(1) PLAN AND PERMIT REQUIREMENTS
(a) Construction plans shall be approved and followed.
— (b) Specified monitoring and reporting requirements shall be met.
(2) SPREADING AND COMPACTING REQUIREMENTS
— (a) Solid waste shall be restricted into the smallest area feasible.
(b) Solid waste shall be compacted as densely as practical into cells.
(3) COVER REQUIREMENTS
(a) Solid waste shall be covered after each day of operation, with a
compacted layer of at least six inches of suitable cover or as
specified by the division.
(b) Areas which will not have additional wastes placed on them for
12 months or more shall be covered with a minimum of one foot
of intermediate cover.
—(c) After final termination of disposal operations at the site or a
major part thereof or upon revocation of a permit, the area shall
be covered with at least two feet of suitable compacted earth.
(4) EROSION CONTROL REQUIREMENTS
— (a) Adequate erosion control measures shall be practiced to pre-
vent silt from leaving the site.
— (b) Adequate erosion control measures shall be practiced to pre-

(5) DRAINAGE CONTROL REQUIREMENTS
(a) Surface water shall be diverted from the operational area,
— (b) Surface water shall not be impounded over or in waste.
—(c) Completed areas shall be adequately sloped to allow surface
water runoff in a controlled manner.
(6) VEGETATION REQUIREMENTS
(a) Within six months after final termination of disposal operations
at the site on a major part thereof or upon revocation of a
permit, the area shall be stabilized with native grasses.
(b) Temporary seeding will be utilized as necessary to stabilize the
site.
(7) WATER PROTECTION REQUIREMENTS
(a) The separation distance of four (4) feet between waste and
water table shall be maintained unless otherwise specified by
the division in the permit.
(b) Solid waste shall not be disposed of in water.
— (c) Leachate shall be contained on site or properly treated prior to
discharge. An NPDES permit may be required prior to the dis-
charge of leachate to surface waters.
(8) ACCESS AND SECURITY REQUIREMENTS
— (a) The site shall be adequately secured by means of gates, chains,
berms, fences, and other security measures approved by the
division, to prevent unauthorized entry.
(b) An attendant shall be on duty at the site at all times while it is
open for public use to ensure compliance with operational
requirements.
— (c) The access road to the site shall be of all-weather construction
and maintained in good condition.
— (d) Dust control measures shall be implemented where necessary.

(9) SIGN REQUIREMENTS
— (a) Signs providing information on dumping procedures, the hours
during which the site is open for public use, the permit number
and other pertinent information shall be posted at the site
entrance.
— (b) Signs shall be posted stating that no hazardous or liquid waste
can be received without written permission from the division.
— (c) Traffic signs or markers shall be provided as necessary to pro-
mote an orderly traffic pattern to and from the discharge area
and to maintain efficient operating conditions.
(10) SAFETY REQUIREMENTS
(a) Open burning of solid waste is prohibited.
(b) Equipment shall be provided to control accidental fires or
arrangements shall be made with the local fire protection
agency to immediately provide fire -fighting services when
needed.
(c) Fires that occur at a sanitary landfill shall be reported to the
division within 24 hours and a written notification shall be
submitted within 15 days.
(d) The removal of solid waste from a sanitary landfill is prohibited
unless the owner/operator approves and the removal is not
performed on the working face.
(e) Barrels and dru ms shal I not be disposed of u n less they are empty
and perforated sufficiently to ensure that no liquid or hazard-
ous waste is contained therein.
(11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS
— (a) A site shall only accept those solid wastes which it is permitted to
receive.
— (b) No hazardous, liquid, or infectious waste shall be accepted or
disposed of in a sanitary landfill except as may be approved by
the division.
— (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste,
and other animal waste delivered to the disposal site shall be
covered immediately.
(d) Asbestos waste that is packaged in accordance with 40 CFR 61, as
amended through January 1,1985, may be disposed of separate
and apart from other solid wastes at the bottom of the working
face or in an area not contiguous with other disposal areas, in
either case, in virgin soil. Separate areas shall be clearly marked
so that asbestos is not exposed by future land -disturbing activi-
ties. The waste shall be covered immediately with soil in a
manner that will not cause airborne conditions. Copies of 40
CFR 61 may be obtained and inspected at the Solid and Hazard-
ous Waste Management Branch, Division of Health Services,
P. O. Box 2091, Raleigh, NC, 27602.
(12) MISCELLANEOUS REQUIREMENTS
— (a) Effective vector control measures shall be applied to control
flies, rodents, and other insects or vermin when necessary.
(b) Appropriate methods such as fencing and diking shall be pro-
vided within the area to confine solid waste subject to be blown
by the wind. At the conclusion of each day of operation, all
windblown material resulting from the operation shall be col-
lected and returned to the area by the owner or operator.

RE: NOTICE OF VIOLATION

Pursuant to NCGS 130A-22(a) and to NCAC 10G, I conducted an inspection on
May 31, 1990 of the Transylvania County Landfill, Permit No. 88-03, located in
Transylvania County off Highway 64 near Rosman, North Carolina. This inspection
found the Transylvania County Sanitary Landfill to be in violation of certain
requirements contained in the _North Carolina Solid Waste_ Mana_yement Rules,
codified at 10 NCAC 10G specifically:
1. 1Q NCAC lOG .0505 4)(b� requires that adequate erosion control measures
shall be practiced to prevent excessive on -site erosion. The
Transylvania County Landfill was operating in violation of 10 NCAC 10G
.0505(4)(b) in that excessive on -site erosion was occuring. (This
violation marked on the 3-27-90 and 5-31-90 inspections).
2. 10 NCAC 10G .0505 12 b requires that at the conclusion of each day of
operation, all windblown material resulting from the operation shall be
collected and returned to the area by the owner or operator. The
Transylvania County Landfill was operating in violation of 10 NCAC 10G
.0505(12)(b) in that windblown material resulting from the operation had
not been returned to the area each day by the owner or operator. (This
violation was marked on the 3-27-90 and the 5-31-90 inspections).

COMPLIANCE SCHEDULE
Based upon the foregoing, the County of Transylvania is hereby ordered to
take the following actions by July 30, 1990 to correct all violations as stated in
this Notice of Violation, and otherwise be in compliance with the North Carolina
Solid Waste Management Rules, codified at 10 NCAC 1OG:
1. Comply with 10 NCAC 1OG .0505(4)(b) by repairing all eroded.
2. Comply with 10 NCAC 1OG .0505 12 b by ensuring that all windblown material
resulting from the operation is picked up and returned to the area each day.
If the requirements above are not met on a continuing basis, enforcement
action may be taken. Remedies include assessment of Administrative Penalties_ of
up to $5000.00 (five thousand dollards) per day per violation, dating from the
compliance date in this order, and/or injunctive relief, pursuant to G.S. 13OA-22
or G.S. 130A-18.

— (a) Effective vector control measures shall be applied to control
flies, rodents, and other insects or vermin when necessary.
(b) Appropriate methods such as fencing and diking shall be pro-
vided within the area to confine solid waste subject to be blown
by the wind. At the conclusion of each day of operation, all
windblown material resulting from the operation shall be col-
lected and returned to the area by the owner or operator.

Well completion records for the Translyvania County Landfill
(Permit# 88-03).
Dear Mr. Emory:
Upon a recent review of our files, our office found that we still
have not received the Well Documentation Records for the monitoring
wells at the Transylvania County Landfill as requested by our office
this past year. Nor have we received the results from the water quality
monitoring. Newly installed wells are required to be sampled twice the
first year and annually thereafter. These requirements are outlined in
the North Carolina Water Quality Monitoring Guidance Document For Solid
Waste Facilities. Landfill Owner/Operators are required to send the
Solid Waste Section copies of the analytical data on a yearly basis.
This analytical data is comprised of laboratory results from samples
extracted from the ground -water monitoring wells and the surface water
sampling locations.
If the 1989 sampling has been done, please send copies of the
results to this office within the next 15 days. If the 1989 sampling
was not done, you should schedule a sampling event within the next 30
days. The proper sampling procedures and parameters are documented
in the North Carolina Water Quality Monitorinq Guidance Document For
Solid Waste Facilities. Copies of the sample results should be
forwarded to the Solid Waste Section within 15 days upon receipt by
-Nour office.

I am writing concerning the spring head that was located during the excavation of the
demolition area of the Transylvania County Landfill. The demolition site was not
probed to determine where the groundwater level is located; consequently, the only
method by which this can be determined is through excavation. When water is located,
we will then stop excavating and back fill to the required four (4) feet of separation. If
we had not excavated to the depth that exposed the spring, we would now be filling
over the spring with the permitted demolition material. We realize that covering the
spring does not eliminate the problem and we submit the following proposal for your
review:
1. is all shingles in upper or dry end of the demolition area.
2. Build a French drain for the spring to have a route to the creek.
3. Back fill over the French drain with 7 to 8 feet of compacted material.
Once we have back filled, we would then use the entire area for demolition with the
exception of shingles which would be isolated at the upper end of the site.

Fuel Oil Contaminated Soil at the Transylvania County
Landfill, (Permit #88-03).
Dear Mr. Brank:
The Solid Waste Management Division has received a request for
characterization of the subject waste. Based upon the submitted
information, the waste appears to be non -hazardous. The Solid Waste
Management Division has no objection to the sanitary landfill
disposal of this waste, if in accordance with the conditions listed
below:
1. The owner/operator of the landfill approves the disposal.
2. The waste contains no -free liquids.
3. The waste shall be land applied in an area of the landfill
which has received two feet of earthen cover or in a virgin
area.
4. The waste shall be applied in a thin layer not to exceed
six inches in depth.
5. Surface water shall be diverted from the area of
application.
6. The area shall be seeded to control erosion if necessary.
7. Approval for sanitary landfill disposal is explicitly
limited to a "one-time" basis. Further -approval by this
office will require submittal of a new Waste Determination
form, and (if applicable), new analytical data.

PROCEDURE AND CRITERIA FOR WASTE DETERMINATION
This procedure will be used by the Division of Health Services to
determine whether a waste is (1) hazardous as defined by 10 NCAC IOF, and
(2) suitable for disposal at a solid waste management facility.
The types of wastes that will be evaluated by this procedure are
primarily, but not exclusively, industrial and commercial wastes and
sludgesl and--Publicly-Owned Treatment Works sludges. -
The Division of Health Services reserves the right to request
additional information or waive some of the requirements based on the type
of waste if it deems necessary. The Division may also require some wastes
to be treated or altered to render the waste environmentally immobile
prior to disposal at a sanitary landfill. Wastes disposed at sanitary
landfills must he non —liquid and in a form that can be confined,
compacted, and covered in accordance with the "Solid Waste Management.
Rules". APPROVAL TO DISPOSE OF THE WASTE SHALL ALSO BE OBTAINED FROM THE
OWNER OR OPERATOR OF THE LANDFILL PRIOR TO DISPOSAL.

RE. REPORT ON THE USE OF SYNTHETIC DAILY COVER,
TRANSYLVANIA COUNTY LANDFILL, PERMIT /88-03
Dear Mr. Coffey:
Transylvania
County Solid Waste
Department has completed the
90
day test of Phillips
Fibers "Fabrisoil",
and finds the synthetic daily
cover to be an effective
method of cover.
The fabric was used daily in the area of the landfill and under
good weather conditions. The working face was contained to an area
that was 60 feet by 75 feet with the slope of the working face 3:1,
horizontal: vertical.
Placement and removal of the fabric was accomplished manually
with waste passenger car tires placed at approximately 15 foot
intervals on the perimeter of the fabric serving as anchors. Evening
placement required three men and four minutes of labor while morning
removal required between four and five men with five minutes of labor
(depending on moisture content). The advantage of the manual
placement was a longer fabric life as the fabric cannot be torn by
hand. The first two nights the fabric was in place there were five
vector holes. After that there were no further intrusions.
Transylvania County request that the use of the sunthetic daily
cover be approved for an additional 180 days. It saves landfill
space, equipment operation cost, and is of particular advantage to
this County due to the limited amount of available cover material.
