OBSERVED VIOLATIONS
15A NCAC 13B 15A NCAC 13B .0402 "Operational Requirements" states: "Any person who maintains or operates
a transfer facility shall maintain and operate the facility in conformance with the following practices unless
otherwise specified in the permit. "
Item #7(a) in Part I (Operating Conditions) of Attachment 3 (Conditions of Operating Permit) of the Permit to
Operate dated October 1, 2008 (DIN 5925) states "The tipping floor and transfer trailer loading area must be
maintained in a clean, sanitary condition at all times and must be cleaned at least daily in accordance with the
approved Operational Plan. "
Burke County is in violation of 15A NCAC 13B. 0402 in that it failed to ensure that the transfer trailer
loading area (a.k.a. "receiving bay") was maintained in a clean and sanitary condition at all times. (Photos
#2 - #4) On Monday July 9, 2012, before any wastes had been taken in for the day, wastes were observed on the
receiving bay floor. These wastes were left over from the prior Saturday (7/07/12). A transfer trailer filled with
solid waste that was taken in on Saturday (7/07/12) was in the receiving bay. (Photo #1)
To correct this violation and be in compliance with I5A NCAC 13B. 0402, Burke County must immediately
remove all debris and waste from the transfer trailer loading area (a.k.a. "receiving bay') and ensue that
transfer station is maintained in a clean and sanitary condition at all times.

You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for
each violation of the Solid Waste Statute or Regulations. If the violation(s) noted here continue, you may be subject to enforcement
actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
STATUS OF PAST NOTED VIOLATIONS (List all noted last audit):
1. On 7/25/11 Burke County was cited for violation of 15A NCAC 13B .0105(c) in that it failed to ensure trailers
utilized for hauling waste within and from this facility are leak proof and are being maintained in good repair after
been previously notified of the issue by the Section. This violation has been resolved.
On 7/25/11 Burke County was cited for violation of 15A NCAC 13B .0105(d) in that it failed to ensure that two
transfer trailers filled with municipal solid waste at their facility, were covered to keep their contents dry during a
weather event. This violation has been resolved.
AREAS OF CONCERN AND COMMENTS:
1. Hours of operation: M-F: 7AM — 4PM Sat: 7AM — 1 PM
2. Garbage Disposal Services, Inc. (GDS) is under contract with Burke County to haul municipal solid waste from the
Burke County Transfer station to the Foothills Landfill in Lenoir, NC which includes providing the waste transfer
trailers; moving the waste trailers in and out of the receiving bay of the transfer station; and hauling the waste from
the transfer station to the Foothills Landfill in Lenoir, NC. GDS has subcontracted K.R. Drenth Trucking, Inc. to
meet the conditions of GDS's agreement with Burke County.
3. The transfer station is permitted to receive municipal solid waste that has been generated from within Avery,
Burke, Caldwell, Catawba, Cleveland Lincoln, McDowell, Mitchell, Rutherford and Yancey Counties.
4. Wastes must be transported to the Foothills Municipal Solid Waste landfill in Lenoir, Caldwell County.
5. The transfer station is currently taking in an average of approximately 250 tons of municipal waste per day.
6. Residential tipping fee at the transfer station is $59.12 per ton. Commercial / industrial tipping fee is $58.00 per
ton.
7. Used oil and used oil filters collection receptacles are located on the asphalt apron in front of the transfer station.
8. Leachate from the tipping floor is collected in a floor drain that runs across the entire front of the Transfer Station.

Leachate from the receiving bay is collected in a floor drain the runs across the width of the east end access. Both
of these floor drains feed into gallon underground storage tank that is located off the SE quadrant of the transfer
station. According to the September 2008 Revised Operations Plan (DIN 5821) prepared by Joyce Engineering,
Inc. the leachate holding tank has a capacity of 5,000-gallons.
9. The leachate is pumped out and hauled to the City of Morganton's Wastewater Treatment plant by Honeywell
Septic of Morganton. (4068 Bel Aire Dr., Morganton, NC 28655, 828-433-7867)
10. The leachate holding tank was most recently pumped out one week ago.
11. The interior walls (Photos #7 and #8) and the floor drains (Photos #5 and #6) will soon need to be cleaned
to ensure compliance with condition #7 of the October 1, 2008 Permit to Operate (DIN 5925).
12. Waste screening is done approximately once a week.

13. Lead -acid batteries had been set aside for recycling.
14. Wastes were being received during the inspection.
15. Multiple bait traps had been set outside of the transfer station to control rodents and other vermin.
16. Wind-blown litter was very well controlled.

17. There is a 2-inch water hose on site for fire control. The Chesterfield volunteer fire department also provides fire
response for the facility.
18. The tipping floor was in good condition — no cracks and no worn concrete.
WHITE GOODS:
19. White goods are maintained in a separate area located west of the Transfer Station. Appliances that contain CFCs
are stored up -right on a concrete pad.
20. Refrigeration gases (CFCs) are removed from the white goods by OmniSource Southeast LLC.
21. OmniSource Southeast LLC bales scrap metal on -site for collection and disposal along with the white goods.

SCRAP TIRE COLLECTION:
22. Scrap tires that are still on the rim are disposed of for $2.50 to $3.50 each.
23. The county is in the process of purchasing a "tire changer" for removing tires from rims.
24. There are three semi -trailers on site for the collection, storage and transport of scrap tires to the US Tire facility in
Concord, NC. (Photo # 10)
YARD WASTE:
25. Yard waste is ground into mulch for use on site and for sale to the public.
26. Yard waste is sold to the public for: Small Pickup $9.50 Large Pickup $11.00
27. Burke County owns their own grinder which is currently undergoing repairs.

Burke County is in receipt of the above -referenced Audit Report and NOV. The Violation
for the transfer trailer loading area (receiving bay) has been addressed with the heavy
equipment operators at the transfer station. Both of the individuals have been made
aware of the need to keep this area clean and each has been given copies of the
Facility Plan, Operations Plan and Permit No. 12-05T.
Also, item 11 under Areas of Concern and Comments states "The interior walls and
floor drains will soon need to be cleaned ..... ". This work has been started. We lack the
areas of the interior that cannot be reached with a small lift. We should have that larger
lift rented by mid -week next week and should have the remaining areas cleaned by the
end of next week (8/24/12).
