The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS 1. Reason for visit was to inspect YW area. Facility is gated and has signage out front for Transfer Station, in which YWN is a part of LOS permit. 2. Compost logs, including map of piles, date created and temperature were viewed while on site.

3. Yard Waste is being composted in basically 4 windrows with a clean wood pallet windrow separate. The waste is moved by Simmons and Simmons, transported to Old Castle” to compost into soil. A document was provided from Simmons and Simmons, to Richmond County, that stated approximately 2000 tons of waste had been removed to Oldcastle Lawn and Garden in Aberdeen, NC and Pageland, SC in December 2021. Simmons and Simmons equipment was still onsite from another recent chipping of newer waste. Waste also is removed to a boiler when accepted.

Pallet grindings up front and compost in back of the windrow areas were too close to swales and should be moved back away from them. 15A NCAC 13B .1404 (8) - A 25-foot minimum distance shall be maintained between compost areas and swales or berms;

5. Be mindful of unacceptable waste, colored and treated wood/pallets. In previous photo of pallet grindings there is plastic present in the pallet waste pile. Across the yard there was painted wood pieces discovered. Please remove all unacceptable waste to proper disposal landfill. There was not a lot of unacceptable waste but what can be removed should be done.
Painted wood. 6. Windrow and grinding area had ruts from recent activity and it being wet. Please be sure and buildup up this area and grade it so that storm water can be managed, without causing erosion or leachate runoff. Waste should also not be in standing water. Reference 15A NCAC 13B .1404.

7. The last windrow was rather large in width. Although it was not measured, it seemed to be within the guidelines of the Transfer Station LOS Permit, see below. It is suggested to keep smaller windrows for easier management, firefighting equipment access and less risk of ignition when it is composting. Check with your engineer/consulting firm on how to manage. Access roads should be of all weather construction. Transfer Station Permit Attachment 3, Part (7), 21 - The permittee must store or stockpile the received waste or processed/ground material (such as mulch) in the following manner: a. Each windrow has the maximum height of 30 feet and the width of 50 feet at any time. b. Each windrow shall be maintained at least 25-foot clear distance or perimeter from drainage ditches and swales, around the processing area, and other stockpiles of raw wastes and ground material to allow for inspection, monitoring temperature, or firefighting. c. Each windrow shall be maintained at least 50-foot clear distance from property boundaries. 15A NCAC 13B .1406 (5) (c) - The access road to the site shall be of all-weather construction and maintained.
8. Edge of Waste (EOW) markers should be in place, with one visible to the next, to outline the approved
area and for Section staff to tell where the limits of activity are to measure for buffers. YWN are two acre sites. Suggest tall white PVC pipe. Waste should not be outside the approved area.

9. Discussions onsite consisted of the removal of pallet wood waste, if not accepting at a boiler. Any older YW or ground up or composted material is still considered waste and must be removed for appropriate use or disposal site. If boilers will not take ground up pallet wood, then an alternative plan should be ready to execute. It can be composted, if clean wood only, and can then be utilized as compost. However, it cannot just remain in the notification or grinding area, that would be disposal. The notification is for treatment, staging and processing. DEACS, Department of Environmental Assistance and Customer Service 1-877-623-6748, may could find a use for this waste type to be recycled. In the event waste cannot be removed, then the County should consider altering its services of accepting pallets until this problem is solved and the waste removed. Consult also your engineering firm/consultant for ideas and check with the Sections Permit Engineer, Ming Chao, for approval on that plan before putting into action.
10. Composted YW can be used to reclaim slopes of Closed MSW and help with erosion control. Max depth of 2 to 3 inches should be used. Cannot be used as fill or buried etc. This should assist the County by utilizing it for a beneficial purpose.
11. Corrective measures are necessary as result of this inspection. Failure to meet the conditions for compliance may result in Compliance Actions. A follow up inspection will be conducted in about 30 days
