STATUS OF PAST NOTED VIOLATIONS: Corrective Action in Process.
OBSERVED VIOLATIONS:
No new observed violations were noted during this inspection.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENT

01 - This Life of Site Permit approves the continued operation of the C&DLF Unit phases 1-9 and 3301-COMPOST-2020. The Permit to Operate for the Edgecombe County C&D Landfill was recorded in the Edgecombe County Register of Deeds on April 07, 2010 in Deed Book 1551 Pages 645-669. (DIN 10349).
02 - This facility is permitted to receive permitted waste generated in the following North Carolina counties: Edgecombe, Nash, Halifax, Wilson, Pitt, and Martin.
03 - The Minimal Cover issues have been corrected and currently, the working face is small (manageable). 04 - Please continue to keep adequate cover material on the working face so operator can cover when needing to. Seeding needs to take place on areas that will not have any waste added to reduce erosion. 05 - The work being done to address the Notice of Violation (NOV) for leachate outside of the landfill footprint is almost completed. No leachate was noted outside of the landfill footprint during this inspection. 06 - The contractor will continue next week on the work on the leachate issue. Minimal leachate breakouts were noted and they were very small areas inside of the landfill footprint and contained. 07 - Please monitor these areas close to keep the leachate contained inside of the landfill footprint. If leachate is ponded, please pump out and take to the wastewater treatment plant that you have used during this issue. 08 - You may want to consult with your Engineer, to address not using this area for future C&D waste due to the past issues. 09 - Gloria Moseley, Interim Solid Waste Director has kept John College informed of all the progress made to
resolve the NOV for this facility. 10 - Another inspection will be conducted to resolve this NOV and send Edgecombe County a Resolution Letter for confirmation. 11 - A minimal amount of uncovered waste was noted outside of the working face and discussed onsite. 12 - The current operator (Brandon Kelly) is doing a good job and continuing to learn this operation. 13 - Facility Certified Landfill Operations Specialist: Gloria A. Moseley, expires 10/21/2023, and William Exum, expires 9/21/2023, Chris Meyers, expires 9/8/2024 and Brandon Kelly, expires 9/8/2024. 14 - Digital pictures were taken during this inspection and some attached to this report.
