The Transylvania county Solid Waste Department has taken measures to rectify the violation issued
October 30, 2012 concerning the cap on the Calvert Landfill.
We have hauled in loads of fill material to repair the erosion that occurred on the cap and on the slope
near the bottom. We have also hauled in material to fill in the washout that happened outside the cap
area. These areas have been graded in an effort to divert runoff from reoccurring there. We are still in
the process of adding drainage pipes to further divert water from the problem area. We will also have
to hydroseed the filled in areas as weather permits.
I e-mailed you some pictures on November 21 of some of the work we have done at Calvert. We are
continuing our work to try and have this project finished soon and will monitor the repairs closely until
the vegetative cover is reestablished.

SUBJECT: Notice of Violation/Notice of Continuing Violation
Compliance Inspection Report
Transylvania County Municipal Solid Waste Facility (Calvert Landfill)

Dear Mr. Wilson:
On October 23, 2012, Troy Harrison, Environmental Senior Specialist, representing the State of North Carolina, Division
of Waste Management Solid Waste Section, inspected the above referenced facility for compliance with North Carolina
solid waste statues and rules. The following violations were noted:
A. 15A North Carolina Administrative Code 13B .0510 (c) states: "When a solid waste disposal site has been
closed in accordance with the requirements of the Division, future necessary maintenance and water quality
monitoring shall be the responsibility of the owner and the operator and shall be specified in the closure letter."
Closure Letter issued to Transylvania County on December 21, 1995 states in part:
"The integrity and effectiveness of the final cover system and any permanent erosion control
devices must be maintained. This could include making repairs to the cover as necessary to
correct the effects of settlement, subsidence, erosion, or other events."
Transylvania Co. was in violation of 15A North Carolina Administrative Code 13B .0510 (c) in that on October
23, 2012; erosion which resulted in exposed waste was observed on the Southern slope of the closed Calvert
Landfill.
COMPLIANCE SCHEDULE
Based upon the foregoing, Transylvania County Municipal Solid Waste Facility shall come into compliance within 30
days of receipt of this letter with the requirements of 15A NCAC 13B .0510 (c) by completing the following:
"Corrective Actions"
Transylvania County must make repairs to the cap and have measures in place to control erosion to cover and
prevent future exposure of waste

2. Transylvania County shall provide a written certification with supporting documentation on company letterhead
confirming the noted compliance schedule has been completed. Include in this certification any actions taken to
prevent these deficiencies from occurring in the future. Mail this certification by within 30 days of receipt of this
letter to:

Failure to comply with this schedule may subject the facility and/or all responsible parties to enforcement actions
including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act
and Rules. Pursuant to N.C.G.S. 130A-22(a) and 15A NCAC 13B .0701-.0707, an administrative penalty of up to
$15,000.00 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or
an Order issued under Article 9 of Chapter 130A of the N.C. General Statutes.
