Spills of septage onto the ground surface are a violation of the following rule. 15A NCAC 13B .0838 STANDARDS FOR SEPTAGE DETENTION AND TREATMENT FACILITIES (e) Each detention and treatment facility shall be designed, constructed, and maintained to: (1) prevent leaks or the flow of septage out of the facility into the seasonally high water table, onto the ground surface, or into any surface waters; Please see the addition comments on page 2 of this report. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1. An appropriate No Trespassing sign was displayed. 2. The tanks were accessible for inspection. 3. The tank appeared structurally sound. 4. Septage transferals appear to have been made in a safe and sanitary manner. The observed violation noted on page 1 appeared to be a one-time occurrence. The septage spilled was largely assimilated by the ground surface at the time of the inspection where no cleanup was needed. 5. No vectors or objectional odors were noticed. 6. Approved setbacks appear to be met 7. The access road was passable.
