OBSERVED VIOLATIONS:
A. 15A NCAC 13B .0203(d) states `By receiving solid waste at a permitted facility, the permittee shall be
considered by the Department to have accepted the conditions of the permit and shall comply with the conditions
of the permit." The Permit to Operate, Part IV: Transfer Station/Treatment & Processing Unit(s), 20 (b) states
"Waste must only be deposited on a "tipping floor" or directly into a transfer container. Waste must not be stored
on the "tipping floor" after operating hours."
Garbage Pal, LLC is in violation of 15A NCAC 13B .0203(d) for storing waste on the tipping floor after
operating hours. On the morning of January 25, 2022 at 6:40 am, a pre -operational inspection of the
treatment and processing facility was conducted to ensure that all waste was being removed from the

tipping floor as required by the Permit to Operate, Part IV: Transfer Station/Treatment & Processing
Unit(s), 20(b). During the inspection, construction and demolition waste was observed on the tipping floor
that had been left there from the previous operational day.
To correct the violation, Garbage Pal, LLC must remove all waste from the tipping floor and ensure waste
is not stored on the tipping floor after operational hours as required by Permit to Operate, Part IV:
Transfer Station/Treatment & Processing Unit(s), 20(b).
B. 15A NCAC 13B .0203(d) states `By receiving solid waste at a permitted facility, the permittee shall be

of the permit." The Approved Operations Plan (FID 1595832), Section 3.1, states in part... "all wastes will be
removed from the tipping floor and placed into the appropriate container by the end of each operating day."
Garbage Pal, LLC is in violation of 15A NCAC 13B .0203(d) for failing to remove all waste from the
tipping floor by the end of each operating day as required by the Approved Operations Plan (FID
1595832), Section 3.1. On the morning of January 25, 2022 at 6:40 am, a pre -operational inspection of

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on January 25, 2022.
2. The facility is permitted to receive construction or demolition debris or waste as defined in NCGS 130A-
290(a)(4), inert debris as defined in NCGS 130A-290(a)(14), recyclable materials as defined in NCGS 130A-
290(a)(26), and special wastes defined in NCGS 130A-290(a)(40).
3. The facility is secured by gates and fencing to prevent unauthorized access.
4. Signage is posted at the entrance to the facility providing the types of material that are accepted, permit number
and emergency contact information.
Records Review
5. The Permit to Operate and Approved Operations Plan were available for review upon request.
6. The facility has accepted 3856.44 tons of material since receiving their Permit to Operate on October
18, 2021.
7. Waste screenings from October 21, 2021 to January 6, 2022 were reviewed. The forms document the
types of material being screened as well as photographs of the screening. The forms also showed the
final disposition of any unacceptable waste that was encountered.

Operations Inspection of the Treatment and Processing Facility
9. The treatment and processing building is located on the south side of the facility.
10. Material is deposited on the tipping floor, sorted by facility staff and placed in the appropriate container for
recycling or disposal.
11. On the morning of January 25, 2022 at 6:40 am, a pre -operational inspection of the treatment and processing
facility was conducted to ensure that all waste was being removed from the tipping floor at the end of each
operational day as required by the Approved Operations Plan and the Permit to Operate. During the inspection
construction and demolition waste was observed on the tipping floor that had been left there from the previous
operational day. All material must be removed from the tipping floor at the end of each operational day, See
Observed Violations Section of this report for additional information. Additional pre -operational
inspections will be conducted to ensure compliance with the Approved Operations Plan and the Permit to
Operate.
12. The leachate drain is located in the center of the tipping floor and appeared to be working properly. The
leachate containment system is connected to the Cane Creek Sanitary Sewer System.
13. Windblown material was minimal and well managed at the time of inspection.
14. Shingles and untreated wood are removed from the tipping floor and are stored on a concrete pad in separate
stockpiles on the west side of the treatment and processing building. The material is then transported by loader
to the grinding area which is located to the east of the treatment and processing building.
15. A small amount of painted wood was observed in the grinding stockpile. Remove the painted material before
grinding. Engineered wood was also observed in the stockpile. Facility staff stated that the ground material
was being sent to Evergreen Packaging in Canton for boiler fuel. Staff also stated they were planning to make
landscaping mulch in the future. Engineered wood can only be ground for boiler fuel and CANNOT be
used for landscaping mulch.
