As discussed in our March 1, 2006 meeting, Altamont Environmental, Inc. (Altamont) is providing to you
correspondence and other information regarding the Jackson County landfill gas to energy project. The
following items are enclosed for your files:
• Landfill Gas Extraction Workplan — Phase I and letter, dated January 23, 2004
• Letter regarding Landfill Gas Extraction Workplan — Phase I, dated March 11, 2004
• Landfill Gas Extraction Workplan — Phase II and letter, dated December 30, 2004
• Status report letter to Mr. Ken Westmoreland, dated May 18, 2005
• LFG monitoring data, dated February 16, 2006
All but one of the conditions in the letter from the Division of Waste Management dated March 11, 2004
have been addressed in the letter from Altamont dated December 30, 2004. An asbuilt drawing of Phase I
and Phase II is included with the status report letter to Mr. Ken Westmoreland, dated May 18, 2005, and
should satisfy the remaining condition of the March 11, 2004 letter.
A letter regarding the Landfill Gas Extraction Workplan —Phase II from your office was not found. As
discussed in our meeting, please respond to this letter with a list of requested items that we may be able to
provide. Thank you for your help, and please contact our office if you have any questions.

Re: Phase II -Landfill Gas Extraction Plan, Jackson County MSWLF Facility,
Permit # 50-02, Jackson County
Dear Mr. Parker:
The Solid Waste Section (the Section) hereby approves the implementation of Phase II of the
Landfill Gas Extraction Plan for the referenced landfill facility.
The Section strongly encourages and supports gas -to -energy projects at municipal solid waste
landfill facilities (MSWLFs). However, it should be emphasized that from a regulatory perspective,
the primary purpose of a methane extraction or remediation system at a MSWLF is to prevent the
migration of methane gas. Rule .1626(4) of the solid waste management rules requires that
"owners and operators of all MSWLF units ensure that the concentration of methane gas
generated by the facility does not exceed 25 % of the lower explosive limit for methane in facility
structures and does not exceed the lower explosive limit for methane at the facility property
boundary."
In compliance with these rules, the owner or operator must take all necessary steps to ensure
protection of the human health and implement a remediation plan for the methane gas releases.
Based upon the performance of this system, the Section may require additional remedial activities
to ensure compliance with these rules.

Re: Permit for Closure, Jackson County Municipal Solid Waste Landfill
Permit # 50-02, Jackson County
Dear Mr. Parker:
The Solid Waste Section (the Section) has received and reviewed documentation submitted by Altamont
Environmental Inc, on behalf of Jackson County, regarding closure of the subject facility. Based upon
the certification report dated December 2002, the Section has determined that the unlined municipal
solid waste landfill (MS WLF) unit at the subject facility has been closed in accordance with the
applicable requirements and the approved closure plan. This determination may be rescinded should any
of the documentation prove to be inaccurate.
The MS WLF unit at the subject facility is considered closed subject to the post -closure conditions in the
permit. The owner/operator of the landfill unit, Jackson County, is responsible for compliance with
these conditions. Please note, that the 30-year post -closure period is effective starting December 2002,
the closure certification date as stated by the certifying engineer.
Rule .1627(c)(8) and Condition #5 of this permit requires that, following closure of the MS WLF unit,
the owner or operator record a notation on the deed to the landfill facility property, or some other
instrument that is normally examined during title search, and notify the Division that the notation has
been recorded and a copy has been placed in the operating record. The notation on the deed shall in
perpetuity notify any potential purchaser of the property that:
(a) The land has been used as a landfill facility; and
(b) Its use is restricted under the closure plan approved by the Division.

The attached certified copy of the Permit for Closure shall be recorded by the Register of Deeds and
indexed in the grantor index under the name of the land owner. The certified copy affixed with the
Register's seal and the date, book, and page number of the recording shall be returned to the Solid Waste
Section.
