Ms. Dawn Hughes Plant Manager Chemours Fayetteville Works 22828 NC Highway 87 W
Fayetteville NC 28306 Re: Consent Order Paragraph 19 Extension Request Dear Ms. Hughes,
Paragraph 19 of the Consent Order states that “Chemours shall establish and properly maintain permanent replacement drinking water supplies in the form of public water or whole building filtration system for any party (household, business, school, or public building) with a private drinking water well that has been found through testing validated by the North Carolina
Department of Environmental Quality (DEQ) to be contaminated with concentrations of GenX compounds in excess of 140 ng/L, or any applicable health advisory, whichever is lower.” DEQ issued a response letter to Chemours regarding the feasibility of municipal water in
Bladen County west of the Cape Fear River while areas in Cumberland County west of the river
continue to be evaluated. As noted in the September 9, 2021 letter from Chemours, Bladen County and Chemours finalized an “Agreement to Fund Public Water System Upgrades and Connections,” and, on September 7, 2021, the Bladen County Board of Commissioners voted to approve the Agreement. Chemours and Bladen County will proceed with implementing the terms of the Agreement, to include providing public water system connections for County residents west of the Cape Fear River. Paragraph 25 of the Consent Order states, “For good cause shown, Chemours may submit
to DEQ one or more requests for extensions of up to three months each for any deadline specified in paragraphs 19-24. By a letter dated July 30, 2021, DEQ granted such an extension to September 15, 2021, for Chemours to meet the paragraph 19 requirements in Bladen and Cumberland Counties west
of the Cape Fear River. On September 9, 2021, Chemours requested, pursuant to paragraph 25 of the Consent Order, a further extension of 3 months to meet the paragraph 19 requirements in Bladen and Cumberland Counties west of the Cape Fear River. DEQ hereby grants an extension
of ninety days, until December 15, 2021 for the company to comply with the requirements of paragraph 19 of the Consent Order.
DEQ continues to review Chemours’ additional request for concurrence on the infeasibility of public water connections in Cumberland County west of the Cape Fear River and will update Chemours in the weekly meetings regarding this review.
Sincerely,
Sushma Masemore Assistant Secretary, NC DEQ
