(Operator) on June 8, 2020 and will expire on January 10, 2061. A Permit to Construct Shotwell Landfill, Phase 6, was issued to Meridian Waste North Carolina, LLC (Owner) and Shotwell Landfill, Inc. (Operator) on June 8, 2020. The initial, substantial, construction authorized by the permit to construct must commence within 18 months from the issuance date of the permit (by December 8, 2021). Construction on Phase 6 had begun prior to this site visit. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 Permit Approval to Construct Shotwell C&D Material Recovery Facility (9226-MWP-2020) was issued to Meridian Waste North Carolina, LLC (Owner) and Shotwell Landfill, Inc. (Operator) on November 6, 2020. The initial, substantial, construction authorized by the Permit to Construct must commence within 18 months from the issuance date of this permit. If substantial construction does not begin within 18 months from the issuance date of the permit, then the permit to construct shall expire. PURPOSE OF SITE VISIT: Compliance Visit follow up. STATUS OF PAST NOTED VIOLATIONS: 15A NCAC 13B .0542 (k); Resolved 15A NCAC 13B .0542 (f) (3); Resolved NOTICE OF VIOLATION(S): NONE ADDITIONAL COMMENTS Shotwell Landfill is a construction and demolition landfill, C&DLF, located at 4724 Smithfield Road, Wendell, Wake County, North Carolina. The facility has received a permit to construct Phase 6 of the landfill, however, as of the date of this inspection, construction had not begun. The facility has also received a permit to construct a Mixed Waste Processing facility, which also had not yet begun construction. A. The site was inspected by Section staff, Jason Watkins, Diana Felix and Andrew Hammonds on December 7, 2021. Josh Daher, Murray Long and David King with Meridian Waste were present for the inspection. 1. The working face appeared to be less than ½ acre at the time of this inspection and staff were removing scrap tires from the waste. 2. The western side slope had been covered, graded and stabilized with matting. Construction of Phase 6 was started prior to this inspection. Land clearing waste from Phase 6 will be processed and used for temporary groundcover until active construction moves forward. 3. There was an eroded area on the western slope between the active area and inactive area near the sediment basin. Landfill gas odor was detected here. The bank of the inactive area was almost vertical in this area creating a channel for surface water runoff. It is recommended that you fill this area with soil, grade and stabilize to reduce the velocity of surface water runoff. 4. There was an eroded area of the western side slope that had not been stabilized adjacent to the sediment basin. The facility staff stated that this area would be graded and stabilized. 5. The facility staff stated that the sediment basin would be drained and excess soil build up would be removed and utilized on the landfill for cover. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Per the permit, “The edge of the waste footprint for all disposal units must be identified with permanent physical markers.” The operator had surveyed and installed additional temporary edge of cell markers. They will install more permanent and visible markers as required. 7. The majority of the landfill had been graded and no water was observed ponding over waste at the time of this inspection. There were still some settled areas observed over the inactive portion of the landfill that need to be filled or graded to prevent future ponding of water over waste. 8. A couple of MWs were inspected during this inspection and had data plates affixed. Remaining wells will be inspected for compliance. 9. Repaired areas should be stabilized and seeded as soon as practical to avoid additional erosion. 10. Continue to maintain vegetation so that facility staff can thoroughly inspect site. 11. Records were not reviewed during this inspection. 12. Discussions occurred around the management of concrete and other inert material now that Phase 6 construction was underway. Once Phase 6 is operation, and possibly before, the current location will be unusable. It was recommended that the operator provide permitting an amended document to allow for the fluid movement of the waste concrete grinding operation until a permanent location was determined. B. Jason Watkins and Drew Hammonds met with Josh Daher, Murray Long, and David King on January 10, 2022 to observe remaining outstanding matters. 1. On January 6th, Mr. Daher submitted photos of any outstanding repairs and seeding activities undertaken since the 12/7 site inspection. In addition, on January 7th, a waste diversion plan was submitted outlined options to reduce volume at the landfill to meet permit and franchise requirements. 2. Also on January 7th, the Section finalized its review and approval of a minor permit modification that clarifies and addresses the recycling of wood waste at the facility. 3. Phase 6 clearing and grubbing activities have been completed and temporary groundcover was in place. Construction will continue upon receipt of amended Erosion Control plans under review by DEMLR. 4. Areas of previous erosion on the side slopes had been addressed with additional matting and seeding in place. The area noted in A3 above during the December 7th site inspection had been repaired. 5. The draining and cleaning of the sediment pond has yet to commence. This is occurring under DEMLR oversight. 6. Facility staff took action to hold a driver and reload truck for disposal of non-C&D waste from Strategic Materials. The driver was directed to take the material to S. Wake LF. Facility staff should follow-up with Strategic to ensure they fully understand their waste streams and what is accepted at Shotwell LF. 7. As discussed on site, when transitioning the working face of the landfill especially to accommodate wet weather conditions, take immediate steps to cover what will become the non-active areas. This will prevent you from exceeding the regulatory limits of open area, cut down on the need for resources to cover a larger area at one time, and also offer additional turnaround areas, etc. This should provide some improved efficiency to your operations. In addition, larger areas open also lead to odor concerns. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 5 8. During wet weather, measures must be taken to reduce the amount of sediment and soil tracked out onto the road in front of the facility. 9. As of January 12th, Meridian has initiated diversion of waste from the Morrisville Transfer Station (SW Permit 9241-TRANSFER) to other local C&D facilities to reduce waste volumes at the landfill. Periodic evaluation of tonnage will continue to occur and adjustments made as needed to ensure compliance. 10. Violations listed in the Notice of Violation dated October 21, 2021 have been resolved.
