STATUS OF PAST NOTED VIOLATIONS: NA Observed Violations
Violations of the following rules were observed during this inspection: On Field 1, septage material approximately 1 inch thick was observed coating the ground surface on the east end of the field was indicative of uneven application or overapplication of septage in a localized area in violation of the following rule. 15A NCAC 13B .0842(a)(11) all septage discharges shall be made at a location on the site consistent with the nutrient management plan; where section E of the NMP under Application Method indicates that the prescribed application rates dictated by the NMP are based on “septage being evenly applied over the entire permitted site by a pressurized vacuum
truck or hose cart on the surface”. An NOV was issued for the following rule violations: During the site inspection a pumper vehicle operated by Atlantic OBX (Atlantic Sewage Control) was observed applying
septage on Field 2. Within 10 minutes of the septage application, a pH test of the liquid material applied remaining in the spreader spoon of the truck was conducted using pH indicator strips. Based on the results of the test, the pH of the septage applied to the site was determined to be between 5 and 6 in violation of the following rule and federal codes.

15A NCAC 13B .0842 (c)(1) domestic septage shall be treated in accordance with the requirements in 40 CFR 503 D (including Appendix A and B) except that 503.33(b)(11) is not incorporated; where: 40 CFR 503.32(c)(2) requires “The
pH of domestic septage applied to agricultural land, forest, or a reclamation site shall be raised to 12 or higher by alkali addition and, without the addition of more alkali, shall remain at 12 or higher for 30 minutes and the site restrictions in §
503.32 (b)(5)(i) through (b)(5)(iv) shall be met” and 40 CFR 503.33(b)(12) states, “The pH of domestic septage shall be
raised to 12 or higher by alkali addition and, without the addition of more alkali, shall remain at 12 or higher for 30 minutes”. Liquid and semi-solid material having the appearance of septage was observed on an unpermitted field adjacent to Field 4. Stephen Cummings, (Field General Manager, Atlantic OBX) explained that it was where employees were dumping wash
water generated during the process of washing out pump truck tanks used for land applying septage. The practice described is a violation of the following rules and statutes: 15A NCAC 13B .0832(h)Washings from the interior of septage handling containers such as pump trucks shall be managed as septage. N.C.G.S. 130A‐291.1(d) Septage shall be treated and disposed only at a wastewater system that has been approved by
the Department under rules adopted by the Commission or by the Environmental Management Commission or at a site that is permitted by the Department under this section. A permit shall be issued only if the site satisfies all of the requirements of the rules adopted by the Commission.
15A NCAC 13B .0840(a)No person shall establish or allow to be established upon any real property owned, operated, leased, or controlled by that person, a septage management facility to treat, manage, store, or dispose of septage, or any
component of septage, unless a permit has been obtained from the Division. Septage shall not be disposed of by trenching or burial.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS
1) The access roads to the disposal area were posted with the required signage that was visible and legible.
2) The roads accessing the site were passable. 3) The disposal area boundaries were marked on the ground visibly and were distinguishable from the surrounding landscape.
4) On the permitted fields no discharges were noticed outside of the permitted boundaries. On an adjacent unpermitted field septage wash water was observed discharged onto the ground surface, please see observed violations on page 1 of this report.
5) On field 1 a thick, uneven application of septage was observed on the eastern end of the field. On field 2 a septage application was observed being applied without liming where the pH of the septage at the time of application was between 5and 6. All other applications appear to be made in accordance with the nutrient management plan 6) The warm season crop described by the nutrient management plan was dormant, no evidence of winter overseeding was discernable. Weedy species were noticeable in areas of all fields. 7) No objectional odors where noticed. 8) Required setbacks appear to be met. 9) Records were not inspected at the time of the site inspection. 10) NOVs were issued for Applying septage to an unpermitted field and applying septage at a pH less than 12.
