This is a good example of an application that contains the type and scope of information that we require for this type of facility. This application was submitted in a three ring binder format which facilitated easy replacement of sections which were revised during the review and approval process, The one suggestion that I would make for future applications is the submission of full size (24" x 36") drawings of the site development plans instead of the 8.5 by 11 copies (92-004, RF-1, RF-2, RF-3, TP-1, FP-1, and FP-2), If you have any questions or if we can provide any other assistance, please do not hesitate to contact this office. This permit is for a three (3) year period from the date of issuance and approves the construction and operation of the referenced materials recovery facility on the property shown in the accompanying approved application. Condition number 16 specifies the types of wastes which may be received at the facility. Waste or materials that are not processed and reused as per condition number 18 must be disposed of at a properly permitted facility. Condition number 9 requires obtaining approval for additional land disturbing activities from the North Carolina Department of Environment, Health, and Natural Resources, Division of Land Resources, Land Quality Section. Haywood County Property Map, Sheet Number 8647. 5. Haywood County Property Map, Sheet Number 8657.01. PERMIT 44-09-TP March 22, 1994 ATTACHMENT 2 Conditions of Permit GENERAL CONDITIONS 1 . This permit is issued for a period not to exceed three years from the date of issuance. This permit is for the construction and operation of the Materials Recovery Facility according to the approved application. Additional conditions and revisions of the approved plans shall be approved by the North Carolina Solid Waste Section. This permit will be periodically reviewed to evaluate impacts on the assessment and monitoring of the adjacent Champion landfill site. Should it be determined that the operations of this facility have an impact on the assessment and monitoring, this permit may be revoked or operations modified at the direction of the Section. Amendments or revisions to the Solid Waste Management Rules or violation of groundwater standards may necessitate the modification of the construction and operation plans or closure of this facility prior to this date. 2. This facility shall be operated in a manner which is consistent with the State Solid Waste Management Plan and with the solid waste management plans that have been adopted by those units of local government served by the facility and approved by the Division. 3. Site preparation and construction shall be in accordance with the approved plans. 4. A sign shall be posted at the entrance to the facility containing the facility name, contact name and number, hours of operation, and permit number. 5. If solid waste is received at the facility other than that which the facility is permitted to receive, it shall be separated and removed within seven (7) days. 6. Any water which comes in contact with solid waste shall be contained on -site or properly treated prior to discharge. 7. Effective vector control measures shall be applied to control flies, rodents, insects, vermin, and any other potential vectors. 8. Fires and non -conforming waste incidents shall be reported to the Regional Waste Management Specialist within twenty-four (24) hours followed by a written notification to the submitted within fifteen (15) days. 9. All sedimentation and erosion control activities shall be conducted in accordance with the Sedimentation Control Act, 15A NCAC 4 and require approval from the Division of Land Resources, Land Quality Section. 10. All earth -disturbing activities will be conducted in accordance with all applicable federal, state, and local requirements. 11. Dust and odor control measures shall be utilized to minimize emissions. PERMIT 44-09-TP March 22, 1994 12. Ground water quality at this facility is subject to the classification and remedial action provisions of 15 NCAC 2L. 13. Open burning of solid waste is prohibited. 14. The site shall be adequately secured by means of gates, chains, berms, fences, etc., to prevent unauthorized entry except when an operator is on duty. An attendant shall be on duty at the site at all times while it is open for public use to assure compliance with operation requirements and to prevent entry of hazardous waste and other unacceptable waste onto the site. 15. Equipment shall be provided to control accidental fires or arrangements shall be made with the local fire protection agency to immediately provide fire -fighting services when needed. MATERIALS RECOVERY FACILITY CONDITIONS 16. The Materials Recovery Facility is permitted to receive and process: a. "Construction" and "Demolition" materials as provided for under N.C.G.S. § 130A- 290(a)(4); waste or debris resulting solely from construction, remodeling, repair, or demolition operations on pavement, buildings, or other structures. b. "Land Clearing and Inert Debris" waste as provided for in 15A NCAC 13B .0101(73); concrete, brick, concrete block, uncontaminated soil, rock, and gravel, untreated and unpainted wood, and yard trash. C. "Used asphalt" as provided for under N.C.G.S. § 130A-309B; used asphalt or used asphalt mixed with dirt, gravel, rock, and concrete. d. "Land clearing waste" as provided for in 15A NCAC 13B .0101(72); stumps, trees, limbs, brush, grass, and other naturally occurring vegetative material. e. "Yard waste" as provided for in 15A NCAC 13B .0101(74); brush, grass, limbs, and similar vegetative material. 17. All materials including resource recovery materials shall be placed a minimum of four (4) feet above the seasonal high water table. 18. Seventy-five percent (75%) of materials received at the facility must be processed and removed from the facility within one (1) year of receipt. 19. The storage period for unprocessed materials shall not exceed one (1) year from the date of receipt. 20. The storage period for processed materials shall not exceed one (1) year from the processing date. 21. Records shall be maintained for the amount of material received, materials processed, and materials removed from the facility. 22. An activities and records report shall be submitted to the Division of Solid Waste Management on an annual basis. PERMIT 44-09-TP March 22, 1994 23. The monitoring well at the operations site (noted as well A on the approved copy of the plans) and the monitoring well adjacent to the access road (noted as well B on the approved plans) shall be protected from damage by installing a minimum of four bollards around each well, at a ten foot square spacing. Alternatively, the wells may be protected by installing a chain link fence at a ten foot square spacing. Well protection must be installed prior to commencing any waste stockpiling and processing. 24. The area around monitoring wells A and B shall be graded to ensure that surface water is diverted away from the monitoring well. 25. The access road shall be located to avoid monitoring wells A and B. 26. The stockpile area for treated or painted wood shall be located at a lower elevation than monitoring well A and shall be graded as such to ensure that surface water runoff is directed away from the monitoring well. 27. Individual stockpile areas shall be no larger than 50 foot by 50 foot in area. There shall be a minimum 50 foot separation between stockpile areas. C. 27611-7687 RE: Permit Renewal and Modification - Material Recovery Facility #44-09TP - Haywood County Dear Mr. Coffey, On December 17, 1996 I requested a permit renewal for our Material Recovery Facility (44-09TP), Haywood County, which expired in March, 1997. This permit was for a three (3) year period and I requested a renewal for a five (S) year period I have not received any confirmation regarding this request. In addition to the above I also request a modification to the permit to allow for the grinding of painted and treated wood at our adjacent Demolition Landfill (#44-A). We have a new grinder set up at the Demolition Landfill to grind clean wood, brash and pallets. Keeping our grinding operation in the same area will allow for better site utilization and eliminate the visible work area at the present location. The painted and treated material would be located in a designated area approximately three hundred feet from the clean wood operation. We will contain the unground and the ground material in bunkers made from highway medium dividers. When a truck load of ground material is accummulated we will haul to the White Oak Landfill.
