The monitoring shall be conducted at a frequency of no less than quarterly." Haywood County and Santek Environmental Services of North Carolina, LLC are in violation of 15A NCAC 13B .1626(4)(b)(ii) in that they failed to conduct quarterly landfill gas monitoring as required. During the November 30, 2021 inspection, landfill gas monitoring records were not in the operating record nor were they available for review. On December 2, 2021, the records were requested by email. On December 6, 2021, John Preston phoned and stated that the second and third quarter landfill gas monitoring for 2021 was not conducted due to the change of contracted providers after the purchase of Page 1 of 4 D_E FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management �aAT��ARo��NA � °°�` ItItE111111°�'°"��� Solid Waste Section Santek Environmental Services, LLC by Republic Services, Inc. which occurred on May 5, 2021. To resolve the violation, Haywood County and Santek Environmental Services of North Carolina, LLC must conduct quarterly landfill gas monitoring as required by 15A NCAC 13B .1626(4)(b)(ii) and submit the fourth quarter landfill gas monitoring report by email to Lee Hill at lee. hill@ncdenr.gov. B. 15A NCAC 13B .0203(d) states: `By receiving solid waste at a permitted facility, the permittee shall be considered by the Department to have accepted the conditions of the permit and shall comply with the conditions of the permit." Haywood County and Santek Environmental Services of North Carolina, LLC are in violation of 15A NCAC 13B .0203(d) in that they failed to conduct quarterly landfill gas monitoring as required by Attachment 3, Part I, 22 of the Permit to Operate. To resolve the violation, Haywood County and Santek Environmental Services of North Carolina, LLC must conduct quarterly landfill gas monitoring as required by Attachment 3, Part I, 22 of the Permit to Operate dated March 3, 2020 and submit the fourth quarter landfill gas monitoring report by email to Lee Hill at lee. hill@ncdenr.gov. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on November 30, 2021. 2. The facility is owned by Haywood County and operated by Santek Environmental of North Carolina, LLC. 3. The service area for the facility is Avery County, Buncombe County, Burke County, Cherokee County, Clay County, Graham County, Henderson County, Jackson County, Macon County, Madison County, McDowell County, Mitchell County, Polk County, Rutherford County, Swain County, Transylvania County, and Yancey County. 4. The facility entrance is secured by a gate and a portion of the facility is fenced to prevent unauthorized access. In areas where fencing has not been installed, topography serves to limit access as well. Records Review 5. Tonnage records were reviewed from the FY2020-2021 Facility Annual Report. The facility received 159,304.06 tons of material from July 1, 2020 to June 30, 2021, which is within the maximum variance allowed by GS 130A- 294(bl)(1) of the permitted amount of 146,000 tons. 6. Waste screening forms from January 4, 2021 to November 22, 2021 were reviewed and found to be complete. The final disposition of any unacceptable waste detected was included on the forms. 7. North Carolina Certified Landfill Operators • Mike Kirkpatrick (expires August 9, 2022) • Richard James (expires February 19, 2022) • Fred Whittier (expires February 19, 2022) 9. Landfill gas monitoring records were not available for review at the time of inspection. On December 2, 2021, the records were requested by email. On December 6, 2021, John Preston phoned and stated that the second and third quarter landfill gas monitoring for 2021 was not conducted. The first quarter landfill gas monitoring was conducted on March 3, 2021 and no exceedances were noted. On December 8, 2021, Derek Bouchard, Environmental Manager for Republic Services, sent an email stating the fourth quarter landfill gas monitoring was scheduled for December 20, 2021. See Observed Violations Section of this report for additional information. 10. Semi-annual groundwater monitoring was conducted by SCS Engineers, PC on October 20-12, 2020 and on April 22, 2021 and were submitted to the section for review. 11. As of November 29, 2021, 1873.45 tons of disaster debris has been received so far from the county's temporary debris reduction site (DS44-009). The TDRS was approved to receive debris from Tropical Storm Fred on August 23, 2021. Operations Inspection of the MSWLF Unit (4407-MSWLF-1993) 12. The facility is currently filling in Phase 5A. 13. The access roads were constructed of all-weather material and were being maintained in good condition. 14. The working face was of manageable size. A refrigerator was observed on the working face from a recently dumped load of storm debris from Tropical Storm Fred. Facility staff also saw the appliance and removed it from the working face during the inspection. 15. Windblown waste was minimal and was contained in the active cell. 16. The tipping area was large which resulted in waste becoming intermingled with the cover. It is recommended that the tipping area be made smaller and moved closer to the working face to prevent waste from getting mixed with cover soil. 17. The slopes inside the cell had adequate cover and no erosion issues were observed. 18. Storm water controls have been installed on the inactive phases of the landfill and appeared to be working as designed. All inactive phases had good vegetative cover and no erosion issues were noted. 19. The leachate pond had adequate freeboard and no visual deficiencies were noted in the liner. 20. Edge of waste (EOW) markers, constructed of wooden posts, were installed around the perimeter of the cell as required.
