such as fencing and diking shall be pro-
vided within the area to confine solid waste subject to be blown
by the wind. At the conclusion of each day of operation, all
windblown material resulting from the operation shall be col-
lected and returned to the area by the owner or operator.

— (a) Within six months after final termination of disposal operations
at the site on a major part thereof or upon revocation of a
permit, the area shall be stabilized with native grasses.
— (b) Temporary seeding will be utilized as necessary to stabilize the
site.
(7) WATER PROTECTION REQUIREMENTS
(a) The separation distance of four (4) feet between waste and
water table shall be maintained unless otherwise specified by
the division in the permit.
(b) Solid waste shall not be disposed of in water.
(c) Leachate shall be contained on site or properly treated prior to
discharge. An NPDES permit may be required prior to the dis-
charge of leachate to surface waters.
(8) ACCESS AND SECURITY REQUIREMENTS
(a) The site shall be adequately secured by means of gates, chains,
berms, fences, and other security measures approved by the
division, to prevent unauthorized entry.
(b) An attendant shall be on duty at the site at all times while it is
open for public use to ensure compliance with operational
requirements.
(c) The access road to the site shall be of all-weather construction
and maintained in good condition.
— (d) Dust control measures shall be implemented where necessary.

division within 24 hours and a written notification shall be
submitted within 15 days.
(d) The removal of solid waste from a sanitary landfill is prohibited
unless the owner/operator approves and the removal is not
performed on the working face. --

and perforated sufficiently to ensure that no liquid or hazard-
ous waste is contained therein.
(11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS
— (a) A site shall only accept those solid wastes which it is permitted to
receive.
— (b) No hazardous, liquid, or infectious waste shall be accepted or
disposed of in a sanitary landfill except as may be approved by
the division.
(c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste,
and other animal waste delivered to the disposal site shall be
covered immediately.
— (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as
amended through January 1,1985, may be disposed of separate
and apart from other solid wastes at the bottom of the working
face or in an area not contiguous with other disposal areas, in
either case, in virgin soil. Separate areas shall be clearly marked
so that asbestos is not exposed by future land -disturbing activi-
ties. The waste shall be covered immediately with soil in a
manner that will not cause airborne conditions. Copies of 40
CFR 61 may be obtained and inspected at the Solid and Hazard-
ous Waste Management Branch, Division of Health Services,
P. O. Box 2091, Raleigh, NC, 27602.
(12) MISCELLANEOUS REQUIREMENTS
— (a) Effective vector control measures shall be applied to control
flies, rodents, and other insects or vermin when necessary.
— (b) Appropriate methods such as fencing and diking shall be pro-
vided within the area to confine solid waste subject to be blown
by the wind. At the conclusion of each day of operation, all
windblown material resulting from the operation shall be col-
lected and returned to the area by the owner or operator.

Reference is made to our meeting on September 23, 1987 regarding defic-
iencies noted at the Avery County Landfill. As we discussed, consecutive
inspections on June 2, 1987 and September 23, 1987 revealed the following
violations of the N. C. SOLID WASTE MANAGEMENT RULES:
1. .0505(3)(a) - Cover Requirements: solid waste shall be covered after each
day of operation, with a compacted layer of at least six inches of suitable
cover or as specified by the Division.
2. .0505(4)(b) - Erosion Control Requirements: adequate erosion control
measures shall be practiced to prevent excessive on -site erosion.
In addition to the above -noted violations, the September 23, 1987 inspection
also revealed additional violations relative to surface water impoundment
over the solid waste and an accumulation of windblown materials around the land-
fill.
We are, therefore, notifying you that immediate action must be initiated
to:
1. Correct all excessive erosion problems including re -seeding before adverse
weather conditions arrive.
2. Insure that all solid waste is covered after each day of operation with a
compacted layer of at least six inches of soil cover.
3. Collect all windblown materials resulting from the operation and return to i
the area (at the conclusion of each day of operation).

Construction Project at Landfill
Persons Present: Cuthbertson, Fletcher, VonCannon,
Setzer, Owens and Beehler
Dear Randall:
The following listed items were noted as being not in accordance with the
construction plans for this project:
1. Stone Check Dams were not constructed as designed, as well as being
deficient in total number to be installed on each diversion ditch.
2. Filter Basins (Stone rip-rap,.Class 1) was not installed as per
drawings. The stone rip rap utilized was much smaller in size than
the Class 1 Stone Rip rap that was specifier an ac7ass a result it
was washed out due to being too small and also the earth berms of the
filter basins were not properly compacted during construction.
3. Grassing was inadequate over the entire construction area.
4. Diversion Ditches were not properly stabilized.at the ditch flow line,
under the jute matting, and severe eroding occurred in the ditches in
the limits of the existing landfill which resulted in exposure of
existing garbage fill to the atmosphere.
5. Grading of landfill berms was not true to grade.and created ponding
on the terraces. and spillover eroded the fill face of the existing
landfill.
The Contractor was on site at the time of the inspection and is aware of
the above listed items and each was discussed as to where the deficiencies
existed and what he must do to correct the problem.

It was determined at the time of.the inspection that the Contractor was to
proceed with all of the corrective measures as soon as weather permitted but
that immediate priority be given to the installation of hay bales in the
eroded ditches along with earth intermixed so as to reduce further erosive
action on the existing landfill area.
I will be available as needed during the time period of this corrective
measures consturction but would like to have sufficient notice to arrange
my schedule when a site visit is deemed necessary.

Avry Countv Landfill
Dear Mr. Fletcher:
Pursuant to N. C. General Statute 130A-2,2(a) and to NCAC lOG an inspection
was conducted on December 2, 1987 of the Avery County Landfill, Permit #06-01,
located in Avery County on S.R. 1101 near Highway 19E northeast of Spruce Pine,
North Carolina. The inspection by Owen R.-Setzer, Waste Management Specialist,
Solid & Hazardous Waste Management Branch, found the Avery County Landfill to be
in violation of certain requirements contained in the N. C. SOLID WASTE MANAGE-
MENT RULES,.codified at 10 NCAC lOG specifically:
1. 10 NCAC 10C .0505(3)(a) requires that solid waste shall be covered after
each day of operation with a compacted layer of at least six -inches of
suitable cover or as specified by the division. The livery County Landfill
was operating in violation of 10 NCAC lOG .0505(3)(a) at the time of the
inspection on December 2, 1987 in that solid waste was not completely
covered with six inches of soil cover at the old site and the new extension
site. -

be practiced to prevent on -site erosion. The Avery County Landfill was oper-

10 NCAC lOG .0505(5)(b) at the time of the inspection on December 2, 1987

of the landfill and on top of the landfill.

10 NCAC 10G .0505(12)(b) requires that at the conclusion of each day of
operation, all windblown material resulting from the operation shall be

Notice of Violation, and otherwise be in compliance with the N. C. SOLID WASTE
MANAGEIIENT RULES, codified at 10 NCAC lOG:
1. Comply with 10 .NCAC 10G .0505(3)(a) by covering all waste after each day of
operation with a compacted layer of at least six inches of soil cover.
2. Comply with 10 NCAC 10G .0505(4)(b) by repairing all eroded areas on the
side slope of the landfill and the slope drains.
3. Comply with 10 NCAC lOG .0505(5)(b) by repairing low areas in terrace
drains on the side slope of the landfill and covering the top of the land-
fill with two feet of cover.
4. Comply with 10-NCAC 10G .0505(12)(b) by cleaning up all windblown material
such as paper, plastic, etc. on and -around the landfill and providing
daily collection of windblown materials.
Pursuant to N. C. General Statute 1.30A-22(a) and 10 NCAC IN section .0701 -
.0707, an administrative Ipenalty of up to $500.00 per day may be assessed for
violations of the Solid Waste Law or Regulation.
