Cobey, Jr., Secretary This letter is to inform you that the practice of allowing anyone to have keys to the landfill gate for after-hours dumping would violate several of the North Carolina Solid Waste Management Rules. Please advise persons, requesting keys that N. C. Solid Waste Management Rules prohibits this practice and that they will have to make arrangements to bring waste to the landfill during normal operating hours. (8) ACCESS AND SECURITY REQUIREMENTS (a) The site shall be adequately secured by means of gates, chains, berms, fences, and other security measures approved by the division, to prevent unauthorized entry. —_ (b) An attendant shall be on duty at the site at all times while it is open for public use to ensure compliance with operational requirements. (e) Barrels and drums shall not be disposed of unless they are empty and perforated sufficiently to ensure that no liquid or hazard- ous waste is contained therein. (11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS — (a) A site shall only accept those solid wastes which it is permitted to receive. — (b) No hazardous, liquid, or infectious waste shall be accepted or disposed of in a sanitary landfill except as may be approved by the division. (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste, and other animal waste delivered to the disposal site shall be covered immediately. — (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as amended through January 1,1985, may be disposed of separate and apart from other solid wastes at the bottom of the working face or in an area not contiguous with other disposal areas, in either case, in virgin soil. Separate areas shall be clearly marked so that asbestos is not exposed by future land -disturbing activi- ties. The waste shall be covered immediately with soil in a manner that will not cause airborne conditions. Copies of 40 CFR 61 may be obtained and inspected at the Solid and Hazard- ous Waste Management Branch, Division of Health Services, P. O. Box 2091, Raleigh, NC, 27602. (11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS — (a) A site shall only accept those solid wastes which it is permitted to receive. — (b) No hazardous, liquid, or infectious waste shall be accepted or disposed of in a sanitary landfill except as may be approved by the division. — (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste, and other animal waste delivered to the disposal site shall be covered immediately. — (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as amended through January 1,1985, may be disposed of separate and apart from other solid wastes at the bottom of the working face or in an area not contiguous with other disposal areas, in either case, in virgin soil. Separate areas shall be clearly marked so that asbestos is not exposed by future land -disturbing activi- ties. The waste shall be covered immediately with soil in a manner that will not cause airborne conditions. (12) MISCELLANEOUS REQUIREMENTS (a) Effective vector control measures shall be applied to control flies, rodents, and other insects or vermin when necessary. AMENDMENT TO PERMIT NO. 57-01 DATE ISSUED 02/09/89 SOLID WASTE PERMIT (SANITARY LANDFILL) CONDITIONS OF —PERMIT: - --- - 1. This permit shall not be effective unless the certified copy is filed in the Register of Deeds Office, in the grantor index under the name of the owner of the land in the county or counties in which the land is located. After recordation, the certified copy shall be returned to the Solid Waste Branch and shall have indicated on it the page and book number, date of recordation, and Register's seal. 2. When this property is sold, leased, conveyed or transferred, the deed or other instrument of transfer shall contain in the description section in no smaller type than that used in the body of the deed or instrument a statement that the property has been used as a sanitary landfill. 3. This solid waste disposal site is permitted to receive solid waste as defined in 10 NCAC 10G, .0101(36), except that hazardous waste, liquid waste and any other wastes that may pose a threat to the environment or public health are prohibited from disposal at this site. 4. This permit is for construction according to the attached plans with the following conditions. a. This is a phased construction plan with the approved phase not to exceed two years from the issuance date of the permit. b. Earthen berms will be constructed as shown on plans, prior to disposal of waste. Additional conditions and revisions of the approved plans shall be approved by the North Carolina Solid Waste Branch. 5. This facility shall conform to operating procedures in Rule .0505 of the Solid Waste Management Rules. 6. Proper operation and management of this facility must conform to the standards referenced in Section .0503(2)(d) of 10 NCAC 10G. 7. A closure and post -closure plan must be submitted for approval at least 90 days prior to the expiration date of this permit. The plan must include all steps and measures necessary to ensure closure and minimize further maintenance of the site in accordance with all rules in effect at the date of closure. Final cover requirements, specifically the degree of protection which will be required at closure, will be determined by an assessment of ground -water monitoring results over the next two years of operating life. Conditions of Permit Page 2 8. Analytical data acquired from ground water monitoring events dated Oct. '86, June '87, May '88, necessitate implementation of a Phase II Monitoring Plan. Protocol for Phase II Monitoring is detailed in Attachment One. The issuance date of this permit shall initiate Phase II monitoring events. Attachment One Macon County, Permit #57-01 February 9, 1989 Phase II Monitoring Plan - Pursuantto-NCAC-10G - 0601 of the-N-ar-tly--Carolina solid waste Management Rules, Macon County shall be required to implement a Phase II ground water monitoring plan. The scope of this plan is to determine the concentration of specific hazardous constituents and assess their associated risk to human health and the environment. This plan shall include the sampling of ground -water monitoring wells, and the submittal of a hydrogeologic report documenting the concentration and source of contamination. The following is a detail of the required events. 1. Identify the Parameters An initial sampling and subsequent analysis for approximately 247 organic and inorganic constituents (see Attachment Two) is required as part of this plan. For this initial analysis, the Branch approves the use of EPA methods at minimum detection limits (MDLs), in all wells. The county will notify the Solid Waste Branch when the sampling date has been arranged. Submittal of the comprehensive analysis marks the completion of this event. 2. Quarterly Sampling The Solid Waste Branch will evaluate the initial data and define the parameters ("triggered constituents") to be monitored. The county will be required to sample all of the wells on a quarterly basis for the individual chemical constituents which exceed an established standard, or, in the case of most organics, those constituents which exist above minimum detection limits. Upon completion of one year of monitoring data, (four sampling events) this office will evaluate the data with the county to ascertain the potential impact upon public health and the environment, and subsequently, determine the extent of any remedial action. 3. Statistical Analysis In order for this office to make this determintation, the county shall submit a statistical analysis to this office upon completion of the four quarterly sampling events referenced above. The report will assess whether or not a statistically significant increase has occurred over time. One of the statistical procedures found on Attachment Three must be used to make this determination. Scope Acceleration If data obtained from a single sampling event indicates an -- imminent and substantial threat to public health or the -- environment, then, based upon what is found, the county will be required to immediately define the vertical and horizontal extent of the plume including vertical gradients, aquifer hydraulic conductivities, and other subsurface hydrogeologic characteristics which are necessary to design and implement a corrective action plan. 5. Schedule EVENT 1. Meyer Director Wells at the Macon and Permit #57-02) Upon a recent review of our files, our office found that we do not have sufficient documentation on the ground -water monitoring wells at the Macon County landfill facilities. Within the next 30 days would you please provide our office with the following information: 1. A map (preferably 8 1/2" x 1111) for each landfill facility delineating the entire landfill and adjacent property owned (or leased) by you. Each map should clearly show the location of the landfill with respect to the entire property. 2. A specific site map of each landfill illustrating the configuration of the landfill per the current permit description. on each of these maps also indicate the following: a. Areas of Past landfilling activity b. Area of present landfilling activity c. Areas of proposed future landfilling activity d. Areas of demolition waste landfilling e. Locations of existing monitoring wells; Each well should be numbered on the map (e.g. MW-1; MW-2; etc.) in a manner corresponding to the designations of the wells in the field. 3. Complete and accurate Well Completion Records (DHS 3342) for all ground -water monitoring wells. These records should clearly indicate the following: Page 2 a. Well construction specifications pertaining to inner/outer casing diameter b. Borehole depth C. 24-hour water table elevations d. Screen length Scr-e-e—s-l-ot s-i-ze f. Vertical extent of screen (e.g. where the screen is placed in the aquifer). g. Which wells are "upgradient" and which wells are "downgradient". h. All other data required on well construction forms as specified in the "N.C. Water Quality Monitoring Guidance Document for Solid Waste Facilities". In addition, please submit to us a summary of the hydro - geological data accumulated for the landfill sites from the boring operations. Include boring logs and other pertinent subsurface information. Also, designate in writing to this office the name of the contractor you have chosen to perform your annual ground and surface water monitoring extractions, and the date on which you plan to perform your annual sampling.
