Jim - Following is our action plan concerning deficiencies indicated in
the above report.
1. Landfill Elevations - Present elevations will be reflected in final
vertical expansion plan. This plan is awaiting off -site soils testing
as requested by the state.
3. Daily cover work will be improved as well as long term cover applied
in completed sections. Seeding is to begin week of 3/26.
4. Silt ponds to be cleaned in week of 3/26.
11. Soil tests indicate that this material meets state requirements for
landfill disposal. This information has been submitted to Bill Holcott.
He has advised us that he is 60 to 90 days behind in reviewing the
information.
Information in remarks - The area with the demolition material is to be
graded and capped with proper cover to eliminate leachate generation
problems in this area. We have been requested to solve this problem per
a letter from Suzanne Malloy and we feel that creating positive drainage
to the sediment basin is essential to stop the generation of leachate.
We will reflect this work in the vertical expansion plan but the leachate
must be stopped as soon as possible.

Re: Surface Water Monitoring at the Haywood County sanitary
landfill, (Permit 444-03).
Dear Mr. Rogers:
Section .0602 (Surface Water Monitoring) of The Solid Waste
Management Rules (10 NCAC 10G) states that "The division shall
require a solid waste management facility to provide such surface
water monitoring capability as the division determines to be
necessary to detect the effects of the facility on surface water in
the area." As a result of the focus on grourid-water monitoring in
recent years, surface water monitoring has been overlooked at many
solid waste management facilities.
The Solid Waste Section is now in the process of re-establishing
a surface water monitoring program at all sanitary landfills in North
Carolina. Surface water monitoring should include a sample taken
immediately upstream of the landfill facility as well as a sample
taken immediately downstream of the facility. Each significant
stream adjoining (or within) the landfill facility should be sampled.
All ground and surface water monitoring should be performed according
to the specifications in the "North Carolina Water Quality Monitoring
Guidance Document for Solid Waste Facilities".
Within the next 30 days, please submit to our office a surface
water monitoring plan. This plan should include a map of the
permitted landfill facility showing all streams within or adjoining
the landfill property. Proposed stream monitoring locations should
be indicated on the map with designations that can be correlated with
future sample analytical data (e.g. SW-1, SW-2, etc.). You should
also indicate which are upstream sampling locations, and which are
downstream locations. The streams should be sampled at the same time
and for the same parameters as the ground -water monitoring wells.
Please include the surface water data along with the ground -water
analysis for all future water quality samplings.

Dear Mr. McCracken:
David Lilley of the NC Superfundd Section spoke with you
on June 7 to notify you that the EPA Field Investigation Team
(FIT) will conduct a screening site site investigation of the
subject site located in Haywood County, NC. The investigation
will be conducted on June 25-29, 1990 by John Jenkins of NUS
Corporation.
The purpose of the investigation is to determine if the site
poses a hazard to public health or the environment because of
releases of contaminants to soil, surface water, groundwater, or
air. The investigation team will take samples on and around the
site to determine if a hazardous condition exists. Additionally,
they will locate all nearby water supplies (surface and
groundwater, comnnuzity and private) and any close sensitive
environments, schools, and day care centers.
This investigation is not an emergency situation but is a
normal step in the evaluation of all uncontrolled and unregulated
potential hazardous waste sites in North -Carolina. You may want
to have your representative meet the investigation team at the
site. If so, please contact John Jenkins at 1-800-888-7710 and
he will coordinate a meeting. I am enclosing background data on
the site for your information.

Enclosed please find the Preliminary Assessment report for the subject
site. This priority is based on review of available data.
The Haywood County Landfill is located on Francis Farm Road (SR 1802)
approximately one -quarter mile northeast of Waynesville, NC. Waynesville, is
in central Haywood County in western North Carolina. The land is privately
owned but the landfill is operated by the Haywood County Board of
Commissioners. The county has operated the landfill since 1973 and it is
currently an active, permitted solid waste landfill.
Dayco Corporation of Waynesville, NC disposed of liquid waste from its
rubber manufacturing process at the landfill from 1975 to 1983. This waste
included latex cord dip; rubber cement containing toluene; waste lube
oil/carbon black mixture; and iron phosphate metal cleaning solution. These
wastes were reportedly disposed in drums or containers. The total volume
disposed is unknown. The landfill is unlined and is known to have had
problems with water ponding on top of it.
Currently, there have been no known observed releases from the
landfill. There are 3 monitoring wells on site which thus far have not
indicated groundwater contamination. The depth of these wells in relation to
the depth of waste disposal, however, has not been determined. Approximately
2,000 people within 3 miles depend on private wells for water supply. The
nearest well is reportedly less than 2,000 feet north of the site at a trailer
park. Surface water runoff drains to Ratcliffe Cove Branch and ultimately
Lake Junaluska. The only known surface water usage within 3 miles is for
fishing and boating.

Due to the long-term disposal of liquid waste at the landfill, a medium
priority for inspection is recommended.
On September 3, 1987 this Preliminary Assessment was reviewed by CERCLA
Unit personnel; and by the following representatives from the North Carolina
Department of Natural Resources and Community Development, Division of
Environmental Management: Glenn Ross, Air Quality Section; and Vince
Schneider, Water Quality Section.

of Waynesville was reportedly disposed here 1975-1983. This waste is described as
latex cord dip; rubber cement containing toluene; waste lube oil/carbon black

In response to your letter dated June 27, 1990 concerning the
Haywood County Landfill, I would like to offer the following reply.
At the time of your inspection, the County was removing stockpiled
dirt from the buffer zone as the first step to building a garage
building in that area. I have discussed the possibility of such
a building with Mr. Coffey.
It is my understanding that the Solid Waste Section is encouraging
the use of the buffer zone for such purposes and we would hope that
you will be a help rather than a hindrance to us in this matter.

I am in receipt of your letter dated July 5, 1990, responding to the Notice of
Violation I issued to Haywood County Landfill on June 27, 1990.
Concerning you comments about the buffer area, I would reiterate that condition #2
of the May 23, 1990, letter to you from Jim Coffey states, "The buffer area must
be maintained undisturbed. All soil requirements can be met by using off -site
borrow source." In addition, this condition is -also referred to in the amendment
to Haywood County Landfill's permit issued July 5, 1990. Item #1(a) under the
Construction and Operation Section states, "This permit includes a 5.192 acre
tract which is to be used exclusively as a buffer area. No waste shall be placed
in this area, and the area shall remain undisturbed."
Based on my observations, Haywood County was removing an embankment of natural
soil rather than stockpiled dirt from the buffer zone at the time of my
inspection. Soil had, in fact, been removed from around the monitoring well
casing some 2 to 3 feet below ground level. I had the landfill employees replace
the soil around the well casing during my visit.
It is my intention to work in a cooperative manner with Haywood County in applying
the rules and conditions as specified by the Division of Solid Waste. If you
desire, I will be glad to meet with you to discuss this matter.

RE: NOTICE OF VIOLATION
Dear Mr. Rogers:
Pursuant to NCGS 130A-22(a) and to NCAC 10G, I conducted an inspection on
June 21, 1990 of the Haywood County Landfill, Permit No. 44-03, located in Haywood
County on State Road 1802 near Waynesville, North Carolina. This inspection found
the Haywood County Landfill to be in violation of certain requirements contained
in the North Carolina Solid Waste Management Rules, codified at 10 NCAC IOG
specifically:
1. 10 NCAC 1OG .0505(1)(a) requires that construction plans shall be approved
and followed. The Haywood County Landfill was operating in violation of 10
NCAC 10G .0505(1)(a) in condition #2 of the letter written to Gary D. McKay
from the Solid Wasted Management Section dated May 23, 1990, was not being
adhered to. Condition #2 states that the buffer area must be maintained
undisturbed and that all solid requirements are to be met by using off site
borrow source. Daily cover was being taken from the buffer zone at the time
of my inspection.
2. 10 NCAC IOG .0505(3)(a) requires that solid waste shall be covered after each
day of operation with a compacted layer of at least six inches of suitable
cover. The Haywood County Landfill was operating in violation of 10 NCAC 1001
.0505(3)(a) in that waste had not covered after each day of operation with a
compacted layer of at least six inches of suitable cover.

COMPLIANCE SCHEDULE
Based upon the foregoing, the County of Haywood is hereby ordered to take the
following actions by July 31, 1990 to correct all violations as stated in this
Notice of Violation, and otherwise be in compliance with the North Carolina Solid
Waste Management Rules, codified at 10 NCAC 10G:
1. Comply with 10 NCAC 10G .0505(1)(a) by ensuring that the.buffer area at the
landfill remains undisturbed.
2. Comply with 10 NCAC 10G .0505(3)(a) by covering all solid waste after each
day of operation with a compacted layer of at least six inches of suitable
cover.
If the requirements above are not met on a continuing basis, enforcement
action may be taken. Remedies include assessment of Administrative Penalties of
up to $5000.00 (five thousand dollars) per day per violation, dating from the
compliance date in this order, and/or injunctive relief, pursuant to G.S. 130A-22
or G.S. 130A-18.

Re: Surface Water Monitoring at the Haywood County sanitary
landfill, (Permit 444-03).
Dear Mr. Rogers:
Section .0602 (Surface Water Monitoring) of The Solid Waste
Management Rules (10 NCAC 10G) states that "The division shall
require a solid waste management facility to provide such surface
water monitoring capability as the division determines to be
necessary to detect the effects of the facility on surface water in
the area." As a result of the focus on ground -water monitoring in
recent years, surface water monitoring has been overlooked at many
solid waste management facilities.
The Solid Waste Section is now in the process of re-establishing
a surface water monitoring program at all sanitary landfills in North
Carolina. Surface water monitoring should include a sample taken
immediately upstream of the landfill facility as well as a sample
taken immediately downstream of the facility. Each significant
stream adjoining (or within) the landfill facility should be sampled.
All ground and surface water monitoring should be performed according
to the specifications in the "North Carolina Water Quality Monitoring
Guidance Document for Solid Waste Facilities".
Within the next 30 days, please submit to our office a surface
water monitoring plan. This plan should include a map of the
permitted landfill facility showing all streams within or adjoining
the landfill property. Proposed stream monitoring locations should
be indicated on the map with designations that can be correlated with
future sample analytical data (e.g. SW-1, SW-2, etc.). You should
also indicate which are upstream sampling locations, and which are
downstream locations. The streams should be sampled at the same time
and for the same parameters as the ground -water monitoring wells.
Please include the surface water data along with the ground -water
analysis for all future water quality samplings.

(4) EROSION CONTROL REQUIREMENTS
— (a) Adequate erosion control measures shall be practiced to pre-
vent silt from leaving the site.
— (b) Adequate erosion control measures shall be practiced to pre-
vent excessive on -site erosion.
(5) DRAINAGE CONTROL REQUIREMENTS
— (a) Surface water shall be diverted from the operational area.
— (b) Surface water shall not be impounded over or in waste.
(c) Completed areas shall be adequately sloped to allow surface
water runoff in a controlled manner.
(6) VEGETATION REQUIREMENTS
(a) Within six months after final termination of disposal operations
at the site on a major part thereof or upon revocation of a
permit, the area shall be stabilized with native grasses.
_(b) Temporary seeding will be utilized as necessary to stabilize the
site.
(7) WATER PROTECTION REQUIREMENTS
— (a) The separation distance of four (4) feet between waste and
water table shall be maintained unless otherwise specified by
the division in the permit.

discharge. An NPDES permit may be required prior to the dis-

division, to prevent unauthorized entry.
— (b) An attendant shall be on duty at the site at all times while it is
open for public use to ensure compliance with operational
requirements.
— (c) The access road to the site shall be of all-weather construction
and maintained in good condition.
— (d) Dust control measures shall be implemented where necessary.

(9) SIGN REQUIREMENTS
— (a) Signs providing information on dumping procedures, the hours
during which the site is open for public use, the permit number
and other pertinent information shall be posted at the site
entrance.
— (b) Signs shall be posted stating that no hazardous or liquid waste
can be received without written permission from the division.
(c) Traffic signs or markers shall be provided as necessary to pro-
mote an orderly traffic pattern to and from the discharge area
and to maintain efficient operating conditions.
(10) SAFETY REQUIREMENTS
— (a) Open burning of solid waste is prohibited.
(b) Equipment shall be provided to control accidental fires or
arrangements shall be made with the local fire protection
agency to immediately provide fire -fighting services when
needed.
— (c) Fires that occur at a sanitary landfill shall be reported to the
division within 24 hours and a written notification shall be
submitted within 15 days.
— (d) The removal of solid waste from a sanitary landfill is prohibited
unless the owner/operator approves and the removal is not
performed on the working face.
— (e) Barrels and drums shall not be disposed of unless they are empty
and perforated sufficiently to ensure that no liquid or hazard-
ous waste is contained therein.
(11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS
(a) A site shall only accept those solid wastes which it is permitted to
receive.
— (b) No hazardous, liquid, or infectious waste shall be accepted or
disposed of in a sanitary landfill except as may be approved by
the division.
(c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste,
and other animal waste delivered to the disposal site shall be
covered immediately.
(d) Asbestos waste that is packaged in accordance with 40 CFR 61, as
amended through January 1,1985, may be disposed of separate
and apart from other solid wastes at the bottom of the working
face or in an area not contiguous with other disposal areas, in
either case, in virgin soil. Separate areas shall be clearly marked
so that asbestos is not exposed by future land -disturbing activi-
ties. The waste shall be covered immediately with soil in a
manner that will not cause airborne conditions. Copies of 40
CFR 61 may be obtained and inspected at the Solid and Hazard-
ous Waste Management Branch, Division of Health Services,
P. O. Box 2091, Raleigh, NC, 27602.
(12) MISCELLANEOUS REQUIREMENTS
— (a) Effective vector control measures shall be applied to control
flies, rodents, and other insects or vermin when necessary.
— (b) Appropriate methods such as fencing and diking shall be pro-
vided within the area to confine solid waste subject to be blown
by the wind. At the conclusion of each day of operation, all
windblown material resulting from the operation shall be col-
lected and returned to the area by the owner or operator.

Management Division has no objection to the sanitary landfill
disposal of this waste, if in accordance with the conditions listed
below:
1. The owner/operator of the landfill approves the disposal.

The Solid Waste Management Division has received a request for
characterization of the subject waste. Based upon the submitted
information, the waste appears to be non -hazardous. The Solid Waste
Management Division has no objection to the sanitary landfill
disposal of this waste, if in accordance with the conditions listed
below:
1. The owner/operator of the landfill approves the disposal.
2. The waste contains no -free liquids.
3. Under no circumstances will oily waste be disposed of by
mixing with routine waste or buried below ground.
4. The waste shall be land applied in an area of the landfill
which has received two feet of earthen cover or in a virgin
area.
5. The waste shall be applied in a thin layer not to exceed
six inches in depth.
6. Surface water shall be diverted from the area of
application.
7. The area shall be seeded to control erosion if necessary.
8. Approval for sanitary landfill disposal is explicitly
limited to a "one-time" basis. Further approval by this
office will require submittal of a new Waste Determination
form, and (i.f applicable), new analytical data.

PROCEDURE AND CRITERIA FOR WASTE DETERMINATION
This procedure will be used by the Solid Waste Management
Division to determine whether a waste is (1) hazardous as defined by
10 NCAC 10F, and (2) suitable for disposal at a solid waste
management facility.
The types of wastes that will be evaluated by this procedure are
primarily, but not exclusively, industrial and commercial wastes and
sludges, and Publicly Owned Treatment Works Sludges.
The Solid Waste Management Division reserves the right to
request additional information or waive some of the requirements
based on the type of waste if it deems necessary. The Division may
also require some wastes to be treated or altered to render the
wastes environmentally immobile prior to disposal at a sanitary
landfill. Wastes disposed at sanitary landfills must be non -liquid
which can be properly managed in accordance with the "Solid Waste
Management Rules". APPROVAL TO DISPOSE OF THE WASTE SHALL ALSO BE
OBTAINS FROM THE OWNER OR OPERATOR OF THE LANDFILL PRIOR TO
DISPOSAL.

RE: Completeness Review - Wade County Landfill, Amendment to Permit

Dear Mac:
Pursuant to our discussion and site visit on February 20, 1990
at the referenced landfill, the following comments must be addressed
to continue the review process:
1. The area which we discussed as a possible "demolition" site
is not recommended for this usage. The area must be
delineated on the plans as a buffer zone. This area may be
used as a borrow area as long as a proper sediment and
erosion control plan is submitted and the area is stabilized
and maintained as a buffer zone after usage.
2. Soil samples and test results must be submitted for
off -site borrow material. The on -site sample is sufficient
(however, it is general procedure that soil borings are
necessary to determine water level and presence of
bedrock).
i. Dirt calculations for on and off site usage of soil
needs to be submitted.
ii. A plan to utilize the most appropriate soil for final
cover should be addressed (i.e., stockpiling).
3. As per our discussion, a sediment and erosion control plan
(calculations and design of basins, etc) must be submitted
to our office. We shall contact the appropriate agency in
Haywood County for approval. Their commnents will be
addressed in the solid waste permit conditions.
i. Calculations for depth and width of drainage ditches
must substantiate "appropriateness" of size related
to needs of drainage, soil conditions, erosion

control, carrying capacity, and site conditions. These
ditches can work properly; however, proper design and
construction is imperative.
4. The access road to the newly installed MW-3A needs to be
stabilized. As leachate is escaping from the embankment,
the toe of the slope needs to be extended and stabilized.
The road above the well is sufficient as long as the
monitoring well is accessible by foot from the road.
5. Usage of tire walls is not recommended as they are not a
suitably stable material.
6. Calculations for life expectancy need to be submitted.
7. The buffer zone (50') must be delineated on plan.
8. Monitoring well test results need to be submitted to Bobby
Lutfy, North Carolina Hydrogeologist, for evaluation.
9. Stationing must be shown on plans.
These comments are intended to expedite the review of the
application, and in no way do they restrict the Section's right to
request additional information following the technical review
process.
If complete plans, with all required information, are not
submitted within 90 days, this application will be returned to the
applicant as "incomplete." Likewise, the applicant will be notified
when a complete application has been received.

RE: Receipt of a Complete Application - Haywood County Landfill,
Amendment to Permit # 44-03
Dear Mr. McKay:
On May 17, 1990, the Solid Waste Section received a complete
application for the referenced project.
The applicant should be aware that the technical review of the
project is contingent upon the following conditions:
(1) Any modifications as required by the Asheville Regional
Office of the Land Quality Section must be incorporated
into the plans. If you have any questions, contact
Richard Moore at (704)251-6208.
(2) The buffer area must be maintained undisturbed. All soil
requirements can be met by using the off -site borrow
source.
The Solid Waste Section, pursuant to your submittal of May 16,
1990 and subsequent completeness reviews, realizes the limited
resources which the County is working with. Due to the County"s
impending Notice of Violation without the receipt of a complete
application, the Section acknowledges the receipt of a complete
application with the above listed stipulations.
The purpose of permitting Vertical Expansions is to aid local
governments in upgrading existing facility conditions while allowing
time for the County to submit an application for a high-tech
landfill permit.
We are concerned about the quality of engineering work which
the county has based their Vertical Expansion upon. The County
should be aware of the fact that calculations for life and soil
requirements under the proposed expansion may not be indicative of
actual conditions. The permit when issued shall only be issued for
a time period of two years and all operational requirements must be
followed.
Haywood County is advised to use all possible resources to
submit a quality application for a high-tech landfill as to avoid
similar problems in the future.

Dear Mr. Rogers:
The enclosed Amendment to Permit for the referenced facility is
approved in accordance with G.S. 130A-294, subject to the conditions
of Permit.
This permit is for the property defined in the attached
descriptions and amends the facility description to include the 5.192
acre buffer area, which is to be left undisturbed. The Conditions of
Permit supersede any conditions issued heretofore.
Please note General Condition No. 1 which states that
modifications of this permit may be required in accordance with
upcoming revisions to the Solid Waste Management Rules and revised
EPA Subtitle D criteria. Modifications to the construction and
operational plans or even closure of this landfill may be required
before the permit period expires. This amendment provides a 24 month
planning period, which the County should use to develop a
comprehensive solid waste management plan.
Within 60 days of the issuance of the permit, on a mutually
agreeable date, all parties concerned shall have a walk-thru of the
facility to evaluate compliance with the permit.

SANITARY LANDFILL
CONDITIONS OF PERMIT:
GENERAL
1. This permit is issued for a period not to exceed two years from
the date of issuance. Upcoming amendments to the Solid Waste
Management Rules, in accordance with EPA Subtitle D revisions,
may necessitate the modification of the construction and
operation plans or even closure of this facility prior to this
date.
2. This permit shall not be effective unless the certified copy is
filed in the Register of Deeds Office, in the grantor index
under the name of the owner of the land in the county or
counties in which the land is located. After recordation, the
certified copy shall be returned to the Solid Waste Section and
shall have indicated on it the page and book number, date of
recordation, and Registrar's seal.
3. When this property is sold, leased, conveyed or transferred, the
deed or other instrument or transfer shall contain in the
description section in no smaller type than that used in the
body of the deed or instrument a statement that the property has
been used as a sanitary landfill.
4. This solid waste disposal site is permitted to receive "solid
waste" generated within the territorial boundaries of Haywood
County, and as defined in 10 NCAC 10G, .0101(36), except that
hazardous waste and liquid waste are prohibited from disposal at
this site.
CONSTRUCTION AND OPERATION
1. This permit is for construction according to the attached plans
with the following conditions:

a. This permit includes a 5.192 acre tract which is to be used
exclusively as a buffer area. No waste shall be placed in
this area, and the area shall remain undisturbed.
b. The usage of tire walls shall not be allowed.
Additional conditions and revisions of the approved plans shall
be approved by the North Carolina Solid Waste Management
Division.
2. All sedimentation/erosion control activities will be conducted
in accordance with the Sedimentation Control Act (15 NCAC 4).
3. This facility shall conform to operating procedures in Rule
.0505 of the Solid Waste Management Rules, and the conditions
specified herein.
4. A closure and post -closure plan must be submitted for approval
at least 90 days prior to closure or partial closure. The plan
must include all steps and measures necessary to close and
maintain the facility in accordance with all rules in effect at
that time. The final cover will be evaluated based upon
performance and upgraded if necessary.
MONITORING REQUIREMENTS
1. Haywood County shall sample monitoring wells and surface waters
annually as per the N.C. Water Quality Monitoring Guidance
Document.
2. Ground water quality at this facility is subject to the
classification and remedial action provisions referenced in Rule
.0503(2)(d) of 10 NCAC 10G.
