I have reviewed the information which you have 'forwarded to me on the Haywood
County Landfill Access Road. The soil sample contains relatively high levels
of polynuclear aromatic (PNAs) compounds and phthalates. A number of the PNAs
are considered to be suspect carcinogens; however, degradation to less complex
molecules would be expected if this is a surface soil sample. In fact, William
Paige has done considerable research on the fate of PNAs. The levels of
phthalates while high, are not considered to pose significant risk because the
phthalates found, which are used as plasticizer, are not considered to be
carcinogenic. It should be noted that PNAs are coal tar -derivatives which
would probably be found in asphalt at very high concentrations. Since PNAs are
not particularly volatile and because degradation would be expected, I do not
believe that the health risks are unacceptably high. However, it should be
emphasized that this conclusion is based on very limited data.
Finally, the level of phenol 18 mg/1 is well above current water quality
standards of 1 ug/l, I would expect that the water has a strong taste and
odor. Based solely on these considerations, this water would not be suitable
for drinking purposes.

Solid and Hazardous Waste (Review 7/87)
Purpose: Enforcement and compliance with the N. C. Solid and Hazardous Waste Management Rules.
Preparation A sample analyses request form (DHS 3191) must be completed for each type of evaluation requested (e.g.,
inorganic, organic, microbiology, radiochemistry). For sampling conditions which require more than one (1)
container (i.e., ground or surface water from landfills) a sample label must be affixed to one of the containers. The
collector must then write the site and sample number on the duplicate.
Do not submit an analysis request sheet with no parameters indicated.
Equivalent measurements:
ppm = µg/ml = mg/1 = µg/g = mg/kg
ppb = µg/l = µg/1000g = µg/kg
DEFINITIONS/INSTRUCTIONS
Site Number — A twelve -digit site/location identifier, assigned only by the district field representative.
Field Sample Number — A six -digit sample identifier which is pre-printed on the sample label.
Name of Site — Name of landfill, facility, etc.
Site Location — Address, street number, state road, etc.
Collected By — Name and ID of sample collector.
Date and Time Collected — Self-explanatory.
Environmental — A sample of a naturally occurring substance such as groundwater, surface water or soils which
may be contaminated.
Concentrate — A sample of a waste, including but not limited to, sludges, resins, treatment effluents or drummed
wastes.
Comments — Lists details regarding sample or sample point, including but limited to, phase separation, and/or
odgrs.
Inorganic Chemistry — Check (✓) the desired parameters to be analyzed. Extractables are only performed on a
solid or semi -solid. For routine landfill samples, check all parameters in the second and third columns.
Organic Chemistry — Check (✓) the desired parameter to be analyzed. If not listed, enter the name in the space
provided.
Microbiology and Radiochemistry — The Raleigh office should be consulted prior to sampling for either
of these.

RE: NOTICE OF VIOLATION

Pursuant to NCGS 130A-22(a) and to NCAC 10G, inspections were conducted on
October 11, 1988 and November 28, 1988 of the Haywood County Sanitary Landfill,
Permit No. 44-03, located in Haywood County on S.R. 1802 near Waynesville, North
Carolina. The inspection by James E. Patterson, Waste Management Specialist,
Solid Waste Management Branch, found the Haywood County Sanitary Landfill to be
in violation of certain requirements contained in the North Carolina Solid Waste
Management Rules, codified at 10 NCAC 10G specifically:
1. 10 NCAC 1OG .0505(3)(a) requires that solid waste shall be covered after
each day of operation with a compacted layer of at least six inches of
suitable cover. The Haywood County Landfill was operating in violation of
10 NCAC 10G .0505(3)(a) at the time of James E. Patterson's inspections on
October 11, 1988 and November 28, 1988 in that solid waste was not being
covered after each day of operation with a compacted layer of at least six
inches of suitable cover.
2. 10 NCAC 10G .0505(5)(b) requires that surface water shall not be impounded
over or in waste. The Haywood County Landfill was operating in violation of
10 NCAC 1OG .0505(5)(b) at the time of James E. Patterson's inspections on
October 11, 1988 and November 28, 1988 in that surface water was being
impounded over waste.
3. 10 NCAC 10G .0505(5)(c) requires that completed areas shall be adequately
sloped to allow surface water runoff in a controlled manner. The Haywood
County Landfill was operating in violation of 10 NCAC 10G .0505(5)(c) at the
time of James E. Patterson's inspections on October 11, 1988 and November
28, 1988 in that completed areas were not adequately sloped to allow surface
water runoff in a controlled manner.

Based upon the foregoing, the County of Haywood is hereby ordered to take
the following actions by January 15, 1989 to correct all violations as stated in
this Notice of Violation, and otherwise be in compliance with the North Carolina
Solid Waste Management Rules, codified at 10 NCAC 1OG:
1. Comply with 10 NCAC 106 .0505(3)(a) by covering all solid waste after each
day of operation with a compacted layer of six inches of suitable cover.
2. Comply with 10 NCAC 1OG .0505(5)(b) by sloping or filling low areas so that
surface water will not impound over waste.
3. Comply with 10 NCAC 1OG .OS05(5)(c) by insuring that completed areas are
sloped so.as_to allow surface water runoff in a controlled manner.
Pursuant to N.C.G.S. 130A-22(a) and 10 NCAC 1OG Section .0701-.0707, an
administrative penalty of up to $500.00 per day may be assessed for violations of
the Solid Waste Law or Regulations.

(a) Surface water shall be diverted from the operational area.
(b) Surface water shall not be impounded over or in waste.

water runoff in a controlled manner.
(6) VEGETATION REQUIREMENTS
— (a) Within six months after final termination of disposal operations
at the site on a major part thereof or upon revocation of a
permit, the area shall be stabilized with native grasses.
— (b) Temporary seeding will be utilized as necessary to stabilize the
site.
(7) WATER PROTECTION REQUIREMENTS
— (a) The separation distance of four (4) feet between waste and
water table shall be maintained unless otherwise specified by
the division in the permit.

(c) Leachate shall be contained on site or properly treated prior to
discharge. An NPDES permit may be required prior to the dis-
charge of leachate to surface waters.
(8) ACCESS AND SECURITY REQUIREMENTS
(a) The site shall be adequately secured by means of gates, chains,
berms, fences, and other security measures approved by the
division, to prevent unauthorized entry.

open for public use to ensure compliance with operational
requirements.
(c) The access road to the site shall be of all-weather construction

and other animal waste delivered to the disposal site shall be

— (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as
amended through January 1,1985, may be disposed of separate
and apart from other solid wastes at the bottom of the working
face or in an area not contiguous with other disposal areas, in
either case, in virgin soil. Separate areas shall be clearly marked
so that asbestos is not exposed by future land -disturbing activi-
ties. The waste shall be covered immediately with soil in a
manner that will not cause airborne conditions. Copies of 40
CFR 61 may be obtained and inspected at the Solid and Hazard-
ous Waste Management Branch, Division of Health Services,

lected and returned to the area by the owner or operator.

(a) .Adequate erosion control measures shall be practiced to pre-
vent silt from leaving the site.

vent excessive on -site erosion.
(5) DRAINAGE CONTROL REQUIREMENTS
— (a) Surface water shall be diverted from the operational area.
(b) Surface water shall not be impounded over or in waste.
_ (c) Completed areas shall be adequately sloped to allow surface
water runoff in a controlled manner.
(6) VEGETATION REQUIREMENTS
— (a) Within six months after final termination of disposal operations
at the site on a major part thereof or upon revocation of a
permit, the area shall be stabilized with native grasses.
— (b) Temporary seeding will be utilized as necessary to stabilize the
site.
(7) WATER PROTECTION REQUIREMENTS
(a) The separation distance of four (4) feet between waste and
water table shall be maintained unless otherwise specified by
the division in the permit.
(b) Solid waste shall not be disposed of in water.
(c) Leachate shall be contained on site or properly treated prior to
discharge. An NPDES permit may be required prior to the dis-
charge of leachate to surface waters.
(8) ACCESS AND SECURITY REQUIREMENTS
(a) The site shall be adequately secured by means of gates, chains,
berms, fences, and other security measures approved by the
division, to prevent unauthorized entry.
— (b) An attendant shall be on duty at the site at all times while it is
open for public use to ensure compliance with operational
requirements.
(c) The access road to the site shall be of all-weather construction
and maintained in good condition.
— (d) Dust control measures shall be implemented where necessary.

during which the site is open for public use, the permit number
and other pertinent information shall be posted at the site

mote an orderly traffic pattern to and from the discharge area
and to maintain efficient operating conditions.

— (a) Open burning of solid waste is prohibited.
(b) Equipment shall be provided to control accidental fires or
arrangements shall be made with the local fire protection
agency to immediately provide fire -fighting services when
needed.
—(c) Fires that occur at a sanitary landfill shall be reported to the
division within 24 hours and a written notification shall be
submitted within 15 days.
— (d) The removal of solid waste from a sanitary landfill is prohibited
unless the owner/operator approves and the removal is not
performed on the working face.
(e) Barrels and drums shall not be disposed of unless they are empty
and perforated sufficiently to ensure that no liquid or hazard-
ous waste is contained therein.
(11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS
— (a) A site shall only accept those solid wastes which it is permitted to
receive.
— (b) No hazardous, liquid, or infectious waste shall be accepted or
disposed of in a sanitary landfill except as may be approved by
the division.
— (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste,
and other animal waste delivered to the disposal site shall be
covered immediately.
— (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as
amended through January 1,1985, may be disposed of separate
and apart from other solid wastes at the bottom of the working
face or in an area not contiguous with other disposal areas, in
either case, in virgin soil. Separate areas shall be clearly marked
so that asbestos is not exposed by future land -disturbing activi-
ties. The waste shall be covered immediately with soil in a
manner that will not cause airborne conditions. Copies of 40
CFR 61 may be obtained and inspected at the Solid and Hazard-
ous Waste Management Branch, Division of Health Services,
P. O. Box 2091, Raleigh, NC, 27602.
(12) MISCELLANEOUS REQUIREMENTS
— (a) Effective vector control measures shall be applied to control
flies, rodents, and other insects or vermin when necessary.
— (b) Appropriate methods such as fencing and diking shall be pro-
vided within the area to confine solid waste subject to be blown
by the wind. At the conclusion of each day of operation, all
windblown material resulting from the operation shall be col-
lected and returned to the area by the owner or operator.

Dear Mr. Rogers:
The Branch has completed its review of the proposed revisions to the
construction plans for the referenced facility.
The Branch can not approve the proposed design for the following reasons:
The run-on surface water is directed towards the middle of the
landfill across solid waste and then through solid waste via -
corrugatec—metal pipe. This is extremely poor design and
encourages the infiltration of rainwater and creates the situation
in which the CMP will eventually leak due to corrosion or
subsidence and surface water will "saturate" the solid waste.
Also, it is impractical, if not impossible, to maintain such a
system following closure.
Therefore, the Branch requires submittal of the following information:
An accurate, up-to-date topographic map indicating present
elevations of filled areas.
A revised construction plan including; (1) the removal of the
present drainage system (eaten basin, CMP etc.) or totally filling
with cements, (2) design plan for tine diversion of run-on surface
water around solid waste fill area and"(3) a "domed" final contour
design Jil sting rainwater off solid waste with adequate erosion
and sedimentation controls to prevent erosion.
As early as Marcn 31, 1987, the Branch has encouraged the county to
redesign the landfill to improve drainage and also increase the disposal
capacity of the site. The Branch now requires that this redesign be
submitted, even if the county does not intend to expand the existing facility.
