Haywood County
There have been no efforts taken by the Town of Canton to correct violations specified
in the Compliance Order. The solid waste that was place above permitted vertical elevations
and beyond permitted horizontal distances approved in the landfill plan has not been removed.
I am attaching a copy of my last inspection to this memo.
Jack Horton, Haywood County Manager, has informed me that arrangements have
been made with the Town of Canton to accept the Town's waste at the County facility located
in the Whiteoak Community once the site is completed and operational.
Please let me know if further information is needed.

On December 18, 1990 Champion submitted a report from Law
Engineering, which provided an assessment of the long term
potential impact of the No. 2 Fiberline excavation material
on ground water at the Canton Municipal Landfill Permit
Number 44-04. This report was in response to your
conditional approval of disposal of approximately 15,000
cubic yards of excavation material from Champion
International Corporation's Canton Mill, on October 15, 1990.
The Solid Waste Section conditional approval was based on an
acceptance of this long term ground water assessment.
Champion conducted extensive testing of this excavation
material prior to transport to the Canton Municipal Landfill.
The analysis indicated the soils were not hazardous based on
criteria established by the EPA or the State of North
Carolina and the detected concentrations of materials were
well below the North Carolina landfill maximum. The soil did
not exhibit the characteristic of corrosivity because the
representative soil pH (EPA Method 9045) was 10.9 and not
aqueous or liquid. The representative soil pH of 10.9 is
below the corrosivity limit of pH 12.5, if the sample is
aqueous. Due to the elevated pH, the Solid Waste Section
expressed concern that the excavation material could impact
ground water pH at the Canton Municipal Landfill.
To address this concern, Champion asked Law Engineering to
provide recommendations for the short term protection of
ground water. Law Engineerings recommendations were designed
to reduce any potential significant impact at the Canton
Landfill. The report included the following recommendations:
1. Flatten and track with dozer existing waste slopes to a
2.5H:1V (horizontal to vertical slope).
2. Construct a rainfall run-on diversion ditch or berm
(asphalt curbing or soil) at the top of the waste pile
along the landfill entrance road.

This ground water protection plan was completely implemented
by December 14, 1990.
In Law Engineering's report of assessment it was concluded:
"Based on the above observations (contained in the report),
laboratory testing and our evaluation, it is our opinion
that the site groundwater will not be significantly
impacted by the presence of this soil".
This conclusion was supported by the data generated during
the following eight months. The pH in the collection basin
remained below 8.2 throughout the entire observation period.
Table 1 is a summary of this testing. One additional pH
measurement was taken on December 1, 1992, prior to writing
this letter and found to be 7.1.
Analysis performed by Pace Incorporated on the Canton
Municipal Landfill MW-2 (down gradient) for samples collected
on October 22, 1991 and October 15, 1992 indicated a pH of
6.7. Due to the stable and neutral pH measurements in the
collection basin and the recent down stream monitoring well
test results, Champion proposes to demolish the collection
basin installed in December, 1990. The toe drain collection
system would be demolished, the retention basin would be
filled in, and the surface would be graded and seeded.

Re: Implementation Of Subtitle 'D' Ground -water Monitoring Program
Dear Mr. Stamey,
The purpose of this correspondence is to provide information and
clarification on the changes in ground -water monitoring requirements
for MSWLF facilities that remain in operation after October 9, 1993.
The proposed North Carolina Solid Waste Management Rules reflect
significant changes for ground -water monitoring based on requirements
of the E.P.A. Subtitle D Rules.
Attachment A to this letter provides a summary of important
dates and significant activities that must be accomplished in order
to be in compliance with the new rules. Attachment B contrasts
existing and proposed ground -water monitoring and assessment
requirements based on changes in the rules. Because of significant
increases in costs that will be incurred in order to operate a MSWLF
under the new Subtitle D Rules, including financial assurance and
increased costs for ground -water monitoring and assessment, you may
wish to seriously consider closing your sanitary landfill prior to
October 9,1993, when the new rules become effective.
When the new rules take effect, MSWLF facilities that have
violations of the North Carolina Groundwater Quality Standards or
facilities that show a significant statistical increase in the level
of any Appendix I constituent will quickly be required to implement
assessment monitoring for all Appendix II constituents. Since the
Groundwater Quality Standards are also used in establishing the
ground -water protection standards, MSWLF facilities with violations
may also rapidly move into assessment of corrective action
alternatives based on a full-scale ground -water investigation to
determine the nature and extent of contamination at the site.

If the Town of Canton chooses to continue to operate their MSWLF
facility after October 9, 1993, then you need to begin planning and
budgeting immediately for the activities outlined in Attachment A. A
revised Water Quality Monitoring Plan must be submitted as part of
the Transition Plan on or before April 9, 1994. All background
sampling and related activities for the upgraded monitoring system
must be completed and reported to the Division in order to
demonstrate compliance with the new water quality monitoring
requirements on or before October 9, 1994.
Please note that the goals and objectives for ground -water
assessment monitoring and ground -water contamination investigations
are the same under both the current and the proposed rules and shall
be accomplished in a way that is protective of human health and the
environment. However, current rules allow for greater flexibility in
the assessment and investigation activities and the sample analytical
costs could be substantially less using the constituent list required
under current rules and policy as compared to analytical costs
required by the new rules based on Subtitle D, which require sampling
for the Appendix II list of constituents.
I hope this letter has been helpful in providing you more
insight into the actions that will be required by the Town of Canton
to maintain compliance with the water quality monitoring requirements
of the Solid Waste Management Rules as we make the transition to the
new rules growing out of the E.P.A. Subtitle D Regulations. If you

Dear Mr. Mathews:
This letter is formal notification that the Town of Canton
intends to cease operation of its existing landfill for disposal of
sanitary wastes by October 9, 1993. However, the Town intends to
continue operation of the existing facility as a construction and
demolition landfill only until April 9, 1994, at which time the
previously submitted closure plan will be executed as planned.
The continued use of the landfill thorough April 9, 1994 is
contingent upon the proposed extension of the dates as outlined in
your memo of September 3, 1993. We would appreciate notification
of formal adoption of the proposed extension or any other changes
to the proposed rules which might affect our schedule.
In light of our above plans we would ask that you comment on
our proposed plan to continue to use a small portion of our
landfill as a construction demolition landfill.

Dear Mr. Coffey:
As you are aware, the Town of Canton has been fined for non-compliance with Solid Waste
Management Rules and has paid the fine of $3,000.00.
The main reason for the penalty, cited by Nancy Scott, Assistant Attorney General, in a letter dated
March 29, 1993, was the lack of a concrete plan for removal of waste exceeding the limits of the landfill
construction plans.
As we stated in our letter of April 7, 1993, a landfill closure plan was submitted originally on October
14, 1992 and revised on November 11, 1992. The erosion control plan was approved by Land Resources
on December 9, 1992.
Since our April 7th letter, we have been in contact with your office several times by phone requesting
comments or approval of the closure plan, which will remove the material exceeding the landfill limits and
close the landfill at the same time. As of this date, we have not received any response from your office
concerning the plan.
The Town of Canton is ready to begin closing the landfill in order to be finished by October, 1993. We
would appreciate your comments or approval on the closure plan as soon as possible.

Dear Mr. Coffey:
In response to the letter of March 29, 1993, from Nancy E. Scott, Assistant Attorney General, please
find enclosed a set of plans showing the landfill closure plan for the Town of Canton, in Haywood County.
These plans were previously submitted to your office and the Asheville office of the Land Quality Section
on October 14, 1992. After review by Land Quality, revised sheets were sent to your office on November
11, 1992. Approval by Land Quality was received on December 9, 1992.
The area of the landfill where the property related violation occurred is on Sheet No. 3 on the
western portion of the site. There has been a problem with conflicting property line deeds, making
determining the actual property line a difficult job; however, a property line agreeable to both the Town of
Canton and the private property owner was staked last fall.
It is our belief that if the approved site plan is followed, all of the material will be removed from the
private property and it will be restored to the original contours. In any event, the Town is aware that all
material is to be removed from across the property line. The agreed upon method of removal is for the Town
to use the suitable material for daily cover, with unsuitable material being placed in the demolition portion
of the landfill.
To the best of my knowledge, the Landfill Closure Plan approved December 9, 1992, achieves the
goal of removal of the excess material and should be considered the concrete plans required by Solid Waste
for correction of the violation.

This office has reviewed the erosion and sedimentation control plan submitted for the project
listed below. We find the plan to be acceptable and hereby issue this Letter of pproval with
modifications and/or performance reservations. A list of the modifications required and/or
reservations is attached. This approval is conditioned upon the incorporation or addition of these
items to the plan. Please be advised that Title 15A, North Carolina Administrative Code
4B.0017(a), requires that a copy of the approved soil erosion control plan be on file at the job site.
Also, _you should consider this letter to give the Notice required by NCGS § 113A-61(d) of our
right of periodic inspection to ensure compliance with the approved plan.
The State's Sedimentation Pollution Control Program is a performance -oriented program
requiring protection of the natural resources and adjoining properties. If, following commencement
of this project, it is determined that the plan is inadequate to meet the requirements of NCGS
§ 113A-51 to 66, this office may require revisions to the plan and implementation of the revisions
to ensure compliance with the Act.
Please note that this approval is based in part on the accuracy of the information provided in
the Financial Responsibility Form which you have provided. You are requested to file an amended
form if there is any change in,the information included on the form. In addition, it would be
helpful if you notify this office of the proposed starting date for this project. Your cooperation
is appreciated.
