Meadowview Road Suite 101 tet: 336/323-0092 fax: 336/323-0093 www.JoyceEngineeting.com The purpose of this letter is to provide you with the results for the February 12, 2008 (first quarterly) monitoring event at the John's River Waste Management Facility. Landfill gas was detected above the lower explosive limit in gas probe GP-2. The concentrations detected are similar to those detected during previous events. GP-2 is located in an area with a close proximity to waste and is not a boundary probe; therefore, the detection of methane gas is not unexpected. Small detections . of 0.2%, methane in ambient air were recorded at GMP-6 and GMP-9; however these detections were well below the regulatory limit. No detections were recorded for any of the remaining site probes, monitoring points, and structures. The two gas probes that were installed adjacent to the Kirksey Drive Landfill in June 2001 were also monitored for the presence of landfill gas. There were no detections of landfill gas in either probe during this event. The landfill gas monitoring logs for each site are attached. Box 1486 Morganton, NC 28680 RE: John's River Waste Management Facility (Permit # 12-03) and the Closed Kirksey Drive Landfill (Permit # 12-01) Second Quarterly Gas Monitoring Results JEI Project No. 277.00, Task 34 Dear Mr. Fisher: The purpose of this letter is to provide you with the results for the second quarterly landfill gas monitoring events at the John's River Waste Management Facility and the closed Kirksey Drive Landfill in conformance with 15A NCAC 13B.1626.(4). Landfill gas monitoring was conducted for both sites on May 29, 2008. A copy of this letter should be placed in the operating records for these facilities. Landfill gas was detected above the lower explosive limit in gas probe GP-2 at the John's River site. The concentrations detected are similar to those detected during previous events. GP-2 is located in close proximity to waste and is not a boundary probe; therefore, the detection of methane gas is not unexpected. No detections were recorded for any of the remaining site probes, monitoring points, and structures, except as noted below. An explosive gas concentration above the lower explosive limit was detected in the vehicle maintenance pit in the maintenance shop at the John's River site. No gas was detected anywhere in the maintenance shop except in the pit itself. Information provided by the facility personnel indicated that the detection may be due to a leak in the site's propane system rather than landfill gas. This is supported by the fact that Probe GP-3, located between the waste area and the shop, showed no methane detections. JEI immediately contacted you with this information and recommended that the propane system be shut down and tested as soon as possible, and that site personnel stay out of the pit area until the problem is resolved. If the propane leak is confirmed and repaired, JEI will return to the site to monitor gas concentrations in the pit to confirm that the problem has been resolved and was not related to landfill gas. More specifically, the violation is for having treated wood waste, yard trash and land clearing debris by grinding this material into mulch, without first obtaining a permit from the Division. To correct this violation, we are requesting a "Receipt for Acknowledgement Letter " (RAL) from the Division of Waste Management; Solid Waste Section, Permitting Branch for this operation. Our responses to your comments and concerns are as follows: Areas of Concern and Comments: 10. The perimeter of the C&D landfill needs to be marked with stakes to identify the footprint of the landfill. As soon as reasonably possible, landfill staff will delineate the boundaries of the C&D landfill and the underlying MSW landfill as best we can. 17...... there are several areas on the west side of the landfill that is not adequately covered. Discussions have been held with the applicable landfill staff to ensure adequate daily cover. 18..... no records of random screening of wastes. Copies of the most recent waste screenings have been included. Also, discussions have been held with the applicable landfill staff to conduct random waste screenings to ensure the proper disposal of all waste. 19..... what appeared to be municipal solid waste (bagged food waste, household items ) was observed in the working face. Discussions have been held with the applicable landfill staff to conduct random waste screenings to ensure greater compliance with the items allowed in the C&D landfill. 20..... no records documenting methane monitoring readily available for review. A copy of the May 22, 2008 Second Quarterly Gas Monitoring results are included. Copies of the LF Gas Monitoring reports from the last three quarters have been requested from Joyce Engineering and will be forwarded upon receipt. We will be reviewing what will be necessary to provide a cleaner, neater pad for storage of these white goods. 2. All appliances, including those that contain CFCs, were haphazardly stored in a pile. Discussions have been held with applicable landfill staff to ensure that the CFC containing appliances are stored upright until CFCs have been removed. 3. .... about half of the gas tanks on site had not been perforated or otherwise rendered un-useable. Discussions have been held with applicable landfill staff to ensure compliance with this requirement. Treatment and Processing Area: 4. There is no Solid Waste Permit or Operations Plan that addresses the storage and treatment processing of wood wastes ........ into mulch. Discussions were held with Mr. Larry Frost of the Asheville Regional Office regarding the "Request of Acknowledgement Letters ". Combustible gas monitoring was conducted on July 16, 2008 by JEI personnel..A copy of this letter should be placed in the operating records for this facility. During the second quarter monitoring; event in May, an explosive gas concentration above the lower explosive: limit was detected in the vehicle service pit within the maintenance shop at the John's River site. A propane leak after a, recent regulator replacement was suspected, JEl immediately contacted you with this information and recommended that the propane system be shut down and tested as soon as possible, and that site personnel stay out of the pit area until safe. After the propane system had been checked and fixed, ,fEl personnel returned to monitor the pit and shop. The presence of combustible gas was not detected in the pit or shop during this visit, confirming that the detection on May 29, 2008 was not related to landfill gas. Burke County is in violation of 15A NCAC 13B .0542(c)(1) in that they have accepted wastes from an industrial source (wooden furniture forms and frames, upholster stuffing and wood trimmings) that are not "C&D wastes. [15A NCAC FACILITY COMPLIANCE AUDIT REPORT Division of Waste Management Solid Waste Section w P e`b�� 139-.0532(8) "C&D solid waste" means solid waste generated solely from the construction, remodeling, repair, or demolition operations on pavement and buildings or structures. C&D waste does not include municipal and industrial wastes that may be generated by the on -going operations at buildings or structures.] To correct this violation and be in compliance with 15A NCAC 13B .0542(c)(1), Burke County must only accept only those C&D solid wastes it is permitted to receive. 15A NCAC 13B .0542(k)(2) requires that "adequate sediment control measures consisting of vegetative cover, materials, structures or devices must be utilized to prevent excessive on -site erosion of the C&DLF facility or unit." Burke County is in violation of 15A NCAC 13B .0542(k)(2) in that they have allowed excessive erosion to occur on the south face of the landfill. This erosion has breached erosion control berms in at least two places and exposed solid waste in at least one place. To correct this violation and be in compliance with 15A NCAC 13B .0542(k)(2), Burke County must, within 30 days from receipt of this Notice, repair the breaches in the erosion control berm and initiate adequate sediment control measures consisting of vegetative cover, materials, structures or devices, to prevent excessive on -site erosion of the C&DLF facility. You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per dad% may be assessed for each violation of the Solid Waste Statute or Regulations. For the violation(s) noted here, you may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. STATUS OF PAST NOTED VIOLATIONS (List all noted last audit): In an August 1, 2008 letter, as required in the NOV dated 6/11/08, Burke County requested a "Receipt of Acknowledgement Letter" (RAL) for grinding treated wood waste, yard trash, and land clearing debris into mulch. AREAS OF CONCERN AND COMMENTS: Construction and Demolition Landfill: 1. The industrial waste that was received at eh C&D landfill, was removed to the transfer station on the day of the audit, after the operator was notified of this violation of 15A NCAC 13B .0542(c)(1). 2. This facility is a C&D landfill over a closed MSW landfill. 3. The service area for the C&D landfill is Burke County. 4. The C&D facility is currently accepting approximately 50 tons/day. 5. The facility is secured by a gate, which was unlocked - landfill operations were being conducted at the time of the inspection. 6. The permit and operations plan are kept at the Burke County General Services Office, 100 Government Dr., Morganton, NC. 7. Signs at the entrance to the landfill were installed and posted as required. 8. The landfill is open from 7:00am to 4:00pm, M — F; and from 7:00am to 1:00pm on Saturday. 9. Current Landfill Operations Specialist Certifications: Alan Holcombe Expires 4/07/12 10. The access road was maintained in good condition. 11. The perimeter of the C&D landfill needs to be marked in order to identify the footprint of the C&D landfill. 12. Excessive erosion on the south face of the landfill has breached the control berms in several places and f has exposed waste in at least one place. As noted in the previous audit of 5/28/08, sections of the stormwater diversion pipe that runs down the west face of the landfill have become separated. 14. The working face of the landfill was less than %Z acre. 15. Very little wind blown waste was noted at the time of the audit. 16. The slope of the landfill appears to be properly maintained as required at 3(H):1(V). 17. Runoff from the landfill is held in two sediment retention ponds. This runoff is pumped out as needed and applied to the landfill. Both of the sediment retention ponds were dry. 18. Groundwater and surface water monitoring were collect on May 30 and 31, 2007, and analyzed on by Joyce Engineering. 19. Records documenting the random screening of wastes were reviewed. Random waste screens are done at least weekly on the working face of the landfill. 20. Digital pictures were taken during the audit. Treatment and Processing Area: 1. The land clearing debris is ground into mulch with a "tub grinder". The mulch is sold to the public. 2. Wooden pallets are ground into mulch on site. The mulch is sold as boiler fuel. (Suez Energy BioPower, Inc. of Marion, NC is the primary buyer of the mulch.) Inert Debris Area: 1. Concrete, asphalt, rock and brick were originally stockpiled for possible use as beneficial fill. But, as there has been no demand for the beneficial fill, it is being disposed of the Foothills MSWLF. Please contact me if you have any questions or concerns regarding this audit report. Wagner@ncmail.net> Date: Fri, 07 Nov 2008 11:12:48 -0500 To: Carson Fisher <hcfisher@co.burke.nc.us> Carson, On Tuesday 11/04, when Katherine Marciniak and I were at the Burke County C&D landfill, we discovered a seep of leachate along the east face of the old MSW landfill. I've attached a photo (note the ink pen in lower middle for scale) of the seep and a map with the estimated location of the seep. This seep must be immediately fixed. I suggest that at the very least the seep must be excavated and sealed with low permeability soil. The excavated soils can be taken to the top of the C&D landfill and covered with soil.
