The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Currently this facility consists of one 1,400-gallon steel collection box and one 263,000-gallon stainless steel tank for the screening, decanting and storage of grease septage. According to staff and current application (submitted on 11/3/2021), these items will no longer be used for the storage of septage.
2. The current application lists two 31,000-gallon tanks with a 1400-gallon screening box (see photos below).
Two 31,000 gal. tanks with screening box 1400 gal screening box over storm drain 3. Due to vegetation and building location setback requirements were checked using the Gaston County GIS. The distance from the tanks to the nearest property boundary is approximately 150’. The distance to the nearest surface water is approximately 470’. 4. The tanks are next to (and the screening box directly over) a storm drain. Staff on location stated that the storm drain (and all the storm water from the facility) connects to a WWTP. Any leaks or spills that would occur would flow into this storm drain. This information was not in the application. 5. The tanks appeared to be structurally sound and no leaks were observed.
