Dear Mr. Hotzelt:
The North Carolina Department of Environmental Quality Brownfields Program (DEQ
Brownfields) has received and reviewed the proposed request for changes to the VIMS design
(RE: Brownfields Comments for EAM VIMS Design - 23088-19-060). This modification request was received by DEQ Brownfields on December 29, 2021, with additional documentation provided on January 3, 2022. The modifications requested include;
•Riser R1 was previously designed to discharge through the side of the building on the 4th
floor. However, a utility chase was created which allows the riser to discharge throughthe building roof. Therefore, R1 will now discharge through the building roof.
•Permanent sub-slab monitoring point VMP-02 had the tubing come dislodged from the
bulkhead union after the concrete slab was poured. Therefore, it is not feasible toreconnect the tubing at this point of construction. VMP-02 construction detail will berevised to reflect detail 4D on drawing ENV-020. Based on inspections of VMP-02 andcommunication testing completed in October 2021, Wood has determined that VMP-02 isnot damaged and is adequate for monitoring sub-slab conditions at the site in the future.
•Similar to the modification of VMP-05 that you and I discussed below and via telephoneconversation in November 2021, VMP-04 needs to be revised in Retail 1. VMP-04 andVMP-05 construction details are shown as detail 4C on drawing ENV-020.
•Sub-slab collection materials around Riser R7 need to be modified to accommodate a
foundation footing and a ribbon footing in the area.

Following approval of the revised VIMS Plan Design dated November 10, 2020, DEQ Brownfields has found these changes to the VIMS Design to be in compliance with Land Use Restriction h.iii of the Notice of Brownfields Property.
Consistent with the Brownfields agreement for this project, an essential component of public health protection for this design is the professional engineer’s seal of these documents that the proposed design will be effective at mitigating the potential for vapor intrusion at the property and protecting public health. Furthermore, the safe occupancy of the building will be evaluated upon
“Post-Construction and Pre-Occupancy System Effectiveness Testing” as required by Section 4 and 5 of the VMP. In addition, DEQ Brownfields reserves the authority to require confirmation of efficacy in the future including, but not limited to, additional indoor air and/or sub-slab sampling outlined in the previously approved VIMS Plan for the site.
Please be advised that this Modification Request compliance review from DEQ Brownfields does not waive any applicable requirement to obtain any necessary permits, licenses or certifications which may be required from other state or local entities. Drawing modifications associated with this request should be reflected in your as-built drawings once the VIMS has been completed. DESIGN ENGINEER SHALL BE CONTACTED FOR RE-INSPECTIONS DURING FUTURE RENOVATIONS.
