Meyer, Head Solid & Hazardous Waste Management Branch SUBJECT: AVERY COUNTY FACT SHEET The following is a brief history of Avery County's landfill problems: March 19, 1984 Permit issued for a new landfill site. August 14, 1984 Permit surrendered by Avery County due to controversy surrounding land purchase. This issue is still in court. September 11, 1985 Received permit application for another site. November 18, 1985 Site application (permit) was denied (see attached). It is our understanding that Avery's present site has 2-3 months capacity. Options that have been discussed with them are: 1. Pursue agreement with Yancey/Mitchell County. 2. Evaluate possibility of another lift on top of existing site. Pursuant of the variance conditions of the Solid Waste Management Rules, our office will work with the County and Health Department to insure that an imminent health hazard does not occur. Levine, M.D., M.P.H. State Health Director The Division of Health Services has reviewed the application for the proposed landfill site on Harris Mining Company Property. Even though the application was not entirely complete, those deficiencies will not -affect -the site review ec s on. The Division has made a decision to deny a permit for this specific site. This decision is based on the fact that existing surface and subsurface conditions, including high permeabilities and hydrogeologic diversity within the underlying soils, do not provide an adequate safeguard for groundwater quality and that a contravention of groundwater standards as established under 15 NCAC 2L will occur. You may appeal this decision within 30 days after you receive this notification by requesting an administrative hearing concerning this matter. The request must be submitted in writing to Mr. William L. Meyer, Head, Solid and Hazardous Waste Management Branch, Division of Health Services, P.O. Box 2091, Raleigh, North Carolina, 27602, and must state the legal and factual issues in dispute. When a hearing is requested, it shall be in accordance with the rules contained in 10 NCAC 1B .0200, a copy of which is enclosed. This decision is subject to review at an administrative hearing upon petition of anyone whose legal rights, privileges, and duties may have been affected by the issuance thereof. If accordance with .0203 of the Solid Waste Management Rules the following items are an estimate of what is needed in the way of permit modification so that Avery County might obtain a permit for this specific site: 1. Complete deficiencies so that application addresses all applicable subparagraphs in Rule 0504(1)(c) including (iG), (JH), (ii), (iii). 2. Modify conceptual design plan to show specific and detailed plans for procedures and devices that would protect groundwater in accordance with 15 NCAC 2L (see enclosure). 3. Part of the property does not meet requirements of .0503 1(c).
