The Solid Waste Section (Section) recently performed a technical review excluding the
Local Area Study and the Water Quality Monitoring Plan of the referenced transition plan
application submitted by Joyce Engineering Inc. on behalf of Burke County. Requested
information or revisions were due to the Section by December 23, 1994 in order to expedite
review of the referenced transition plan application. As of today the Section has not received
any revisions of the Transition Plan. What is the status of the Transition Plan?

A hydrogeologic review has been completed of the Burke County
Landfill Transition Plan. Overall this is the most complete and
accurate Transition Plan that I have reviewed. However, additional
information and clarification is needed on a few issues. Please
have Burke County or their consultants review the following
comments and questions and prepare revisions to the Transition Plan
for the John's River Landfill.
COMMENTS AND QUESTIONS:
The Summary Report and Local Area Study appeared to address the
requirements of the rules and technical guidance document.
WATER QUALITY MONITORING PLAN:
Page 4: Maintenance problems with the old monitoring wells
(well identification tags, concrete pads, etc.) should be
corrected and documentation provided to the Solid Waste
Section.
Page 6: Comments on the proposed ground -water monitoring
system have already been provided in my Interim Review Letter
of July 20, 1994.

Page 7: Based upon the information provided, the Solid Waste
Section authorizes discontinuing monitoring of the old surface
water monitoring locations. The Section approves future
surface water monitoring of the two locations below the two
sedimentation basins as proposed. Are these two tributaries
perennial streams that will provide water for sampling in all
seasons of the year?
On page 16 it is stated that "The results of the statistical
analysis will be submitted to the Division annually The
Solid Waste Management rules require a report of the
statistical analysis semi-annually for each sampling event.
Page 18, Permanent (well) abandonment: Since these are
monitoring wells rather than drinking water wells, and
chlorination could introduce chlorine into the aquifer, it is
not necessary for the wells to be "thoroughly chlorinated"
prior to sealing.
- Appendix I, Well Construction Records: Several of the old
monitoring wells have sand filter packs that extend too far
above and/or below the well screen. Although this design does
not fulfill the guidelines of the Solid Waste Sections, these
wells can probably still be used effectively for monitoring.
Therefore wells MW-1 and MW-8 may be used as part of the
routine detection monitoring system.
Appendix II, Groundwater Monitoring Well Maintenance Records:
As mentioned previously, maintenance problems should be
corrected.and documentation provided to the Section.
APPENDIX III, SAMPLING AND ANALYSIS PLAN
- Page 21, Test Methodologies: Regular ICP test methods (6010)
do not fulfill the requirements outlined in the June 24, 1994,
letter to MSWLF Owners and Operators that require low level
certification for most of the Appendix I metals. Antimony,
Barium, Beryllium, Cadmium, Chromium, Cobalt, Silver,
Thallium, and Vanadium all require a low level certification
analytical method. The proposed PQLs are too high for .Barium,
Beryllium, Cadmium, and Nickel. (Refer to 6-24-94 letter.)

Page 22: The proposed PQLs for the organic constituents
appear to have incorrect units (mg/1). Please confirm that
these are micrograms per liter rather than milligrams per
liter. A corrected table should be provided with the correct
units specified.
GROUNDWATER MONITOR WELL INSTALLATION REPORT Of October 5, 1994
- Appendix A: The well schematic diagram for MW-9 indicates the
sand pack extends about 7.5 feet above the top of the well
screen. This exceeds the two feet normally allowed.
- Appendix C: Calculations need to be provided for the ground-
water velocity values. It appears that the same predicted
effective porosity value was used for both wells screened in
the regolith and wells screened in fractured bedrock.
Estimated effective porosity values should be established for
each well based upon the formation materials present in the
screened interval. Ground -water velocity calculations should
be made based upon hydraulic conductivity values, effective
porosity values, and gradients specific to each individual
monitoring well.
GROUND -WATER MONITORING DATA
No ground -water monitoring data has been received by the Solid
Waste Section since November, 1993, except for a report
identified as "John's River MW #11 Resample" (October, 1994)
The initial sampling episode of the baseline sampling event
was due by October 9, 1994.
The "John's River MW #11 Resample" report did not identify the
analytical test methods used for the inorganic or organic
constituent analyses.
- The "John's River MW #11 Resample" report indicates several
organic constituents present at levels that exceed the N.C.
Groundwater Standards.

Subject: Disposal of Approximately 5-10 Pounds/Day of Stainless
Pin Grinding Sludge at the Burke County Landfill, (Permit
# 12-03) .
Dear Mr. Williams:
The Solid Waste Management Division has received a request for
characterization of the subject waste. Based upon the submitted
information, the waste appears to be non -hazardous. The Solid
Waste Management Division has no objection to the sanitary landfill
disposal of this waste, if in accordance with the conditions listed
below:
1. The own:: r/operator of the landfill approves the disposal.
2. The was;:e contains no free liquids and can be confined,
compacted, and covered in accordance with the Solid Waste
Management Rules (15A NCAC 13B).
3. Renewal of this approval will require resubmittal of a
Waste Determination Form and current supportive
analytical data. Renewal is required prior to subsequent
disposal if the process generating the waste changes or
if the waste composition changes significantly.
Failure to meet these conditions may result in revocation of
this approval, and subsequently, an administrative penalty. The
approval is subject to change if new rules and/or regulations were
to prohibit this practice-. If the process which generates the
waste changes or if the composition of the waste changes
significantly, this approval is void and re-evaluation of the waste
will be required prior to subsequent disposal. If you have further

Dear Ms. Wright:
The purpose of this letter is to transmit revisions to the referenced Transition
Plan submitted on April 9, 1994. These revisions address the technical review
comments offered by you and discussed with you in subsequent phone conversations.
All additions to the original text of the Transition Plan are double underlined for ease of
reference (deletions have not been lined out, but were stricken). The text is provided
on hole -punched paper so that the new sections can replace the old in the provided
binder. Two drawings are being transmitted separately, Drawing No. 3 (revised) and
Drawing No. 12. They should be substituted and inserted, respectively, into the roll of
Transition Plan drawings.
Regarding sections of the Transition Plan not addressed, we are in the process
of evaluating the status of the Erosion and Sediment Control Plan for the ongoing
operations at the landfill. The Erosion and Sediment Control Plan included in the
Transition Plan was developed for closure of the landfill. In discussions with the Land
Quality Section, we were informed that it is customary to review plans just prior to their
implementation. Since closure of the landfill is proposed for 1998, we wish to delay
submittal of the closure Erosion and Sediment Control Plan until just prior to closure.
We will keep you informed of the status of this issue and forward a copy of any
correspondence with the Land Quality Section. We have discussed portions of the
Water Quality Monitoring Plan with Bobby Lutfy, but are not aware of written comments
to the plan. We look forward to receiving comments on the Local Area Study and the
Water Quality Monitoring Plan in the near future.

The Solid Waste Section (Section) recently performed a technical review of the
referenced transition plan application submitted by Joyce Engineering Inc. on behalf of
Burke County. See the attached memorandum for geological and hydrological comments.
The Section's preliminary review involved evaluating the Burke County Landfill's
Transition Plan against the N. C. Solid Waste Management Rules, 15A NCAC 13B. Based
on its preliminary review, the Section needs the following additional information from Joyce
Engineering Inc.
Closure Plan
Section C states that "The slopes on the southern and southwestern sides of the
landfill have not had waste placed on them since before October 9, 1991." Side slopes of
existing areas must be capped with 1 X 10' cm/sec soil. In accordance with Rule
.1627(c)(2), the Division may approve an alternative cap system if Burke County can
adequately demonstrate that the alternative cap system will achieve an equivalent or
greater reduction in infiltration as the low -permeability barrier specified in Rule .1627(c)(1)
and the erosion layer will provide equivalent or improved protection as the erosion layer
specified in Rule .1627(c)(3). The cap system that is currently proposed in the transition
plan must comply with this demonstration in order to be considered for approval. Adjust
cost estimates accordingly for any revisions.
Please submit requested information or revisions to the Section within 45 days in
order to expedite review of the referenced transition plan application. Requested
information or revisions should be submitted in accordance with Rule .1603(b). The Section

Re: Site Study - Proposed Burke County Municipal Solid Waste Landfill
Mr. Meyer:
The Division of Solid Waste Management, Solid Waste Section (Section) has received
a Site Study for the above referenced facility. North Carolina General Statute, § 130A-294
(b1)(4) [copy enclosed], requires the applicant, Burke County, to request that each local
government having jurisdiction over any part of the land on which the referenced landfill is
proposed (including Burke County), issue a determination as to whether the local government
has in effect a zoning, subdivision, or land -use planning ordinance applicable to the landfill and
whether the proposed landfill would be consistent with said applicable ordinances. Requests
to applicable local governments must be accompanied by a copy of the permit application and
must be personally delivered, or delivered by certified mail, to the clerk of the local government.
Please forward copies of requests that you make to applicable local governments, in compliance
with this statute, to the Section.
The general statute also requires that determinations by applicable local governments
must be submitted to the Section, and a copy of the determination must be submitted to the
applicant (Burke County). Determinations shall be verified or supported by an affidavit signed
by the chief administrative officer or his official designee, clerk, or other official designated by
the local government to make the determination. If the local government determines that the
proposed landfill is not consistent with a zoning, subdivision, or land -use ordinance, a copy of
the ordinance and the reasons for the determination must be submitted to the Section.
The Section may not act upon an application for a permit until it has received a
determination from each local government requested by the applicant to make a determination.
If the local government fails to submit a determination to the Section within 15 days after
receipt of the request, the Section may proceed to consider the permit application without
regard to a local zoning, subdivision, and land -use planning ordinance.

Proposed Burke County Municipal Solid Waste Landfill

North Carolina General Statute §130A-294(bl)(2) [copy enclosed] requires the Division
of Solid Waste Management (Division) to notify the clerk of the board of commissioners that
the above referenced application has been filed with the Division, and to file a copy of the
application with the clerk. The Division hereby forwards to you one copy of the following:
• Site Study for the Proposed Expansion of the John's River Waste Management Facility,
Burke County, North Carolina, Volumes 1 and 2, dated November 30, 1995.
The statute requires that the applicable unit of local government(s) hold a public hearing,
when sufficient interest exists, regarding the proposed landfill sitting.
