Re: Transylvania County Landfill
Dear Mr. Moore:
On March 22, 1983, Richard Moore of this office accompanied
Mr. Jack McGinnis of the Transylvania County Health Department and you on
an inspection of the Transylvania County Landfill. Richard Moore's purpose
at the inspection was to determine the Landfill's condition with regards to
erosion control and with respect to the Sedimentation Pollution Control Act.
The inspection revealed several serious erosion problems which will
requi re correcti on. They are:
1. A large gully on the east corner of the landfill needs to be filled
and the water presently feeding this gully diverted or collected and piped
off the fill.
2. A culvert under the landfill access road should be relocated where
it will not discharge onto the landfill itself.
3. A recently graded road down the south fill slope should be smoothed
and regrassed. This road presently has eroded to the point of being useless.
4. The existing basin should be overhauled, the embankment crest raised
and leveled and an emergency spillway constructed and the riser filter system
improved.
5. Storm water which is now free to spill onto the west side of the
landfill should be diverted away from the landfill into the wooded, County -
owned land.
6. The southern slope of the landfill should be provided with a vegetative
groundcover sufficient to restrain erosion.

Presently this landfill is in poor condition with regard to erosion

of 1973. This _letter is a request that the site problems be corrected by
June 22, 1983. Personnel of this office will meet with Department of Human
Resources' personnel at the landfill at that time to determine the extent
of compliance with the Sedimentation Pollution Control Act.

I regret to correspond prior to meeting you since your recent
employment as Transylvania County Manager, However, we have concerns
with the Transylvania County Landfill in regard to erosion control and
sedimentation pollution which need immediate attention in order to take
advantage of good seasonal conditions for vegetation growth.
On March 22, 1983, Richard Moore with Natural Resources & Community
Development, Land Quality Section; Jack McGinnis, Transylvania County
Health Director; and I met and inspected the Transylvania County Land-
fill.
Richard Moore identified erosion problems which require correction.
They are:
1. A large gully on the east corner of the landfill needs to be

6. The southern slope of the landfill should be provided with a
vegetative groundcover sufficient to restrain erosion.
These problems are in violation of "SOLID WASTE MANAGE ENT RULES",
Section .0505(8) which states "Adequate erosion control measures shall
be practiced to prevent silt from leaving the site." This letter is
establishing a compliance date of June 15, 1983 to correct these problems.

Re: Disposal of Asbestos (40 cubic yards) from Rosman Research Station at
Transylvania County Landfill (Permit No. 88-03)
Dear Mr. Norman:
The Division of Health Services has no objection to disposal of asbestos waste
in permitted sanitary landfills if performed in accordance with 40 CFR Part 61.
The following procedures should be followed:
1. Permission from the owner/operator of the landfill should be
obtained prior to delivery since the owner/operator has the right to
deny acceptance of any waste.
2. A copy of this letter should accompany the waste at time of disposal.
3. The waste is placed wet into plastic bags and securely sealed to
prevent an airborne condition during handling.
4. The operator shall be notified that the waste is to be covered
immediately with sufficient amounts of dirt or other waste so as to
prevent an airborne condition during final disposal.
5. The operator shall place the waste as far from the top of the
landfill as possible, but in no case within ten (10) feet of the
landfill surface.
The preparation of the asbestos and delivery should comply with OSHA and DOT
standards.
