STATE HEALTH DIRECTOR June 3, 1983 On April 28, 1983, Richard Moore and Dennis Owenby with the Land Quality Section of the Department of Natural Resources and Community Development accompanied me on an inspection of the Macon County landfill. I discussed problems found and remedial measures needed with you on May 31, 1983 and you agreed to a compliance date of June 30,1983. Our agreement was as follows: The cut slopes above the landfill, not now being used for excavating cover material, as well as any completed fill areas need to be vege- tated. A culvert is needed under the access road to channel water into the small basin on the lower right hand side of the landfill. The basins below the center of the landfill need to be cleaned out. For optimum sediment control, the engineering firm which is working on your landfill plan should design and you should construct an adequately sized basin to accomodate drainage from the entire site with provisions for proper filtration and storage and an emergency spillway. The small area over which you are moving cleared brush should be seeded when brush moving is complete. Except for the last two situations mentioned this work should be com- pleted by June 30, 1983. Any violations of the SOLID WASTE MANAGEMENT RULES are subject to administrative penalties or injunctive action pursuant to General Statute 130-166 21E. Box 8314 Charlotte, Nc 28208 Re: Asbestos Disposal from Macon County Schools at Macon County Landfill Dear Mr. Horton: The Division of Health Services has no objection to disposal of asbestos waste in permitted sanitary landfills if performed in accordance with 40 CFR Part 61. The following procedures should be followed: 1. Permission from the owner/operator of the landfill should be obtained prior to delivery since the owner/operator has the right to deny acceptance of any waste. 2. A copy of this letter should accompany the waste at time of disposal. 3. The waste is placed wet into plastic bags and securely sealed to prevent an airborne condition during handling. 4. The operator shall be notified that the waste is to be covered immediately with sufficient amounts of dirt or other waste so as to prevent an airborne condition during final disposal. 5. The operator shall place the waste as far from the top of the landfill as possible, but in no case within ten (10) feet of the landfill surface. The preparation of the asbestos and delivery should comply with OSHA and DOT standards. If you have questions concerning this matter, please advise. Box 69 Franklin, NC 28734 Re: Disposal of Approximately 20 Drums/Month of Sludge (WWTP & Lapping Sludge) at Macon County Landfill Dear Mr. McFalls : The Division of Health Services has received a request for characterization of the subject waste. Based upon the submitted information, the waste appears to be non -hazardous. DHS has no objection to the sanitary landfill disposal of this waste if in accordance with the conditions below: 1. The waste is non -liquid and can be confined, compacted, and covered in accordance with the "Solid Waste Management Rules". 2. The owner/operator of the landfill approves the disposal. 3. The waste remains non -hazardous as determined by the current RCRA regulations, 4. The waste is removed from the drums before disposal. Failure to meet these conditions may result in revocation of this approval and an administrative penalty. This approval is subject to change if new regulations were to prohibit this practice. If the process which generates the waste changes or if the composition of the waste changes significantly, this approval is voided, and re-evaluation of the waste will be required prior to disposal.
