Subject: Disposal of ten to twelve 55 gallon drums/week of wastewater treatment
sludge of spent dye house bath liquor at the Burke County Landfill
(Permit #12-03)
Dear Mr. Arrowood:
The Solid Waste Management Section has received a request for
characterization of the subject waste. Based upon the submitted information, the
waste appears to be non -hazardous. The Solid Waste Management Section has no
objection to the sanitary landfill disposal of this waste, if in accordance with
the conditions listed below:
1. The owner/operator of the landfill approves the disposal.
2. The waste contains no free liquids and can be confined, compacted, and
covered in accordance with the Solid Waste Management Rules (10 NCAC
10G).
3. The waste is to be removed from the drums at disposal.
4. Additionally, a submittal of the Waste Determination Form and supportive
analytical data, is required on the second anniversary of this approval.
Failure to meet these conditions may result in revocation of this approval,
and subsequently, an administrative penalty. The approval is subject to change if
new regulations were to prohibit this practice. If the process which generates
the waste changes or if the composition of the waste chances significantly, this
approval is void and re-evaluation of the waste will be required prior to
subsequent disposal.
If you have further questions, please contact this office at (919) 733-0692.

PROCEDURE AND CRITERIA FOR WASTE DETERMINATION
This procedure will be used by the Division of Health Services
to determine whether a waste is (1) hazardous as defined by 10 NCAC
10F, and (2) suitable for disposal at a solid waste management
facility.
The types of wastes that will be evaluated by this procedure are
primarily; but not exclusively, industrial and commercial wastes and
sludges, and Publicly Owned Treatment Works Sludges.
The Division of Health Services reserves the right to request
additional information or waive some of the regu-rements based on the
type of waste if it deems necessary. The Division may also require
some wastes to be treated or altered to render the wastes
environmentally immobile prior to disposal at a sanitary landfill.
Wastes disposed at sanitary landfills must be non -liquid and in a
form that can be confined, compacted, and covered in accordance with
the "Solid Waste Management Rule". APPROVAL TO DISPOSE OF THE WASTE
SHALL ALSO BE OBTAINED FROM THE OWNER OR OPERATOR OF THE LANDFILL
PRIOR TO DISPOSAL.
The following information is required for an evaluation.
Incomplete waste determination forms will be returned to the
generator without review, An asterisk(*) denotes information
required for Publicly Owned Treatment Works.

Re: Documentation for Ground -water Monitoring Wells at the Burke
County Landfill (Permit #12-03)
Dear Mr. Meyer,
Upon a recent review of our files, our office found that we do
not have sufficient documentation on the ground -water monitoring
wells at the Burke County Landfill facility. Within the next 30 days
would you please provide our office with the following information:
1. A map (preferably 8 1/2" x 11") delineating the entire
landfill and adjacent property owned (or leased) by you.
This map should clearly show the location of the landfill
with respect to the entire property.
2. A specific site map of the landfill itself illustrating the
configuration of the landfill per the original permit
description. On this map also indicate the following:
a. Areas of past landfilling activity
b. Area of present landfilling activity
C. Area of proposed future landfilling activity
d. Areas of demolition waste landfilling
e. Locations of existing monitoring wells; Each well
should be numbered on the map (e.g. MW-1; MW-2; etc.)
in a manner corresponding to the designations of the
wells in the field.
3. Complete and accurate Well Completion Records (DHS 3342) for
all ground -water monitoring wells. These records should
clearly indicate the following:
Page 2
a. Well construction specifications pertaining to
inner/outer casing diameter
b. Borehole depth
C. 24-hour water table elevations
d. Screen length
e. Screen slot size
f. Vertical extent of screen (e.g. where the screen is
placed in the aquifer).
g. All other data required on well construction forms as
specified in the "N.C. Water Quality Monitoring
Guidance Document for Solid Waste Facilities".
In addition, please submit to us a summary of the hydro -
geological data accumulated for the landfill site from the boring
operation. Include boring logs and other pertinent subsurface
information. Also, designate in writing to this office the name of
the contractor you have chosen to perform your annual ground and
surface water monitoring extractions, and the date on which you plan
to perform your annual sampling.

Subject: Disposal of One 32 Gallon Container/Day of Infectious Waste
Incinerator Ash at the Burke County Landfill (Permit
#12-03)
Dear Mr. Brown:
General Statute 130A-294 authorizes the Solid Waste Management
Division to regulate solid waste management in North Carolina. It,
therefore, gives authority to the Division to evaluate wastes that
may pose a threat to the environment or to public health and to
subsequently prohibit disposal of these wastes at a sanitary landfill
in accordance with Sections .0103(d) and (e) of the Solid Waste
Management Rules, 10 N.C.A.C. 10G.
Your recent request for disposal of the subject waste has been
critically reviewed and evaluated by section personnel. It is
concluded that the waste is not suitable for sanitary landfill
disposal because the leachable level of cadmium exceeds the allowable
landfill limits of 0.10 ppm for that metal. For this reason your
request is denied. You must discontinue taking this material to the
landfill immediately. It is recommended that the waste be disposed
in a secure landfill such as the one discussed with you, "First
Piedmont" in Chatham, Virginia (phone 804-432-0211). Alternatively,
you could possibly dispose of the ash as a non -hazardous waste in a
hazardous disposal site such as GSX in Roebuck, South Carolina (phone
803-576-6821). Additional assistance might be available to you from
the attached list of "Consultants, Disposer, and Transporters"
recommended by the N.C. Petroleum Marketers Association.
As per our conversation of today, there are at least two other
N.C. medical ash waste generators which have had high leachable cadmium

problems in their ash. Their names and contacts are given below. It
is my understanding that the Charlotte Mecklenburg Hospital Authority
have had some success in tracing the source of high leachable
cadmium. In the case of Transylvania Community Hospital, I have not
talked with Mr. Emory since May 26, 1989 when they were experiencing
similar problems. As to their finding any means to correct the high
leachable metals, I am not up-to-date. You might want to also
contact him to seek possible assistance.
