ADDITIONAL COMMENTS
On December 7, 2021, Chuck Kirchner met with Clay Moody to conduct a comprehensive inspection of the Key Properties LCID Landfill and Treatment and Processing Operation on Sandy Cross Road in Burlington, Alamance County.
1. The facility is a land clearing and inert debris (LCID) landfill. The permitted LCID landfill area consists of a North Cell, a South Cell, and a 1.99-acre area (previously, notified LCID landfill# N0705) with an additional 1.2- acre expansion area. 2. The facility permit includes a yard waste treatment and processing (T&P) operation and a concrete crushing operation that is conducted atop a notified LCID landfill area (# N0475). The notified LCID landfill is covered with soil and is no longer active. 3. The facility is also a temporary disaster debris staging site (TDDSS). The TDDSS number is DS01-012. 4. The facility has constructed the North Cell and is operating the 1.99-acre area with additional 1.2-acre area. The area allotted for the South Cell has been cleared and has erosion control measures installed. 5. Mr. Clay Moody stated that he now owns 10% of Key Properties and David Moody owns 90%. An additional 25% of the business should be transferred to Clay Moody this year. 6. The facility is operating under Key Properties of Alamance County Inc. as the owner/operator and Hanover Road Properties Inc. as the landowner. New landowner must immediately contact Ming-Tai Chow, Environmental Engineer with the Solid Waste Section, at (919) 707-8251 to meet requirements for permit to be transferred.
7. Ensure Attachment 2 – Conditions of Permit to Construct are met prior to the operation of the South Cell. 8. The facility has installed edge of waste markers around the newly constructed North Cell. 9. Ensure edge of waste markers are installed around the South Cell upon completion of construction. 10. The facility expanded 2-Ac Fill area has been capped and currently has a mulching operation on top of the landfill. LCID waste is currently being placed in the North Cell. 11. Mr. Moody stated that they would like to start processing more wood waste into mulch. Please contact Ming-Tai Chow at contact information above to discuss permit options. 12. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris, and (used) asphalt. 13. The facility is permitted to receive LCID generated within: Alamance, Caswell, Chatham, Durham Forsyth, Guilford, Orange, Person, Randolph, Rockingham, and Wake Counties. 14. Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells. 15. Solid waste shall be covered with 1 foot of soil cover at least once per month, or when the active area
reaches one acre in size, whichever occurs first. 16. A ready supply of soil is available for cover material. 17. Excavation, grading and fill material side slopes must not exceed a ratio of three horizontal feet to one
vertical feet (3:1). 18. The LCID landfill facility annual report (FAR) was received by the SWS dated July 31, 2020. Estimated facility throughput for July 2019 through June 2020 is 23,140 yd3.
19. The yard waste T&P operation FAR was received by the SWS dated July 17, 2019. Facility throughput for July 2018 through June 2019 is 14,404 yd3. The amount of yard waste and mulch on site is approximately 3,000 yd3.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

20. Records were observed for waste received from March 28, 2021 through June 30, 2021. In that time 32,313 yd3 of brush, 4,706 yd3 of concrete/asphalt and 10,118 yd3 of dirt and rock have been received at this facility. In that time 52,200 yd3 of mulch, 1,163 yd3 of dirt, 376 yd3 of sand rock and 7,098 yd3 of soil mix
have been sold. 21. The facility shall not compost or grind high nitrogen-to-carbon ratio material. 22. Land-clearing debris (LCD) must not be stockpiled onsite for greater than 6 months; is restricted to less than 1 acre in size and 10 feet in height; and no more than 6000 cubic yards can be onsite at any one time.
23. Less than 6000 cubic yards of LCD were observed on site during this inspection.
24. Processed wood chips must not be stockpiled for greater than 3 months and is restricted to less than 1 acre
in size and 10 feet in height. 25. Processed wood chips mainly stockpiled near the entrance. Less than one acre of wood chips was observed on site during this inspection.
26. Mr. Moody stated that they have been able to sell up to 1,000 yd3 of mulch per day during the busy season.
27. Permissible grinding and storage areas include the existing area near the facility office and within the approved landfill footprint above the ground water table.
28. Clay Moody has installed a camera with motion sensors which overlooks the active cell. 29. Mr. Moody stated that most of the mulch on site goes to landscapers and mulch supply companies. 30. The facility shall not compost material. 31. Open burning of land clearing waste is prohibited. 32. The facility is operating under an Erosion and Sediment Control Plan, ALAMA-2014-028. 33. Sedimentation and erosion controls appeared adequate. There was no indication observed of erosion or runoff. 34. The facility commonly stores gravel, asphalt, and/or mulch adjacent to the office for sale and use on site.
35. The Pleasant Grove Volunteer Fire Department, Faucette Fire Department, or the Haw River Fire Department can be contacted to respond to an emergency at the facility. 36. Access roads are of all-weather construction. 37. An attendant is on duty when the facility is in operation. 38. The facility is secured by a locked gate. 39. The facility has proper signage. 40. The PTO expiration date is August 10, 2022. 41. The permit renewal application shall be submitted to the SWS by February 15, 2022.
