PLAN AND PERMIT REQUIREMENTS — (a) Construction plans shall be approved and followed. — (b) Specified monitoring and reporting requirements shall be met. (10) SAFETY REQUIREMENTS — (a) Open burning of solid waste is prohibited. — (b) Equipment shall be provided to control accidental fires or arrangements shall be made with the local fire protection agency to immediately provide fire -fighting services when needed. — (c) Fires that occur at a sanitary landfill shall be reported to the division within 24 hours and a written notification shall be submitted within 15 days. — (d) The removal of solid waste from a sanitary landfill is prohibited unless the owner/operator approves and the removal is not performed on the working face. — (e) Barrels and dru Frig shall not be disposed of un less they are empty and perforated sufficiently to ensure that no liquid or hazard- ous waste is contained therein. (11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS — (a) A site shall only accept those solid wastes which it is permitted to receive. — (b) No hazardous, liquid, or infectious waste shall be accepted or disposed of in a sanitary landfill except as may be approved by the division. — (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste, and other animal waste delivered to the disposal site shall be covered immediately. — (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as amended through January 1, 1985, may be disposed of separate and apart from other solid wastes at the bottom of the working face or in an area not contiguous with other disposal areas, in either case, in virgin soil. Separate areas shall be clearly marked so that asbestos is not exposed by future land -disturbing activi- ties. The waste shall be covered immediately with soil in a manner that will not cause airborne conditions. Moore: The Solid and Hazardous Waste Management Branch has implemented a Ground Water Monitoring Plan effective July 1, 1988 for all currently permitted industrially owned sanitary landfills within North Carolina. This plan is designed so that all facilities will be responsible for annual sampling of their own ground -water monitoring wells on site and reporting the results to this office within 15 days of receipt. Because your facility presently has no ground -water monitoring wells to sample, this agency has developed a program to accomodate this situation. The Solid Waste Unit Ground -Water Monitoring Personnel have reviewed all actively permitted industrial landfills on an individual basis to determine which parameters will be required for testing. 'Jhis evaluation is based upon questionaires returned to us by you or other company representatives and primarily upon a detailed analysis of our data concerning your facility. As indicated in the questionaires you currently have no monitoring wells at your landfill, (Permit #56-03), subsequently, per section .0601 of 10 NCAC IOG you are required to install them by JUII� 1 1989 in order to implement your 2s�iLYdY �3. monitoring pro r . Because of the homogeneous nature of materials placed in your landfill you will not be required to analyze all the parameters described on page 12 of the Guidance Document. However, you are required to test for the parameters listed below, which upon completion of a thorough review by this office, should adequately document and characterize your waste stream. Subsequently, the samples must be transported to a certified drinking water laboratory for analysis per page 12 of the enclosed Guidance Document. (10) SAFETY REQUIREMENTS — (a) Open burning of solid waste is prohibited. — (b) Equipment shall be provided to control accidental fires or arrangements shall be made with the local fire protection agency to immediately provide fire -fighting services when needed. — (c) Fires that occur at a sanitary landfill shall be reported to the division within 24 hours and a written notification shall be submitted within 15 days. — (d) The removal of solid waste from a sanitary landfill is prohibited unless the owner/operator approves and the removal is not performed on the working face. — (e) Barrels and drums shall not be disposed of unless they are empty and perforated sufficiently to ensure that no liquid or hazard- ous waste is contained therein. (11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS — (a) A site shall only accept those solid wastes which it is permitted to receive. — (b) No hazardous, liquid, or infectious waste shall be accepted or disposed of in a sanitary landfill except as may be approved by the division. — (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste, and other animal waste delivered to the disposal site shall be covered immediately. — (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as amended through January 1, 1985, may be disposed of separate and apart from other solid wastes at the bottom of the working �ace or in an area not contiguous with other disposal areas, in either case, in virgin soil. Separate areas shall be clearly marked so that asbestos is not exposed by future land -disturbing activi- ties. The waste shall be covered immediately with soil in a manner that will not cause airborne conditions. (12) MISCELLANEOUS REQUIREMENTS — (a) Effective vector control measures shall be applied to control flies, rodents, and other insects or vermin when necessary. — (b) Appropriate methods such as fencing and diking shall be pro- vided within thearea toconfinesolid wastesubjectto be blown by the wind. At the conclusion of each day of operation, all windblown material resulting from the operation shall be col- lected and returned to the area by the owner or operator. General Statute 13OA-22(a) and to NCAC IOG, inspections of the referenced landfill were conducted on September 30, 1987 and December 7, 1987. The inspections revealed two consecutive violations of the N. C. Solid Waste Management Rules, codified at 10 NCAC lOG specifically: 10 VCAC lOG .0505(3)(a) requires that solid waste be covered after each day of operation with a compacted layer of at least six inches of suitable cover or as specified by the division (Collins and Aikman's permit requires that solid waste be covered at the end of each week of operat . ion). The Collins and Aikman Landfill was operating in violation of 10 NCAC IOG (3)(a) at the time of the inspection on December 7, 1987 in that the solid waste was not completely covered with six inches of soil on a weekly basis. Based on the foregoing, Collins and Aikman Company is hereby notified to take the following action by January 10, 1988 to correct the violation stated in this notice of violation and otherwise be in compliance with the Solid Waste Management Rules, codified at 10 NCAC lOG: Comply with 10 NCAC lOG .0505(3)(a) by covering all waste after each week of operation with a compacted layer of at least six inches of soil cover.
