PURPOSE OF SITE VISIT: New Vehicle STATUS OF PAST NOTED VIOLATIONS:
On 05/04/2016, an inspection was conducted of a new pumper vehicle identified by Tag # YA130556 and
VIN # 5KKHAVDV3HPW323. The pumper vehicle was observed to be in violation of Rule 15A NCAC 13B
.0844(b) because the permit number, city name, and a portion of the name were measured to be under 3
inches in height. See attached inspection report from 05/04/2016. A permit application was received on
05/16/2016 to change the Firm name to Overbey’s.

OBSERVED VIOLATIONS:
1) Upon inspection of the pump truck identified by License Plate #, YA157642, and VIN #,
5KKHAVDV3MPMT1480, the lettering of the town name was measured to be less than three (3) inches
in height. The lettering of the town name is in violation or Rule 15 A NCAC 13B .0835(b) that states “All
permitted septage management firms shall display lettering on each side of every pumper vehicle
operated by the firm. The lettering shall include the firm name, town name, phone number, and
septage management firm permit number as shown on the firm application. All lettering required by
this Rule on the pumper vehicle shall be no less than three inches in height and legible, distinguishable
from the background, and not obstructed from view. Identification shall not be removable (i.e. no
magnetic signs).” The lettering of the town name on both sides of the pumper vehicle must be
corrected to be three (3) inches or greater in height. Either update the current lettering of the town
name to be three (3) inches or greater in height or place the town name elsewhere on both sides of
the pumper vehicle with the lettering being three (3) inches or greater in height. The lettering must
also be legible and distinguishable from the background, and not obstructed from view.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1) Pumper vehicle(s) inspected:

2) The required information of Firm name, town name, phone #, and permit # was on both sides of the
pumper vehicle. Each letter of the Firm name, phone #, and permit # was three (3) inches or greater in
height. However, the letters for the town name were measured to be less than (3) inches in height. The
lettering for the town name is in violation of Rule 15 A NCAC 13B .0835(b) as stated above in “Observed
Violations.”
3) The tank is made of steel. The tank is affixed to the frame of the truck as per Rule 15A NCAC 13B
.0835(a)(1).
4) The valves appeared to be in working order and closed as per Rule 15A NCAC 13B .0835(a)(2). Caps
present on ports.
5) Access ports were closed and properly sealed as per Rule 15A NCAC 13B .0835(a)(3).
6) No leaks noticed as per Rule 15A NCAC 13B .0835(a).
7) Pumper vehicle is not in compliance with Septage Management Rules due to the violation to Rule 15 A
NCAC 13B .0835(b).
8) Ricky said that the town name is the same on this pumper vehicle as the previous inspected pumper
vehicle approximately four (4) years ago. Ricky showed me the pumper vehicle and I recorded the
following vehicle information off the pumper vehicle: License Plate #, YA130556, and VIN #,
5KKHAVDV3HPHW3234. I found the inspection report documenting the inspection of that pumper

vehicle on 05/04/2016. An “Observed Violation” was noted for several lettering issues. One of the
issues noted was the lettering of the town name being “under 3 inches in height.” I have attached that
inspection report. I have not found any documentation that the lettering of the town name was ever
corrected. The lettering of all pumper vehicles operating under this permit needs to be checked to
confirm that the lettering complies with Rule 15 A NCAC 13B .0835(b).

15A NCAC 13B .0844 (b) states: “All permitted septage management firms shall display decals or lettering on each side
of every pumper vehicle operated by the firm. The decals or lettering shall include the name, address (town name), phone
number, and septage management firm permit number. All decals or lettering on the pumper vehicle shall be no less than
three inches in height and plainly visible. Identification shall be permanently attached (i.e., no removable signs).”
On May 4, 2016, Overbey’s Septic Tank Service, Inc. was in violation of 15A NCAC 13B .0844 (b) because the permit
number, city name, and a portion of the name were measured to be under 3 inches in height.
In order to come into compliance, by May 20, 2016, Overbey’s Septic Tank Service, Inc. must correct the required
lettering to no less than 3” in height. As discussed on 5/5/2016 via telephone, an option would be to resubmit the
“Application to Operate a Septage Management Firm” (application) and only put “Overbey’s” as the firm name. For the
city name and permit number, you have the option to correct lettering on the pumper vehicle or place additional lettering
elsewhere on both sides of the vehicle to at least 3” or larger.

ADDITIONAL COMMENTS
1. The following vehicle was observed at the North Carolina DOT Rest Area located just off the West Bound
Lane of I-40 in McDowell County.

2. The pumper vehicle was observed with proper lettering requirements with the exception of the 3 inches height
requirement. The permit number, city name, and a portion of the name were measured to be under 3 inches in
height.

3. The tank appeared to be structurally sound, constructed of approved materials and permanently attached to the
vehicles.
4. The valves and access ports appeared to be in working order with caps on all access ports.
5. No leaks were observed.
