This amendment to permit is for construction according to the attached plans. Additional conditions and revisions of the approved plans shall be approved by the North Carolina Solid Waste Branch. 2. Ground water monitoring wells and monitoring requirements: a. One additional well shall be installed at locations as shown on construction plans. b. Installation shall conform to DHS well standard (Attachment 1). C. A well completion record shall be submitted to DHS for each monitoring well constructed (Attachment 2) within 30 days upon completion. d. The location of the monitoring wells shall be physically located in the field and approved by DHS prior to the well being constructed. e. For new site locations, ground water monitoring wells shall be constructed and sampled prior to the acceptance of any waste at the landfill and conform to specifications outlined in the N.C. Water Quality Monitoring Guidance Document for Solid Waste Facilities. Complete specifications are delineated in this document which is available from DHS. f. Surface water sampling shall be performed at the locations specified on the construction plans as per methods outlined in the above -referenced Guidance Document. g. Madison County shall sample monitoring wells and surface waters, semi-annually, for the first year and annually thereafter as per the above -referenced Guidance Document. h. A readily accessible unobstructed path shall be initially cleared and maintained so that four-wheel drive vehicles may access the monitoring wells at all times. 3. This facility shall conform to operating procedures in Rule .0505 of the Solid Waste Management Rules. 4. Ground water quality at this facility is subject to the classification and remedial action provisions of 15 NCAC 2L (Attachment 3). 5. A closure and post -closure plan must be submitted for approval at least 90 days prior to closure and post -closure. The plan must include all steps necessary to close and maintain the unit in accordance with all rules in effect at that time. T N.C. (1) PLAN AND PERMIT REQUIREMENTS (a) Construction plans shall be approved and followed. —(b) Specified monitoring and reporting requirements shall be met. (2) SPREADING AND COMPACTING REQUIREMENTS — (a) Solid waste shall be restricted into the smallest area feasible. —(b) Solid waste shall be compacted as densely as practical into cells. (3) CQV R REQUIREMENTS (a) Solid waste shall be covered after each day of operation, with a compacted layer of at least six inches of suitable cover or as specified by the division. — (b) Areas which will not have additional wastes placed on them for 12 months or more shall be covered with a minimum of one foot of intermediate cover. — (c) After final termination of disposal operations at the site or a major part thereof or u pon revocation of a permit, the area shall be covered with at least two feet of suitable compacted earth. (4) EROSION CONTROL REQUIREMENTS —(a) Adequate erosion control measures shall be practiced to pre- vent silt from leaving the site. (b) Adequate erosion control measures shall be practiced to pre- vent excessive on -site erosion. (9) SIGN REQUIREMENTS —(a) Signs providing information on du mping procedures, the hou rs during which the site is open for public use, the permit number and other pertinent information shall be posted at the site entrance. — (b) Signs shall be posted stating that no hazardous or liquid waste can be received without written permission from the division. —(c) Traffic signs or markers shall be provided as necessary to pro- mote an orderly traffic pattern to and from the discharge area and to maintain efficient operating conditions. (10) (5) DRAINAGE CONTROL REQUIREMENTS — (a) Surface water shall be diverted from the operational area. — (b) Surface water shall not be impounded over or in waste. (11) —(c) Completed areas shall be adequately sloped to allow surface water runoff in a controlled manner. (6) VEGETATION REQUIREMENTS —(a) Within six months after final termination of disposal operations at the site on a major part thereof or upon revocation of a permit, the area shall be stabilized with native grasses. —(b) Temporary seeding will be utilized as necessary to stabilize the site. (7) WATER PROTECTION REQUIREMENTS —(a) The separation distance of four (4) feet between waste and water table shall be maintained unless otherwise specified by the division in the permit. —(b) Solid waste shall not be disposed of in water. — (c) Leachate shall be contained on site or properly treated prior to discharge. An NPDES permit may be required prior to the dis- charge of leachate to surface waters. (8) ACCESS AND SECURITY REQUIREMENTS (a) The site shall be adequately secured by means of gates, chains, berms, fences, and other security measures approved by the division, to prevent unauthorized entry. — (b) An attendant shall be on duty at the site at all times while it is open for public use to ensure compliance with operational requirements. — (c) The access road to the site shall be of all-weather construction and maintained in good condition. — (d) Dust control measures shall be implemented where necessary. REMARKS: I A e I r -a'/'- SAFETY REQUIREMENTS —(a) Open burning of solid waste is prohibited. —(b) Equipment shall be provided to control accidental fires or arrangements shall be made with the local fire protection agency to immediately provide fire -fighting services when needed. — (c) Fires that occur at a sanitary landfill shall be reported to the division within 24 hours and a written notification shall be submitted within 15 days. —(d) The removal of solid waste from a sanitary landfill is prohibited unless the owner/operator approves and the removal is not performed on the working face. —(e) Barrels and d rums shall not be disposed of unless they are empty and perforated sufficiently to ensure that no liquid or hazard- ous waste is contained therein. WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS —(a) A site shall only accept those solid wastes which it is permitted to receive. — (b) No hazardous, liquid, or infectious waste shall be accepted or disposed of in a sanitary landfill except as may be approved by the division. —(c) Spoiled foods, ani mal carcasses, abattoir waste, hatchery waste, and other animal waste delivered to the disposal site shall be covered immediately. —(d) Asbestos waste that is packaged in accordance with 40 CFR 61,as amended through January 1, 1985, may be disposed of separate and apart from other solid wastes at the bottom of the working face or in an area not contiguous with other disposal areas, in either case, in virgin soil. Separate areas shall be clearly marked so that asbestos is not exposed by future land -disturbing activi- ties. The waste shall be covered immediately with soil in a manner that will not cause airborne conditions. (12) MISCELLANEOUS REQUIREMENTS — (a) Effective vector control measures shall be applied to control flies, rodents, and other insects or vermin when necessary. — (b) Appropriate methods such as fencing and diking shall be pro- vided within the area to confine solid waste subject to be blown by the wind. At the conclusion of each day of operation, all windblown material resulting from the operation shall be col- lected and returned'to the area by the owner or operator. Dear Mr. Dudley: The Solid Waste Management Section has received a request for characterization of the subject waste. Based upon the submitted information, the waste appears to be non -hazardous. The Solid Waste Management Section has no objection to the sanitary landfill disposal of this waste, if in accordance with the conditions listed below: 1. The owner/operator of the landfill approves the disposal. 2. The waste is dry and can be confined, compacted, and covered in accordance with the Solid Waste Management Rules (10 NCAC 10G). 3. Additionally, a submittal of the Waste Determination Form and supportive analytical data, is required on the anniversary of this approval. Failure to meet these conditions may result in revocation of this approval, and subsequently, an administrative penalty. The approval is subject to change if new regulations were to prohibit this practice. If the process which generates the waste changes or if the composition of the waste changes significantly, this approval is void and re-evaluation of the waste will be required prior to subsequent disposal. I am forwarding for your review the following information: 1. An analytical report on the phenol content of the scrap. This analysis was run on Durez scrap and it differs from the material specified in our original request only in that it is manufactured by Occidental Chemical Co. rathe. than Plastics Engineering Co. We use the two interchangeably. An MSDS for the Durez material is included. 2. A letter from Occidental Chemical Company regarding the phenol content in the molded scrap. This letter was originally prepared for another of their customers. They removed the other customer name before forwarding it to us. 3. An analysis of the metals in the scrap. We do not consider this scrap plastic to be hazardous material. Our experience and investigations of other industries that generate this waste indicates that ordinary landfill disposal is customarily done. Our situation is becoming extremely critical. We have accumulated 80-100 cubic yards of scrap since December while we have been trying to resolve the problem. The Federal Resource Conservation and Recovery Act (RCRA) defines a hazardous waste in 40 CFR 261 as a solid waste which exhibits the Characteristics of ignitability, corrosivity, reactivity or EP toxicity, or is included in the list in paragraphs 161.31, 261.32 and 261.33. The current phenolic products that we sell to you are composites of polymeric phenolic resin, cellilosic or mineral fillers, hexamine. colorants and lubricants. These composites do not exhibit the characteristics above nor are they liated as hazardous wastes. Therefore they are not subject to regulation as a hazardous waste under RCRA. However, please note that the EP toxicity characteristic is currently under- review and may be expanded by au a 'itionsl 38 chemicals. If phenol is included in this new list, then phenolic molding compound (non molded granular) may fall under the RC RA definition of a hazardous waste. As regard& to the molded product, tests Conducted on a 1/2" X 1/2" x 5" bar using the TCLP leachate test recommended by EPA shows a phenol concentration of 6-10 ppm. The proposed rule for the EP toxicity characteristic has phenol requirements less that 14.4 ppm.
