The enclosed plan for the referenced sanitary landfill is approved in
accordance with G.S. 130A-294, subject to the conditions of the permit.
Please note that the consultant has agreed to incorporate these conditions
into a revised construction plan and provide copies to the Branch and the county.
These revisions were a result of recent policy decisions within the Branch and
were requested after the original construction plan was submitted.

That certain tract of land lying and being in Lower Creek Township, Burke
County, North Carolina, with North Carolina Highway 18 lying to the west, North
Carolina Secondary Road 1501 (Antioch Road) lying to the east, the Catawba River
lying to the South, and Crescent Land & Timber Corp. lying to the North, and
BEGINNING at a point at a new iron pin, said point being identified as Point 62,
and being further located South 46' 18' 56" East (Grid) 6,445.28 feet
(Horizontal) from North Carolina Geodetic Survey Control Monument "Side" located
near the intersection of North Carolina Highway 18 and North Carolina Secondary
Road 1504, coordinates x = 1,208,712.81; y = 756,766.54; THENCE FROM SAID POINT
OF BEGINNING generally in a clockwise direction around the perimeter of the

thence from Point 395 North 34' 01' 15" East 90.14 feet to Point 62, the POINT
OF BEGINNING, and containing 318.00± acres. The above metes and bounds
description is taken from that certain survey entitled "Survey Plat for Burke
County Landfill", dated February 10, 1987, revised April 1, 1987, by Municipal
Engineering Services Company, P.A., Boone, North Carolina, and Garner, North
Carolina, to which survey reference is hereby made for more certainty of
description, said survey being recorded in Plat Book 9, pages 11 and 12, Burke
County Register of Deeds.
EXCEPTING FROM THE ABOVE METES AND BOUNDS DESCRIPTION that certain 0.500± acre
plot of land known as the Sudderth Cemetery, the same having been reserved by
Deed recorded in Book H-4, page 424, Burke County Register of Deeds, and being
described as follows: BEGINNING at a point at a new iron pin, said point being
identified as Point 303 on the above referenced Plat and being located South 58'
16' 37" East 3,179.01 feet from Point 62 identified and located in the metes and
bounds description of the above 318.00± acre tract of land; THENCE FROM SAID
POINT OF BEGINNING, North 620 40' 39" East 147.58 feet to a new iron pin at
Point 302; thence South 27' 19' 21" East 147.58 feet to a new iron pin at Point
301; thence South 62' 40' 39" West 147.58 feet to a new iron pin at Point 304;
thence North 270 19' 21" West 147.58 feet to Point 303, the POINT OF BEGINNING.
SOLID WASTE PERMIT
Conditions of Permit:
PERMIT NO. 12-03
DATE ISSUED 4/16/87
1. This permit may be subject to review at an administrative hearing upon
petition of anyone whose legal rights, privileges and duties may have been
affected by the issuance thereof.
2. This permit shall not be effective unless the certified copy is filed in
the register of deeds' office, in the grantor index under the name of the
o,aner of the land in the county or counties in which the land is located.
After recordation, the certified copy shall be returned to the Solid &
Hazardous Waste Management Branch and shall have indicated on it the page
and book number, date of recordation and registrar's seal.
3. When this property is sold, leased, conveyed or transferred, the deed or
other instrument of transfer shall contain in the description section in
no smaller type than that used in the body of the deed or instrument a
statement that the property has been used as a sanitary landfill.
4. The following requirements shall be met prior to receiving solid waste at
the site:
a. Site preparation shall be in accordance with the construction plan.
b. Site inspection shall be made by a representative of the Division of
Health Services.
c. The permit number and the words "NO HAZARDOUS OR LIQUID WASTE
ACCEPTED WITHOUT WRITTEN PERMISSION FROM THE DIVISION OF HEALTH
SERVICES" shall be posted on an entrance sign.
5. This solid waste disposal site is permitted to receive solid waste as
defined in 10 NCAC l0G; .0101(36), except that hazardous waste, liquid
waste and any other wastes that may pose a threat to the environment or
public health are prohibited from disposal at this site unless prior
authorization is obtained from the Division of Health Services.
6. This permit is for construction according to attached plans. Any
modification or deviation from the approved plans shall be approved by the
North Carolina Solid and Hazardous Waste Management Branch.
7. Ground water monitoring wells and monitoring requirements:
a. Eight wells shall be installed at locations as shown on construction
plans (Attachment 5).
b. Installation shall conform to DHS well standard (Attachment 1).
C. A well completion record shall be submitted to DHS for each
monitoring well constructed (Attachment 2) within 30 days upon
completion.
d. The location of the monitoring wells shall be physically located in
the field and approved by DHS prior to the well being constructed.
e. For new site locations, ground water monitoring wells shall be
constructed and sampled prior to the acceptance of any waste at the
landfill and conform to specifications outlined in the N.C. Water
Quality Monitoring Guidance Document for Solid Waste Facilities.
Complete specifications are delineated in this document which is
available from DHS.
f. Surface water sampling shall be performed at the locations specified
on the construction plans as per methods outlined in the
above -referenced Guidance Document.
g. Burke County shall sample monitoring wells and surface waters,
semi-annually, for the first year and annually thereafter as per the
above -referenced Guidance Document.
h. A readily accessible unobstructed path shall be initially cleared
and maintained so that 4-wheel drive vehicles may access the
monitoring wells at all times.
8. This facility shall conform to operating procedures in Rule .0505 of the
Solid waste Management Rules.
9. Ground water quality at this facility is subject to the classification and
remedial action provisions of 15 NCAC 2L (Attachment 3).
10. A 200' buffer between the waste boundary and the property boundary will be
maintained around the perimeter of the property (Attachment 5).
