1) Overall operation looks good. Yardwaste being ground. White goods area getting full.
2) Site is being re graded to eliminate steep slopes on the backside. New Operator employed
3) Watch for non C&D Waste. Watch for asbestos siding in loads.

On behalf of Burke County, we are requesting an extension to the referenced permit to
continue operations at the John's River C&D landfill until at least January 1, 2004. This request is
being made in accordance with guidance provided in your section's memo of April 1, 2002 endued,
"Continued Operation of Construction & Demalition Landfills on Top of Closed Municipal Solid
Waste Landfills."
The permit to operate the John's Rivet C&D was issued in January 1998. As of that date, we
estimated there were 13.9 years of capacity in the site, based on the C&D waste Stream data available
at that time (see calculations, attached). Based on that waste stream data, we estimate there are 8-9
years of capacity remaining at this time. We ate enclosing Drawing No_ 5 from the original
application, which depicts the projected contours in year 5 (2003) of the landfill's life.
As there is significant capacity remaining in this facility, we believe ganting at extension of
this permit until at least January, 2004 will provide the most efficient and environzriantally sound
disposal option for this area in Buwke County. Please feel free to contact us if you have any

RE: Assessment Monitoring Requirements - Burke County Landfill (Permit # 12-03)
Dear Mr. Meyer:
The Burke County Landfill is in an assessment groundwater monitoring program and therefore must
complete the requirements of 15A NCAC 13B .1634. In addition to requiring sampling and analyzing for
Appendix II contaminants and characterizing the extent of the contamination, which have been done,
Rule .1634 also requires that a number of other steps be taken. Included is the initiation of an assessment
of corrective measures as described in Rule .1635 if concentrations of contaminants are determined to be
statistically greater than approved groundwater protection standards [.1634 (g)(1)(D)J. These
requirements were noted in correspondence to the County dated February 25, 1998 (see attachment).
The statistical analyses of monitoring results received thus far by the Solid Waste Section have been
comparisons of downgradient monitoring well data to upgradient or background data, but not to
groundwater protection standards. Consequently it will be necessary to complete this requirement of
Rule .1634. As stated in previous correspondence, groundwater protection standards have been
established for most detected Appendix I1 constituents and they conform to 15A NCAC 2L groundwater
standards.
Burke County must proceed with completing the remaining requirements of Rule .1634 within the next
90 days. If the conditions of Rule .1634 (g) are met, it will be necessary to fulfill the requirements of
Rule .1635.
Failure to comply with solid waste management rules could result in compliance actions with
administrative penalties.
