David Powell, NCDEQ - SWS STATUS OF PERMIT: 7702 MSW Closed PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Jerry Austin and David Powell road part of the SE side of the Closed MSW along YWN area. No settled areas were visible and site had good grass cover. No trees/ or shrubs were visible. Last year County removed a large number of over growth along backside and did a good job. Backside could not be inspected this visit without causing ruts and disturbing cap due to recent rainfall. Looking west from access road before yard waste notification. 2. Please, be sure and keep perimeter vegetation under control and protect the progress that was made last year. Environmental 1 INC. is doing ground water and surface waters sampling. 1/7/2021 Sampling data. 5. Composted YW can be used to reclaim slopes of Closed MSW and help with erosion control. Max depth of 2 to 3 inches should be used. Cannot be used as fill or buried etc. This should assist the County by utilizing it for a beneficial purpose. 6. Discussion onsite were about when groundwater sampling and monitoring could end and if that was possible in near future or at some point. Mr. Powell was not sure if this was possible, but suggested contacting Ming Chao/Sherri Stanley on what the requirements for the Closed MSW and if it could ever be done sampling and monitoring.
