The violation noted in the audit dated 01/10/03, specifically 15A North Carolina Administrative Code 13B
.1626(1)(b)(i) has been addressed. Bobby Cogdill has written a letter dated January 17, 2003, listing additional
procedures Haywood County will take to make sure commercial hazardous waste is excluded from landfill disposal.

Subject: Hazardous Waste Procedures
Dear Mr. Patterson:
This letter is in response to Haywood County's recent Notice of Violation
concerning hazardous waste received from Ken Wilson Ford. After
reviewing this complaint it was discovered that we had received some
hazardous material in the form of distilled cakes from Ken Wilson Ford.
As you are aware, Haywood County has a daily screening program for
incoming trash and we do not accept hazardous waste pursuant to N.C. Solid
Waste Regulations. However, the waste received from Ken Wilson Ford
was mixed with regular trash and in the form that it was received it would be
very difficult to determine by a visual screening that this was a hazardous
waste.
The following procedures have been initiated to strengthen the County's
program to exclude hazardous waste from landfill disposal:
1. Continue daily screening.
2. Educate employees to look for and to question any suspicious trash.
3. Talk with all the county Automobile Dealers to ensure they are properly
disposing of their hazardous waste.
These items were completed on 1-17-2003.
Please be sure that Haywood County wishes to do everything feasible to
prevent hazardous waste from being disposed in our solid waste landfill.

15A North Carolina Administrative Code 13B .1626(1)(b)(i) prohibits hazardous waste (as defined within 15A North
Carolina Administrative Code 13A, to also include hazardous waste from conditionally exempt small -quantity
generators) from being disposed of in a municipal solid waste landfill.
The N.C. Hazardous Waste Section has discovered that hazardous waste generated at Ken Wilson Ford in Canton has
been disposed of at the Haywood County Landfill.
Haywood County should review waste screening procedures to ensure that the county's program is adequate to exclude
hazardous waste from landfill disposal.
You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $5,000 per day may be assessed for each
violation of the Solid Waste Statute or Regulations. If the violation(s) noted here continue, you may be subject to enforcement actions
