This inspection was performed to determine compliance with the North Carolina Sedimentation Pollution Control Act of 1973. The inspection revealed a land -disturbing activity of approximately 5 acres being conducted. It is our understanding that you and/or your firm are responsible for this land - disturbing activity. The purpose of this letter is to inform you that this activity was found to be in violation of the Act, NCGS 113A-50 to 66, and Title 15A, North Carolina Administrative Code, Chapter 4. If you feel that you are not responsible for the following violations, please notify this office immediately. The violations that were found are: Failure to conduct a land -disturbing activity in accordance with the provisions of an acceptable erosion and sedimentation control plan. NCGS 113A-61.1. The erosion and sedimentation control plan approved by this office on October 26, 1990, must be immediately implemented on the site sufficient to prevent offsite sedimentation. Specifically, the sediment basins on the river side of the site have not been installed or provided as contained in the plan. Failure on a tract of more than one acre, when more than one contiguous acre is uncovered, to provide ground cover sufficient to restrain erosion on such exposed areas within 30 working days or 120 calendar days, which- ever is the shorter, after completion of construction or development. NCGS 113A-57(3); also 15A NCAC 4B.0007(b). Over 30 working days have passed and a ground cover sufficient to restrain erosion has not been established. 3. Failure on a tract of more than one acre, when more than one contiguous acre is uncovered, to install sedimentation and erosion control devices sufficient to retain the sediment generated by the land -disturbing activity within the boundaries of the tract during construction upon and development of the tract. NCGS 113A-57(3). Insufficient sedimentation and erosion control devices or structures have been installed to retain sediment within the boundaries of the tract under development. 4. Failure to take all reasonable measures to protect all public and private property from damage by such land -disturbing activities. 15A NCAC 4B.0005. Offsite damage has occurred due to sediment washing into the Little Tennessee River. 5. Failure to retain along a lake or natural watercourse a buffer zone of sufficient width to confine visible siltation by natural or artificial means within the 25 percent of that portion of the buffer zone nearest the land -disturbing activity. NCGS 113A-57(1). Sediment from the site has entered the Little Tennessee River adjoining the site. 6. Failure within 30 working days of completion of any phase of grading to plant or otherwise provide exposed, graded slopes or fills with ground cover, devices, or structures sufficient to restrain erosion. NCGS 113A- 57(2). No ground cover or erosion control devices or structures have been provided sufficient to restrain erosion on the site. To correct these violations, you must implement the erosion control plan as approved immediately and install additional measures if required to retain sediment on site. After installation, all erosion control measures must be maintained in proper working order until development is complete and the site is completely stabilized. Please be advised that if you fail to respond this Notice or if these violations are not corrected on or before tt 24, 1991, the Director, Division of Land Resources, will be requested to take appropriate legal actions against you pursuant to NCGS 113A-64. That action could be the assessment of a civil penalty and the amount may be up to $500 00 per day for each day of the violation. The penalty may be assessed from the date of your receipt of this Notice of Violations (15A NCAC 4C.0007). If these violations are corrected Mr. Jack Horton July 11, 1991 Page 3 within the time period specified for compliance, no further legal action will be pursued. Please be advised that any new land -disturbing activity associated with this project must not begin until the area presently disturbed is brought into compliance with the Act. When corrective actions are complete, you should notify this office so the work can be inspected. You should not assume that the property is in compliance with the Act until we have notified you. We solicit your cooperation, and would like to avoid taking further enforcement action. At the same time, it is your responsibility to understand and comply with the requirements of the Act. Copies of the relevant statute and administrative regulations may be examined at this office or will be sent to you upon request. Meyer Director Re: Ground Water Monitoring Wells At The Macon County Landfills (Permit #57-01 and 57-02) Dear Mr. Wood, Our office has reviewed the monitoring well survey submitted by Westinghouse Environmental and Geotechnical Services, Inc. on behalf of Macon County. The evaluation and conclusions made by Westinghouse appear to be essentially correct. In designing ground water monitoring wells it is generally required that the wells be constructed so that the water table always falls within the screen. If this design criteria were strictly enforced, then all of the existing monitoring wells at both the Franklin and Highlands Landfill sites would need to be replaced. However, since many of the older monitoring wells at existing landfills are constructed in a similar manner, the Solid Waste Section will permit the use of some of these wells as part of the monitoring system at the Franklin Landfill. FRANKLIN LANDFILL: Westinghouse has proposed abandoning the existing wells and installing five new shallow wells and one new deeper bedrock well for the Franklin Landfill. Since the Solid Waste Section has decided to -permit the use of some of the existing wells, we are proposing the construction of five new shallow monitoring wells. All shallow wells should be constructed using 15 foot screens placed so that the seasonal high water table falls just below the top of the screen. Existing monitoring wells MW-1 and MW-4 may be used as part of the monitoring system. Well MW-2 may also be used, however this well is screened to monitor the water quality deeper in the aquifer. Therefore, an additional monitoring well should be installed in the same area as MW-2 that will monitor the upper part of the aquifer at the water table. Installing a shallow well in this area will create a well nest at the location of existing well MW-2. Well MW-3 may also be used for monitoring at this time, although the location of this well is not the best. After this well is sampled as part of the base -line sampling, a determination will be made as to whether MW-3 should continue to be monitored on a regular basis. An Equal Opportunity Affirmative Action Employer Page 2 Two addition shallow monitoring wells should be installed near the sedimentation basins, in the approximate locations proposed by Westinghouse. Since waste has been disposed of in the area sloping down to the East, an additional shallow monitoring well needs to be installed near the sedimentation basin in this area also. An effective upgradient well to determine background water quality needs to be established for the Franklin Landfill site. As discussed in the field, this may be difficult to do on the existing permitted area. The proposed well nest as located by Westinghouse could be affected by waste disposal in this area. It may be necessary to locate the background well on adjacent property owned by the County in order to obtain a true background water quality sample. Surface water sampling is also required at all solid waste management facilities. There is no stream on or immediately adjacent to the landfill site except for the spring below the landfill. This spring should therefore be sampled as part of the routine monitoring for the Franklin site. The spring should be sampled at the same time and for the same parameters as the monitoring wells. HIGHLANDS LANDFILL: The existing monitoring wells at the Highlands site are located too far away from the waste disposal area to be useful in determining the effects of the facility on the ground water of the area. Therefore new monitoring wells need to be constructed at this site. The general locations proposed by Westinghouse appear to be adequate. One upgradient well and three downgradient well locations should be used. A well nest should be installed at the downgradient location on the North side of the site, as suggested by Westinghouse. However, a well nest will not be required at the upgradient location. One shallow well, screened at the water table, will be adequate at the upgradient location. The upgradient well should be located sufficiently far away from any waste disposal activities to ensure that a true background sample can be obtained. A surface water sample should also be taken at the previously approved location on the stream downgradient of the Highlands Landfill, above where the stream crosses Wilson Gap Road. Thus, the monitoring system will consist of four shallow monitoring wells, one deeper monitoring well, and one downstream surface water sampling location. FRANKLIN AND HIGHLANDS LANDFILLS: The new monitoring wells should be installed by September 30, 1991. Well Completion Records (DHS 3342) should be submitted to our office within 15 days of well completion. Typical well schematic diagrams and boring logs should accompany the Well Completion Records. None of the existing wells should be abandoned at this time. Page 3 After installation and development of the new monitoring wells at both landfill sites, a base -line sampling should be scheduled for late October. All monitoring wells and surface water monitoring points should be sampled for the regular landfill parameters, as outlined on page 12 of the "North Carolina Water Quality Monitoring Guidance Document For Solid Waste Facilities". Sample analysis should also be done for volatile organic analysis (EPA Method 8240), and semi -volatile organic analysis (EPA Method 8270) for all samples. After the results of the base -line sampling are evaluated by the Section, the sampling frequency and parameters for future sampling events will be determined. Past sample results at the Franklin Landfill would indicate the need for some further assessment of water quality at this site. All well design details and sampling equipment and procedures must conform to the above referenced Guidance Document. Highlands Swain County Yesterday I called Mr. Hocutt to determine if the above Bryson City referenced permit letters which approved sludge disposal in the Clay County landfill could be amended to include disposal in the Macon County landfill. Mr. Hocutt said that he could give me verbal approval for such, contingent upon the concurrence of Jim Patterson who is the field representative of the Solid Waste Section. In a telephone conversation today, Mr. Patterson agreed that disposal at the Macon County landfill was acceptable. In addition, it was agreed that this memorandum, together with the above referenced permit letters would be sufficient documentation for Macon County to accept the sludge. The Town of Andrews and Murphy now need to make arrangements with Mr. Horace Ledford, Macon County Landfill Supervisor, to receive the sludge. He can be reached at (704) 524-6421. Orr Regional Manager The 1989 General Assembly passed Senate Bill III "An Act to Improve Management of Solid Waste." On July 9, 1991, the General Assembly ratified House Bill 1109 "An Act to Improve Management of Nonhazardous Solid Waste, to Redefine the State Solid Waste Management Goals, and to make Clarifying, Conforming, and Technical Amendments to the Solid Waste Management Laws." General Statute 130A-309.09A(f) now states that after July 1, 1991, each operator of a municipal solid waste management facility shall weigh all solid waste when it is received. The exclusion of facilities which will not be in operation after the effective date of this section of the Solid Waste Management Act was deleted. It is the position of the Section that the weighing of waste at all landfills which will receive waste after July 1, 1991, is especially important due to the July 1, 1991 - June 30, 1992, baseline period for document waste reduction activities as provided in the North Carolina Statutes. Pursuant to N.C.G.S. 130A-22(a) and to 15A North Carolina Administrative Code 13B, I conducted an inspection on September 9, 1991, of the Macon County Franklin Sanitary Landfill, Permit No. 57-01, located on State Road 1325 near Franklin, North Carolina. The inspection found that there were no means to weigh solid waste when it is received.
