STATUS OF PERMIT:
LCID 26-F closed in 2011. 0.56-acre area over LCID was approved for additional storage, of leaf debris from 2610-Compost, in July of 2015. An application submitted October 2021 to reopen the closed LCID and to combine it with the existing Composting permit 26-10. PURPOSE OF SITE VISIT: Comprehensive Inspection

ADDITIONAL COMMENTS
1. An application, submitted in October 2021 by Smith and Gardener, was received to reopen the closed LCID and to combine it with the existing Composting permit 26-10. Partial excavation of the LCID will also be requested. 2. Section staff walked the LCID with CCSW staff and noted site was well mowed with EOW markers in place. Shrubs were also removed as requested. Good job. LCID had good cover and had recently been mowed.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

3. Area on east end was previously approved for storage on 0.56 acres for processed and unprocessed (ground or unground) wood debris, it was the only area to receive the required soil cover. Equipment was removed as requested in this area but rock and other aggregate materials are now stockpiled in this area. The stockpiles are not approved to be stored on top the closed LCID and should be removed. A request should be submitted for any other activity the county wishes to do on top the closed LCID before it engages in doing that activity. It would also be necessary to verify the required 2 feet of cover over the waste (1 foot LCID final cover plus 1-foot protective cover for the operation) over this area or any others. Given that the LCID is in process for reopening the closed LCID, this may be unnecessary depending on the requests/approvals that result from the application. However, if this part of the LCID isn’t approved for reopening and given a permit addressing this area of the closed LCID, then it should have borings to confirm proper cover if it will be used for storage of the currently approved waste moving forward. Mr. Powell spoke with Ms. Bader on these concerns on 11/16/2021 and the stored rock/etc. was removed from the LCID and a picture provided on 11/17/2021. Good job.
