The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Photos included in this report were taken by Susan Heim on January 4, 2022, during the inspection, unless
otherwise indicated.
2. Conditions at the facility were wet following a 3.5" rain event the previous day.
3. Facility access roadways are of all weather construction and were observed to be in good condition at the time
of the inspection. The approach to the working face had been reinforced with stone and compacted to ensure
stability.
4. The tipping area was large, affording ample space for incoming loads and landfill equipment to maneuver
safely. The entire operational area surrounding the working face was observed to be in good condition with
sufficient operational cover in place. No exposed waste was noted.
5. Windblown litter was minimal and appeared to be well managed. Mr. Phelps stated that implementing a daily
litter collection procedure had made it simple to keep up with the litter.
6. The working face was found to be small and well contained. Facility staff had stockpiled cover soils near the
outer limits of the working face to keep the waste contained and also in preparation for applying cover at the
end of the operating day. Waste appeared to be well compacted. No unacceptable materials were observed in
the working face.
7. Some new vegetation was visible on the slopes of the active area of the landfill; however, many areas that had
been seeded in the fall were still bare. Despite the heavy rain and snow the previous day, slopes appeared to be
in good condition, with minimal rain damage. Only a few short, shallow rills were visible on the slopes
surrounding the working face, and facility staff were observed bringing soil to those small spots in need of
repair. No exposed waste was visible.
8. The inactive portion of the Phase 2 landfill was also inspected. The landfill top was easily accessed from a stone
roadway. Although the ground was wet and vegetation was spotty, no ponding water was observed. A berm had
been constructed around the top of the slopes to prevent erosion.
9. The slopes of the inactive portion of the landfill were observed to be in good condition. Most areas had
established vegetation in place, including the eastern end of the north slope where several attempts at seeding
had proven unsuccessful over the 10 to 12 months. No erosion was noted on the inactive portion of Phase 2.
10. The leachate storage tank was inspected and found to be intact. No leaks were evident. The secondary
containment area was damp from the recent rainfall, but no standing liquid was observed.
11. Prior to the inspection, Mr. Brushwood had provided leachate generation records from 2021 that indicated at
total of 2,343,671 gallons had been hauled to the wastewater treatment plant from the Phase 2 landfill.
The working face is small and well managed, the tipping area is stable with ample operational cover
and provides adequate space for the safe maneuvering of vehicles and equipment
