ADDITIONAL COMMENTS 1. Andrew Hammonds and David Powell conducted a follow up inspection to determine the status of required corrective actions outlined during multiple inspections, Notice of Violation letters, and a Compliance Order with an Administrative Penalty. Upon arrival, Section staff met with office staff Chondrika McCoy and informed her of their arrival and reason for their visit. Ms. McCoy indicated that neither Mr. nor Mrs.
Gilmore were onsite. Section staff informed Ms. McCoy when the inspection was completed and gave her a business card. 2. The facility is still operating by taking several types of waste and burying them despite numerous notifications of being told to “CEASE OPERATIONS.” Some of the waste discovered was recently cut, given some of it was still green, and comingled amongst the waste stockpiles that were onsite.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

3. In the NW corner near the front of the property, more vegetative wastes have been brought in and piled up in a larger area, between the office, I-95, and the dirt access roadway.

4. Vegetative wastes, older C and D waste from onsite and some newer C and D waste from offsite are located on top of the closed notified land clearing and inert debris landfill (NLCID) - Eagle Refuse. Plastic, foam, wire, and other wastes are still comingled in the soil on top around the C and D wastes.

5. In addition, the owner(s) of this property continue to allow the dumping of drilling mud in various areas of the property. During this inspection, it was observed that mud had been dumped on top of the closed NLCID on the ~ NE side and allowed to run downhill. Several areas showed signs where dumping had occurred recently.

6. Waste is also still being brought in and dumped in the back of property along, and at end of dirt road access. Waste loads consist of comingled vegetative debris, rock, concrete block, dimensional treated lumber, plastic, and soil. Previous waste, that was confirmed asbestos and contained heavy metals, appears to have been covered due to the additional loads of waste disposed on the property. No information or action plan was ever provided to the Section confirming removal of this or other waste from the site. Could not access the entire site as the waste had been dumped and pushed into the access road. It appears that the size of the waste disposal area has increased to over two acres with some of the piles pushed up with a bulldozer.

7. GFD (Gilmore’s Farm Development) trucks were onsite with waste inside truck beds, one below in photo had vegetative wastes.

8. Corrective measures are still necessary as a result of this inspection.
9. At time of this inspection no documentation has been provided for removal of hazardous wastes or any other wastes. 10. Dump and Go facility should cease accepting any waste and not burn any more waste. Owners have been instructed numerous times to cease accepting waste until all violations are resolved. This also means cease covering and burying with soil. 11. Remove all waste from the top of the closed NLCIDLF. Unacceptable waste removed from the closed NLCIDLF must be removed and taken to properly permitted landfill for that waste type. Send all documentation on where loads of waste have come from and gone too, to date. Maintain and provide documentation of all waste loads leaving in regard to cleanup activities.
