Mc Dire, The Solid Waste Section hereby issues Haywood County a Permit To Construct (enclosed) for the referenced facility in accordance with N.C.G.S. 130A-294 and 15A NCAC 13B. Also, the North Carolina Department of Cultural Resources, Historic Preservation Section, recommends that Haywood County conduct an archaeological survey of the site to determine if any archaeological remains are present on the site. The Historic Preservation Section also recommends evaluating what the effects, if any, construction of the referenced facility would have on historic remains should they be found. Prior to receiving waste at the facility, Haywood County must also obtain a Permit to Operate from the Solid Waste Section. Key prerequisites for obtaining a Permit To Operate include: + submitting to the Solid Waste Section copies of all applicable state and federal permits and approvals; • submitting to the Solid Waste Section "As -Built" engineering drawings for the facility. Please show connection to the Town of Waynesville's sewer system; • receive operational clearance after a representative of the Solid Waste Section inspects the facility. Coffey, Sup is r ermitting Branch Solid Waste Section An Equal Opportunity Affirmative Action Employer PERMIT No. 44-08-TP OCTOBER 5, 1992 SOLID WASTE PERMIT CONDITIONS OF PERMIT 1. The applicant is responsible for obtaining any and all permits and approvals necessary for the development of this project prior to the commencement of construction activities. 2. This permit will be subject to review every five years as per 15A NCAC 13B 0.0201(c), according to the issuance date of the Permit To Operate. Upcoming amendments to the Solid Waste Management Rules may necessitate modifications of the construction and/or operation of this facility prior to the review date. 3. This facility shall be constructed in accordance with the approved plans and all pertinent rules and regulations. Modifications shall be approved by the Solid Waste Section. The approved plan is described by Attachment 1, "List of Documents for Approved Plan. " 4. Prior to receiving waste at this facility a Permit to Operate must be obtained. The requirements for this part of the Solid Waste Permit are described below in Construction Condition No. 3. The Conditions of Permit issued herein shall also be incorporated in the Permit to Operate. 5. This permit is not transferable. 6. A copy of this permit and the approved plans shall be maintained at the facility. CONSTRUCTION AND OPERATION PLANS 1. This permit is for construction of the mixed waste processing facility. Additional conditions and revisions of the approved plans shall be approved by the North Carolina Division of Solid Waste Management. 2. All sedimentation/erosion control activities will be conducted in accordance with the Sedimentation Control Act codified at 15A NCAC 4. Conditions of Permit No. 44-08-TP Page 2 3. This following pre -operative requirements shall be met to obtain a permit to operate this facility: a. Site preparation shall be in accordance with the construction plan and the conditions specified herein; b. Site inspection shall be made by a representative of the DSWM; C. The permit number and the words "NO HAZARDOUS, OR LIQUID WASTE ACCEPTED" shall be posted on an entrance sign; d. A plan for determining the amount of waste transferred to the Haywood County landfill for disposal as required in the Monitoring and Reporting Requirements Section shall be prepared and submitted to DSWM for approval. e. The Section shall be provided with documentation showing approval for all applicable local, state and federal permits. Copies of any applicable inspections shall also be submitted to the Solid Waste Section prior to the issuance of the Permit To Operate. 1. "As -Built" engineering drawings shall be submitted to the Solid Waste Section prior to the issuance of the Permit To Operate. 5. This solid waste disposal facility is permitted to receive solid waste generated solely within the boundaries of Haywood County except that hazardous waste and liquid waste are prohibited from disposal at this site. 6. This facility shall conform to ' all operating procedures in Section 0.0300 of 15A NCAC 13B and as specified herein. a. All pertinent mixed waste processing facility personnel will receive training and supervision necessary to properly operate this facility. b. Waste water management will be conducted in accordance with the approved plan, the conditions specified herein, and all pertinent State rules and regulations. Conditiogs of Permit No. 44-08-TP Page 3 MONITORING AND REPORTING REQUIREMENTS 1. The permittee shall maintain a record of the amount of waste received at the facility compiled on a monthly basis. 2. On or before December 1 of this year and each year thereafter, the permittee shall report to the Solid Waste Section on forms prescribed by the Section the amount of waste (in tons) received at this facility and transferred to Haywood County's landfill for disposal. This report shall include the following information: a. The reporting period shall be for the previous year, beginning 01 July and ending 30 June; b. The amount of waste received at the facility (in tons) compiled on a monthly basis. 3. All records shall be maintained on -site and made available to DSWM upon request.
