This is a problem of the community as well as the individual and continual disregard on the part of either will certainly result in unnecessary disease and annoyance. Lack of understanding, carelessness and indifference is largely respon- sible for our present problems. Frequently, individual effort is fruitless without public control, but, at the same time, efforts of public health agencies are doomed to failure without support of individual citizens. Refuse which is contaminated with disease organisms originating in the home or institutions-_p-rovides-food and shelter for many of our most importantpublic health pests, insects and rodents. It is, therefore, necessary that refuse be handled in an acceptable manner from the point of origin to that of. disposal. Refuse, at the point of origin, is largely the responsibility of the producer and must be stored in an approved manner. Refuse collection is accomplished in three ways: (1) by the individual, (2) by a governmental agency using public funds, and (3) by private contract garbage collectors who are paid by the individual receiving the service. Refuse disposal is normally accomplished by (1) the individual who utilizes his own land or disposal areas belonging to private or public agencies, (2) by governmental agencies who utilize publicly -owned dis- posal areas or (3) by private collectors who provide their own disposal area or utilize that of a public agency. No longer is the old-fashioned, insanitary refuse dump acceptable in today's society as a means of refuse disposal. An open dump is aesthetically offensive because of smoke and odors and is responsible for the reduction of adjacent land values, and are gradually being replaced by the sanitary landfill or other sanitary means of refuse disposal. - 1 - SECTION II - Legal Aspects thority to Regulate "Rules and Regulations Providing Standards for Solid Waste Disposal" adopted by the North Carolina State Board of Health as directed by Article 13B of Chapter 130 of the General Statutes shall be used as minimum standards for solid waste management. Local Board of Health County or district boards of health may adopt more stringent regulations as pro- vided by General Statute 130-17. Boards of Commissioners r-ds of_commi-ssioners_have authority to regulate under G.S. 153-272 through 275, the collection and disposal of refuse by private persons and firms outside municipal boundaries. In exercising this authority, the board of commissioners may: (1) Issue licenses or permits for the collection and disposal of refuse. (2) Prohibit collection and disposal by unlicensed persons. (3) Grant licensed persons exclusive rights to collect in designated areas. (4) Regulate the fees charged for private collection services. (5) Operate collection and disposal services. Authority to Finance The 1967 General Assembly amended G.S. 153-77 and G.S. 153-80 of the County Finance Act to authorize the issuance of bonds for sanitary landfills and for vehicles and equipment. - 2 - .4 SECTION III - The Refuse Problem in Avery County survey ot Avery County was completed in 1968 and the clata been summarized on --the attached=taGle-. In -ad ition,- the -following -general -informat-ion was gathexedt resard to the storage, collection, and disposal of refuse. Storage: Some 12,655 people are living in areas of Avery County where there are no administrative regulations governing on -site storage. Refuse is stored on the ground, in 55-gallon barrels, or in other type containers, many of which have no lids. This provides ideal conditions for the breeding and feeding of flies, rats, and other pests. Collection: The refuse in the municipalities and in 5 percent of the county is collected once per week. sposal:___The_ study-revea-ls that an estimated 3,606 tons of_household, commercial,__ industrial, and institutional refuse is being collected annually by the towns and private collection firms in Avery County. This amount of refuse is being placed at the four land disposal sites shown on the enclosed map. All sites are operated as open dumps. The study reveals that there are approximately 10,102 people living in rural Avery County who have no collection or disposal service. Computing their annual production rate at less than the urban dweller, an estimated 3,606 tons of refuse is produced by them annually. No tonnage was estimated for the tourist population but it must be considered in preparing a solid waste plan. Part of this tonnage is being burned and part buried on the farm, but a large part is cluttering our farms, woodlands, streams, and highways. SECTION IV - Recommendations To protect the health of the people of Avery County and to prevent the depreciation of the county's environment, solid waste disposal shall meet the standards set by the North Carolina State Board of Health. - 3 - Storage: Solid waste storage shall meet the standards as set forth in Section IV of the th "Rules and Regulations Providing Standards for - Solid Waste Disposal." Collection: Solid waste collection within a municipality should be the responsibility of the local government. House -to -house collection in unincorporated areas shoul be left to private enterprise (private collectors). A container system should be provided for collection in those unincorporated areas where house -to -house service is not available or is not economically feasible. All solid waste collectors shall meet the standards as set forth in Section II of the North Carolina State Board of Health "Rules and Regulations Providing Standards for Solid Waste Disposal." Disposal: In the preparation of recommendations for the disposal of refuse by the sani- tary -landfill method, -- it is -necessary to consider---len-gth--of --haul-,-volume-of _ refuse, population density, and cost to county and municipalities. Based on these factors, it is recommended that: 1. The Avery County Board of Commissioners, in cooperation with the municipalities, provide one sanitary landfill in the general vicinity of the proposed location shown on the enclosed map to serve the total population of Avery County. 2. After the county site is opened, the present dumps should be closed and covered with two feet of compacted earth. Note: Soon after these dumps are closed and before they are covered with earth, they should be heavily baited with rat poison for at least two weeks. This will prevent the rat population from r: migrating to other areas. There is nothing in these recommendations that would prevent the individual from disposing of his own refuse as long as it is done in a manner approved by the Health Director. The disposal operation shall be in accordance with Section XI, North Carolina State Board of Health "Rules and Regulations Providing Standards for Solid Waste Disposal." - 4 - Supervision: In order that adequate supervision may be provided, it is recommended that th-e-Avery-C-aunty ealth-DeparLtment be -put c7her-ge-o-f—the-ope-ra-tion-. T-h--s wou-l-d consist of: promotion of this program, education of the public, and supervision of the landfill operation. SECTION V ® Cost Analysis The following cost estimates are based on the operation of one (1) sanitary landfill for the total population of Avery County, and a container system for collection as recom- mended in Section IV of this report. The containers would be serviced twice a week or as needed. 2. The containers would serve for household waste only. Other type waste would r be transported to the disposal site by the individual or by contract collector. 3. Municipalities and industry would transport their refuse to the disposal site or use collection firms. 4. Based on the solid waste disposal for the total population of Avery County, with an estimated population of 12,655 people, the annual operation cost for disposal would be $1.40 per person. 5. The container system serving the rural population which is estimated to be 11,224 people, the annual operation cost would be 64 cents per person. (This does not include the operator's salary which is included under disposal.) 6 - N VI _ Conclusion 1 in Avery County is due to a number -of Factors. tourist population. The pounds of disposed items per capita per day have doubled over the past decade. Regardless of whether the area of discussion is rural or urban, the disposable items are still the problem, only the quantity changes. 2. This is a problem that affects the total population from the farmer who is being dumped upon to the person who lives near an open, burning dump. 3. The Solid Waste and Vector Control Section of the State Board of Health, ealth department, is available_to__ass_is_t_inany_way_ possible. 4. The recommendations of this report were made to meet the anticipated needs for a ten-year period. (c) Completed areas shall be adequately sloped to allow surface water runoff in a controlled manner. (6) VEGETATION REQUIREMENTS (a) Within six months after final termination of disposal operations at the site on a major part thereof or upon revocation of a permit, the area shall be stabilized with native grasses. (b) Temporary seeding will be utilized as necessary to stabilize the site. (7) WATER PROTECTION REQUIREMENTS (a) The separation distance of four (4) feet between waste and water table shall be maintained unless otherwise specified by the division in the permit. (b) Solid waste shall not be disposed of in water. (c) Leachate shall be contained on site or properly treated prior to discharge. An NPDES permit may be required prior to the dis- charge of leachate to surface waters. (8) ACCESS AND SECURITY REQUIREMENTS (a) The site shall be adequately secured by means of gates, chains, berms, fences, and other security measures approved by the division, to prevent unauthorized entry. (b) An attendant shall be on duty at the site at all times while it is open for public use to ensure compliance with operational requirements. (c) The access road to the site shall be of all-weather construction and maintained in good condition. (d) Dust control measures shall be implemented where necessary. (11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS (a) A site shall only accept those solid wastes which it is permitted to receive. — (b) No hazardous, liquid, or infectious waste shall be accepted or disposed of in a sanitary landfill except as may be approved by the division. (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste, and other animal waste delivered to the disposal site shall be covered immediately. (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as amended through January 1,1985, may be disposed of separate and apart from other solid wastes at the bottom of the working face or in an area not contiguous with other disposal areas, in either case, in virgin soil. Separate areas shall be clearly marked so that asbestos is not exposed by future land -disturbing activi- ties. The waste shall be covered immediately with soil in a manner that will not cause airborne conditions. Copies of 40 CFR 61 may be obtained and inspected at the Solid and Hazard- ous Waste Management Branch, Division of Health Services, P. O. Box 2091, Raleigh, NC, 27602. (12) MISCELLANEOUS REQUIREMENTS —(a) Effective vector control measures shall be applied to control flies, rodents, and other insects or vermin when necessary. (b) Appropriate methods such as fencing and diking shall be pro- vided within the area to confine solid waste subject to be blown by the wind. The site is not the required 5,000 feet from the centerline of the air- port runway. This was delineated in the preliminary application, but it is approximately 4,000 feet east of the runway centerline and approximately opposite the north end of the runway. The site is not within the runway approach zone (landing and take -off) and will present no problems of interference with normal airport traffic. The lateral clearance slopes on airports are normally relatively steep (20:1) when compared to the approach slope (40:1). There should be no problem with respect to birds becoming a hazard, as the refuse deposited in the landfill on any given day is covered with earth on that same day. Unimin agrees to allow the County of Avery to obtain sufficient fill dirt and material for use on the 6.02 site, said fill dirt and material to be obtained from the lands of Unimin from areas designated_ by the Vice President of Operations, Unimin Corporation. 3: Avery County agrees to restore by reseeding all lands of Unimin disturbed by Avery County. -- - 4. Avery -County will continue to collect and deposit in the landfill all refuse which may be dumped, by whatever means and by whomsoever, on or immediately adjacent to any roadway leading to the premises which are within the bounds of the other lands of Unimin Corporation. Specifically, Avery County will be responsible for the collecting and depositing of the refuse dumped on the Brushy Creek Road and on the two sites which have been illegally used by the public as dumpsites. 5.
