NOTICE OF VIOLATION(S) (citation and explanation):
1. 15A NCAC 13B .0505(4)(a) requires "Adequate erosion control measures shall be practiced to prevent
silt from leaving the site."
International Automotive Components is in violation of 15A NCAC 13B .0505(4)(a) by failing to
maintain the berm at the north west corner of the landfill which has been breached in one place.
(See photo #2 below.)
To correct this violation and be in compliance with 15A NCAC 13B .0505(4)(a), within 30 days from
receipt of this notice, fill, compact and stabilized the breach in the berm at the north west corner of the
landfill.
2. 15A NCAC 13B .0505(4)(b) requires: "Adequate erosion control measures shall be practiced to prevent
excessive on -site erosion."
International Automotive Components is in violation of 15A NCAC 13B .0505(4)(b) by failing to
prevent excessive on -site erosion by failing to stabilized the site with vegetation. (See photo #3
below.)
To correct these violations and be in compliance with 15A NCAC 13B .0505(4)(a), within 30 days from
receipt of this notice, stabilized the landfill with native grasses or other erosion control devices (e.g.,
Erosion control blankets or mats)

3. 15A NCAC 13B .0505(3)(b) requires: "Areas which will not have additional wastes placed on them for 12
months or more, but where final termination of disposal operations has not occurred, shall be covered with
a minimum of one foot of intermediate cover."
International Automotive Components is in violation of 15A NCAC 13B .0505(3)(b) by failing to
prevent provide and maintain one foot of intermediate cover over waste. (See photo #4 below.)
To correct these violations and be in compliance with 15A NCAC 13B. 0505(4)(a), within 30 days fi-on:
receipt of this notice, ensure that all waste has at least one foot of intermediate cover.
You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for
each violation of the Solid Waste Statute or Regulations. If the violation(s) noted here continue, you may be subject to enforcement
actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
STATUS OF PAST NOTED VIOLATIONS (List all noted last audit):
Violations of 15A NCAC 13B .0505(4)(a): The top of the berm on the western edge of the landfill
was breached in two places - in the central part of the berm and at the extreme SW comer. The
breach in the central portion of the berm has been repaired. The breach in the SW corner has
occurred again. (See photos #1 and #2 below.)

AREAS OF CONCERN AND COMMENTS:
1. A search of the NC Secretary of State's corporation's web page confirms that International Automotive
Components (IAC) is now registered to do business in NC.
2. The permit that expired on 9/19/07 was issued to the Collins and Aikman Products Company. This permit is
not transferable. (See Item (6) of Part I.• Industrial Landfill Facility General Conditions of the December 19,
2002 Permit.) Please complete the permitting process in accordance with 15A NCAC 13B .0200.
3. The limits of waste have been staked with 3 to 4-foot steel rods that are flagged with surveyor's tape. Jack
Davis (IAC Plant Engineer —retired) placed the stakes approximately 100 to 150-feet apart. (See photo #5
below.)
The property lines of the landfill must also be staked out with permanent markers. (See the attached May 29, 2009
Memorandum "Permanent Edge -of -Waste Markers at Construction and Demolition Debris Landfills, Industrial Solid
Waste Landfills and Municipal Solid Waste Landfills".)

1. A "new" sediment basin was put in place at the head of the access road to in an effort to control on -site
erosion. (See photo #6 above.)
2. Heavy rains this past year have badly eroded the access road. New sediment traps at the top of the access road
were installed. (See photos #7 and #8 below.) The road needs to be repaired.

3. Due recent snow and ice storms, the access road was blocked in multiple places by downed trees. (See photo
#9 below.) The access road needs to be cleared so that it is passable to vehicular traffic.

4. Due to the ice and snow conditions on 1115110, the groundwater monitoring wells were not located. On
January 27, 2010, Bill Wagner returned to the site to locate the two groundwater monitoring wells. The up -
gradient well MW-1 could not be located. The down -gradient well MW was located on the north side of the
access road, that skirts the southern side of the site. (See Photo #1 lbelow.) The well is approximately 75-
yards south of where the access road crosses over an un-named stream that flows west from the landfill and
empties into Brevard Creek. MW-2 was locked but it did not have the required "well contractor identification
plate" as required by 15A NCAC 2C .0107(i)(2).
5. The last groundwater and surface water sampling event that was submitted to the Division occurred on April
28, 2008. Four groundwater wells (MW 1, MW-2, MW-3 and MW-4) and two surface water locations (SW-1
and SW-2) were sampled. Please locate and mark all of the groundwater monitoring wells with

permanent identification plates, and flag or otherwise mark the approximate locations were the surface
water samples were collected.

• Approved to use "scrap bales in lieu of cover material to facilitate closing out the site" by the
