The deadline for having this information in our office was Janu�15, 19921992. Please contact me as soon as possible regarding this matter. The Town has been negotiating with Haywood County concerning the potential operation and use of the landfill and this process has caused some delays in addressing the problems. These negotiations are still on -going but the Town intends to achieve as soon as feasible. Additionally, the Town has compiled topographic information including cross -sections on its present landfill to determine remaining volume. This has taken several months to accomplish. Based on the above, the Town of Canton proposes the following: 1. Scales will be installed at the existing landfill within 45 days of the date of this letter. Installation of the scales was delayed because of an investigation into an alternate entrance to the landfill. Recently, this investigation determined that the alternate entrance was not feasible, therefore the scales can now be installed. 2. The encroachment over the property line with the demolition material is being studied.and will be corrected either by purchasing additional property if feasible or moving the material which violates the buffer requirement. 3. The Town intends to apply for a new lift, if required, at the current site which will incorporate a portion of the material which exceeds the current permitted elevation. We also intend to request that those portions of this material which are acceptable as daily cover be used as such for both the current lift and any new lift. Mr. James Patterson February 18, 1992 Page 2 4. The erosion control plan , as_ originally submitted, will be implemented as soon as feasible, and upgraded to meet present standards. In order to accomplish these goals, the Town has retained the services of McGill Associates, P.A. to assist with items 2, 3 and 4. To allow sufficient time, the Town of Canton anticipates that a plan outlining procedures for compliance can be made by April 2, 1992. The Town will take the following steps to remove the material: The property line will be staked to determine the exact area and amount of the encroachment. 2. A new slope will be staked allowing for the required buffer. 3. Material to be removed will be sorted and that which is suitable will be used as daily cover. Any unsuitable material will be set aside and placed in the landfill as demolition material. 4. Any material above the permitted elevation will be handled the same as Item (3) above. 5. After the demolition material conforms to the required grade, it will be stabilized in the same manner as the other lifts in the landfill. Work will begin on this within 60 days and will proceed until complete. An effort will be made to remove the material over the property line first, if feasible. C. Solid Waste Section Western Area Supervisor. Regarding the scale situation, we are establishing a deadline of April 3, 1992 (the 45 days you requested) for installation/operation of the scales. Since we are well into the baseline year for weighing wastes, it is imperative that this deadline be met. No further extensions will be granted. The April 2, 1992, date which was requested for submitting a plan relevant to steps that will be taken to rectify wastes being placed beyond/above permitted landfill limits is approved with the stipulation that we receive concrete plans. Remediation efforts should begin immediately after State approval of your plan. Implementation of erosion control measures as specified in your approved landfill plan should begin immediately and if a new lift (vertical expansion) is approved in the future, additional/upgraded erosion control measures may be required. The letter from Mr. Bill Stamey of the Town of Canton dated February 18, 1992, outlined several steps the Town intended to take to correct the problems at the landfill. Since that time, some decisions have been made that will affect the Town's options. The following actions by the Town of Canton are planned: 1. The footings for the scales will be poured as soon as weather permits and the scales should be installed prior to the April 3 deadline. 2. The property line where the encroachment occurred is being staked and removal of the material will begin immediately. The Town intends to use the suitable material for daily cover and dispose of the remainder in the landfill. 3. The sediment and erosion control plan for the original landfill permit will be installed as soon as -weather permits. 4. The Town intends to apply for a vertical expansion of the current landfill. A new expansion will include an updated erosion control plan. 5. The Town intends to attempt to permit a construction and demolition landfill on previously unpermitted property next to the existing landfill. Box 27687 Raleigh, North Carolina 27611-7687 Dear Mr. Hocutt: Attached is information for your files concerning excavated material at Champion International Corporation's Canton Mill. The information includes Law Engineering's laboratory test data reports for excavated material in the Filter Bed Area. On January 8, 1992 Derric Brown received verbal approval from you to dispose of this material in the Canton Municipal Landfill. The removal of this material is required in preparation for construction of the No.l Fiberline Oxygen Delignification System as part of the Canton Modernization Project. Complete removal of these beds will take place as part of the project. The filterbeds have not been utilized since 1980. The attached Table provides a description of each area, the estimated material volume, and the number of samples collected to form the composite. Champion has conducted extensive testing of this material. Law Engineering sampled the material on December 2,1991. The following details summarize this assessment. Figure 1 is a site location map of Champion's Canton Mill. The filter beds were divided into two areas, area 1 on the west side and Area 2 on the east side. Seven samples from each area t,7ere collected, composited and thoroughly mixed to yield one representative sample from each area. The location of each sample is shown in Figure 2. The material was sampled by clearing the area with a shovel and manually grabbing the sample. A fresh set of gloves was used for each sampling to prevent cross contamination. Mr Bill Hocutt February 17, 1992 Page 2 Samples were collected in Teflon -lined glass containers. Sample containers were prepared from the laboratory- and certified sterile. The samples were labeled with identifying numbers and shipped overnight in an insulated cooler to Law Environmental National Laboratories in Kennesaw, Georgia for analysis. In the Laboratory, all the samples were extracted by the Toxicity Characteristic Leaching Procedure (TCLP). Attachment II includes the test data reports and chain of custody- records for the sample points. The samples were analyzed for the eight TCLP metals and pH. Low concentrations of barium, were detected in the composite samples. This analysis however indicates the material is not classified as hazardous based on criteria established by EPA and/or the State of North Carolina for the characterization of a hazardous waste by the TCLP. The measured concentrations are 1.0 ppm for Filter Bed-1 Area and 0.6 ppm for Filter Bed-2 Area. The measured concentrations are well below the North Carolina landfill maximum of 10.0 ppm. The material does not exhibit the characteristic of corrosivity because the representative soil pH's (EPA Method 9045) are 7.4 for Area 1 and 5.8 for Area 2, and the materials are not aqueous or liquid. The representative soil sample pH is far below the corrosivity limit of 12.5. As always, if free liquids are detected, the excavated soil is dried on -site before transport to the sanitary landfill. Meer Direclol This past January a letter was mailed to all landfill owner/ operators informing them that the Solid Waste Section will be requiring semi-annual ground and surface water monitoring beginning January 1, 1993. All landfill owner/operators were requested to notify the Section prior to July 1, 1992, of the months they will be performing each of their semi-annual sampling episodes for the 1993 calendar year. Please note details in the letter of January 10, 1992 that is enclosed with this letter. As of this -date the Solid Waste Section has no record of the proposed sampling"dates for next year for your facility. Please notify the Solid.Waste Section in writing immediately of the two months you have chosen for sampling this coming year. A response should be received in our office by October 15, 1992. If you have any questions regarding this request or the water quality monitoring program required at sanitary landfills in North Carolina, please contact the Solid Waste Section at (919) 733-0692. The following information must be submitted in order to continue the review process. 1. A copy of the deed or other legal description of the site and property owner's name should be provided. 2. The landfilling limits should be clearly shown on the construction plan, both horizontal boundaries and final contours. 3. It must be shown that waste will be a minimum of four (4) feet above the seasonal high water table. These comments are intended to expedite the review process, and in no way do they restrict the Section's right to request further information following further review. The information includes Law Engineering's laboratory test data reports for soil samples beneath the existing ground level concrete slab in the old filter bed area. On April 2, we discussed this material and you provided us with verbal approval to dispose of it in the Canton Municipal Landfill. As we discussed care will be taken to not aggravate any elevation concerns at this facility. The removal of this material is required to construct foundations for an 02 Reactor and a Blow Tank used in the No. 1 Fiberline Oxygen Delignification System as part of the Canton Modernization Project. The attached table provides a description of the area, the estimated material volume, and the number of samples collected to form the composite. Champion has conducted testing of this material. Law Engineering sampled the material on March 5, 1992. The following details summarize this assessment. Figure 1 is a site location map of Champion's Canton Mill. Figure 2 shows the location where two samples were taken. The two samples were composited for analysis. Samples were collected in Teflon -lined glass containers. Sample containers were prepared from the laboratory and certified sterile. The samples were labeled with identifying numbers and shipped overnight in an insulated cooler to Law Environmental National Laboratories in Kennesaw, Georgia for analysis. In the Laboratory, all the samples were extracted by the Toxicity Characteristic Leaching Procedure (TCLP). Attachment II includes the test data reports and chain of custody records for the sample points. The samples were analyzed for the eight TCLP metals and pH. \fr. Bill Hocutt April 9, 1992 Page 2 A low concentration of barium was detected in the composite sample. This analysis however indicates the material is not classified as hazardous based on criteria established by EPA and/or the State of North Carolina for the characterization of a hazardous waste by the TCLP. The measured concentration of barium in the composite was 0.6 ppm. This concentration is well below the North Carolina landfill maximum of 10.0 ppm . The material does not exhibit the characteristic of corrosivity because the representative soil pH (EPA 'Method 9045) is 6.3 and the material is not aqueous or liquid. The representative soil sample pH is far below the corrosivity limit of 12.5. As always, if free liquids are detected, the excavated soil is dried on -site before transport to the sanitary landfill. On January 8, 1992 Derric Brown received verbal approval from you to dispose of this material in the Canton Municipal Landfill. Complete removal of these beds will take place as part of the project. The filterbeds have not been utilized since 1980. Champion has conducted extensive testing of this material. Law Engineering sampled the material on December 2,1991. The following details summarize this assessment. Figure 1 is a site location map of Champion's Canton dill. The filter beds were divided into two areas, area 1 on the west side and area 2 on the east side. Seven samples from each area were collected, composited and thoroughly mixed to yield one representative sample from each area. The location of each sample is shown in Figure 2. The material was sampled by clearing the area with a shovel and manually grabbing the sample. The letter from Mr. Bill Stamey of the Town of Canton dated February 18, 1992, outlined several steps the Town intended to take to correct the problems at the landfill. Since that time, some decisions have been made that will affect the Town's options. The following actions by the Town of Canton are planned: 1. The footings for the scales will be poured as soon as weather permits and the scales should be installed prior to the April 3 deadline. 2. The property line where the encroachment occurred is being staked and removal of the material will begin immediately. The Town intends to use the suitable material for daily cover and dispose of the remainder in the landfill. 3. The sediment and erosion control plan for the original landfill permit will be installed as soon as weather permits. 4. The Town intends to apply for a vertical expansion of the current landfill. A new expansion will include an updated erosion control plan. 5. The Town intends to attempt to permit a construction and demolition landfill on previously unpermitted property next to the existing landfill. You stated in your letter that the decision should be made before the end of January, 1992. Since it is now nearing the end of January, this proposal is acceptable. Patterson Solid Waste Section NC Department of Economic, Health, and Natural Resources 59 Woodfin Place Asheville, NC 28801 Dear Mr. Patterson: Reference: Town of Canton Samitary Landfill Permit # 44-04 Scales have been purchased and delivered to the landfill, but have not been installed and placed in service because the Town has been negotiating to relocate the entrance to the landfill through adjoining property off Chestnut Mountain Road. The final decision on the proposed relocation should be made before the end of January and the scales will be installed im- mediately thereafter. We do not believe there has been a loss of important baseline data since this period has been very atypical. Waste material from the Champion International modernization program during the past year(7/90-6/91) increased the total estimated tonnage by almost 800%, and continues to make totals unusable as a baseline for normal operations. The deadline for having this information in our office was January 15, 1992. Please contact me as soon as possible regarding this matter.
