Abernathy, McDowell County Manager Date: February 16, 1994 Subject: Temporary Transfer Station for McDowell County (A) Source and destination of transferred waste McDowell County's Municipal Solid Waste will be transported to the Burke County Landfill. Together, both McDowell and Burke County have approached the NCDSWM with this proposal. NCDSWM has accepted and approved this action. (B) Proposed location within landfill facility; including buffer distances to waste, property boundary, dwellings, wells, streams, etc. A map indicating this is enclosed. (C) Proposed waste management activities including management of non -transferred wastes and special wastes such as construction/demolition, land -clearing inert debris, scrap tires, yard waste, asbestos, recyclable materials, etc. McDowell County will continue accepting C/D and land -clearing waste at our landfill. We will continue to accept scrap tires, which will be shipped to Piedmont Regional Landfill, Kernersville, North Carolina. We will continue to accept Yard Waste, which will be chipped and sold to the general public At this time we will not be accepting asbestos. We would like to reserve the right to accept asbestos when we locate a suitable site. We will have a recycling site located at our landfill. (D) Operational procedures to manage waste in a sanitary manner; including wastewater, windblown waste, vector control, fire control, etc. McDowell County has contacted the City of Marion, in Marion, North Carolina in reguards to accepting our wastewater. We have not received a reply from the City of Marion. We assume a decision will be reached concerning the disposal of our wastewater. Windblown waste and vector control will be addressed by McDowell County employees on a daily basis. McDowell County has local fire departments who respond when we need them for fire control. (E) Transition schedule including; a plan for submittal of permit application(s), if necessary, within 180 days of temporary approval for proposed permanent waste management activities or discontinuation of activities. At this time Jensen Engineering is addressing the applications for a permanent transfer station and the continuing landfill activities. This report will be ready on or before April 9, 1994. (F) Determination that operation of these facilities will not interfere in any way with the closure and post -closure requirements of the MSWLF unit. As stated previously, disposal of solid waste within the MSWLF following closure shall be considered as non-compliance with closure/post closure conditions. All activities that McDowell County has proposed, such as distances from boundary lines, distances from existing waste will not effect the closure/post-closure of McDowell County's existing landfill. Guthrie, Regional Manager February 24, 1994 Mr. Alan Silver, Director Public Works, McDowell Co. 10 East Courts Street Marion, NC 28752 RE: McDowell County Landfill - Recreational Use Dear Mr. Silver: In order to ensure compliance with McDowell County's Sanitary Landfill Permit and the North Carolina Solid Waste Management Rules with regard to the proposed use of the landfill by the public during weekends and after work hours, the County will need to provide adequate personnel to monitor the proposed use; prevent unauthorized entry to the landfill and possible illegal dumping; prevent access to other areas outside of the use area; and prevent damage to the soil cover, cover vegetation, monitoring devices and equipment. Airplane fuel spills and fire from human activities as well as personal injury liability should also be considered in this decision. C. Highway 226 South, North Carolina. The inspection found the McDowell County Sanitary Landfill to be in violation of certain requirements contained in the North Carolina Solid Waste Management Rules, codified at 15A NCAC 13B, specifically: 15A NCAC 13B.0103(f) requires that white goods shall not be disposed of at a solid. waste disposal site. The McDowell County Landfill was operating in violation of 15A NCAC 1313.0103(f) in that white goods were being disposed of in the waste. 2. 15A NCAC 13B.0505(3)(a) requires that solid waste be covered after each day of operation with a compacted layer of at least six inches of suitable cover. The McDowell County Landfill was operating in violation of 15A NCAC 13B.0505(3)(a) in that all solid waste was not covered after each day of operation with a compacted layer of at least six inches of suitable cover. 3. 15A NCAC 13B.0505(51(bl requires that the surface water shall not be impounded over or in waste. The McDowell County Landfill was operating in violation of 15A NCAC 13B.0505(5)(b) in that surface water was impounded over solid waste. 4. 15A NCAC 13B.0505(12)(bl requires that at the conclusion of each day of operation, all windblown material resulting from the operation be collected and returned to the area by the owner or operator. The McDowell County Landfill is operating in violation of 15A NCAC 13B.0505(12)(b) in that windblown material is not being collected and returned to the area at the conclusion of each day of operation. The McDowell County Landfill was operating in violation of 15A NCAC 13B.1104(a) in that whole scrap tires were being landfilled. Based upon the foregoing, the County of McDowell is hereby ordered to take the following actions by April 9, 1994 to correct all violations as stated in this Notice of Violation, and otherwise be in compliance with the North Carolina Solid Waste Management Rules, codified at 15A NCAC 13B: 1. Comply with 15A NCAC 13B.0103(f,� by monitoring the waste stream and removing the white goods. 2. Comply with 15A NCAC 13B.0505(3)(a) by covering all solid waste after each day of operation with a compacted layer of at least six inches of suitable cover. 3. Comply with 15A NCAC 13B 0505(5)(b) by eliminating impoundment of surface water over solid waste. 4. Comply with 15A NCAC 13B.0505(12(b) by collecting after each day of operation all windblown material resulting from the operation and returning it to the area. 5. Comps with 15A NCAC 13B.1104(a) by removing scrap tires from the waste stream. If the requirements above are not met on a continuing basis, enforcement action may be taken. I have talked to Jan and she has stated that the temporary transfer station permit has been approved and the paperwork is being handled at this time. Jan has signed the permit and all it likes is for Jim Coffee to sign the document. The enclosed document contains most of the information that you have asked for, except for what I am addressing below. Volume: Our average is approximately 90 tons per day. This average is over a seven day per week average. At this time I cannot give a good estimate on the types of waste received. I feel that a normal pie chart for landfills would suffice. Transfer Containers: GDS has been awarded the contract of transferring our waste. GDS has stated that they will use push out trailers. The Section hereby grants approval, with the attached conditions, for the construction and operation of a temporary transfer facility at the McDowell County Landfill. This approval is effective for six (6) months from the date of construction completion (see Condition Number 3). If McDowell County wishes to operate a transfer facility on a permanent basis, it will be necessary to obtain a permit from the Section. This facility is hereby approved to receive solid waste as defined in 15A NCAC 13B .0101 (36), except that hazardous and liquid wastes are prohibited from acceptance at this facility. 2. This facility shall only receive solid waste that is generated within McDowell County, as described in the request for a temporary transfer facility, and shall be disposed of at the Burke County Landfill, Permit 12-03. 3. This approval shall be in effect for six (6) months from the date of construction completion. 4. The following requirements shall be met prior to receiving solid waste at the site: a. A consultation shall be made with a representative of the Solid Waste Section prior to actual waste transfer. b. The words "No hazardous or liquid wastes accepted" shall be posted on an entrance sign. 5. Operation of the facility shall occur in accordance with 15A NCAC 13B .0402, "Operational Requirements for Transfer Facilities", the operational plan submitted to the Solid Waste Section, and these additional requirements: a. All waste shall be either removed from the facility or placed in a covered, leakproof container at the end of each working day. The facility shall be secured to prevent unauthorized entry after operational hours. b. This facility shall be operated in a manner which is consistent with the state solid waste management plan and with the solid waste management plans that have been adopted by those units of local government served by the facility and approved by the Section. C. On or before 1 December 1993 and each year thereafter, the owner or operator shall report to the North Carolina Solid Waste Section, for the previous year beginning 1 July and ending 30 June, the amount by weight of the solid waste that was received at the facility and disposed of in a landfill, incinerated, or converted to fuel. To the maximum extent practicable, such reports shall indicate by weight the county of origin of all solid waste. The owner or operator shall transmit a copy of the report to the county in which the facility is located and to each county from which waste originated. The container arrived at 2:01 P.M.. The container was picked up at Jeld-Wen Fiber Products, located on highway 70 west in McDowell County. The contents of the container was off-loaded in McDowell County's C/D holding area. At approximately 3:10 P.M. the landfill employees noticed smoke and fire in the C/D holding area. We made an attempt to extinguish the fire by covering the fire with soil but, to no avail. Marion Fire -Department was called to the scene at 3:26 P.M.. Upon arrival of the fire department, we were still covering the fire with soil. Marion Fire Department with the assistance of Dysartsville Fire Department attempted to extinguish the fire, but they were not successful. McDowell County Landfill Employees have continued to cover the area with soil. I contacted the maintenance supervisor at Jeld-Wen, and he stated that he had new employees cleaning around their building and the new employees had thrown boiler clinkers into the waste container. The contents of the container had caught on fire and they thought that they had extinguished the fire before they had sent it to the landfill. He assured me that they would be more concerned about keeping the hot boiler clinkers out of the waste container from now on. I was at the McDowell County Garage, when Mike Gladden, who is the supervisor at the landfill called me on the radio and advised me that there was smoke coming from the yard waste holding area. I immediately called for the Fire Department to be dispatched to the landfill. I called the fire in at 12:12 P.M.. Marion Fire Department was dispatched at 12:18 P.M.. Marion Fire Department arrived on the scene at 12:23 P.M.. About three/fourths of the yard waste area was on fire at that time. Marion Fire Chief Tom Milligan advised me that basically there was nothing that they could do. There is a road around the yard waste holding area, and there was no danger of the fire getting into the adjoining woodland. When the fire cooled down the landfill employees started covering the area with soil. The fire smoldered underground for several days. I do not know the cause or orgin of the fire. INTRODUCTION To pursue the permanent closure of the current Category 1 and 2 Municipal Solid Waste Landfill (MSWLF) under the current closure regulations by the State of North Carolina Department of Environment, Health and Natural Resources, Division of Solid Waste Management Rules 15A NCAC 131-31 aE amended through January 4, 1994, and the federal criteria as published in part 40 CFR Part 258 and revisions to 40 CFR 257 under authority of Subtitle D of the Resource Conservation and Recovery Act, the following information is provided for approval. McDowell County has previously operated a MSWLF on approximately 25 acres of a 152 acre total tract of land located ajacent to North Carolina Highway 226 and approximately 1/2 mile south of U.S. Interstate 40 (see location map). The current landfill consists of a Category 1 and Category 2 (the landfilling of municipal solid waste ceased prior to April 9, 1994), discrete landfill areas as delineated on the attached plans. II. LANDFILL CLOSURE A. CATEGORY I MSWLF The category I MSWLF landfill stopped accepting waste prior to 1989. 1. Final contours are in conformance to those presented in the updated landfill plan. 2. A minimum of (6) six inches of soil will be placed above the low permeability cap system to encourage growth of native planting and provide for erosion protection and to protect root penetration into the cap system. 3. POST -CLOSURE CONDITIONS Post closure care will cons_Z. of maintaining all erosion control/ storm drainage measures and vegetative cover in compliance with the closure conditions as approved. A comprehensive water quality monitoring program will be continued during the post closure time period as required by the Division in accordance with the N.C. Water Quality Monitoring Guidance Document for Solid Waste Facilities. During the period of post -closure care attention will be given to the potential for concentrations of explosive gases and if conditions warrant measures will be designed to mitigate any adverse effects. Access to the closed MSWLF will be controlled by fencing and or gate structures at the access road preventing unauthorized access by the public. The final grading of the site is designed to prevent ponding and any excessive settlement which appears to provide a potential ponding situation will be dealt with as part of the post closure care of the MSWLF. During Post -closure care the Owner/operator will comply fully with current ground water standards. Page 4 IV. POST -CLOSURE OPERATIONS To provide for solid waste collection and disposal after closure of the MSWLF, the County has applied for a temporary construction permit for a transfer station to transfer MSW from the proposed station sited within the boundary of the landfill property to a remote permitted MSWLF. In addition to the operation of transfer of MSW the County will also provide for the handling and transfer of separated recyclable materials, handling of yard waste and operate a C & D landfill for disposal of permitted construction and demolition wastes. All of the above operations will be sited a minimum of 100 feet from the closed MSWLF and will in no way affect the closure/post-closure operations of the discrete MSWLF units. A. TRANSFER STATION 1. Source of transferred waste will be 70% residential & Commercial and 30% Industrial. Destination of transferred waste will be the Burke County Landfill. 2. Proposed location within landfill facility; including buffer distances to waste, property boundary, dwellings, wells, streams, etc., as shown on attached plan. 3. Proposed waste management activities including management of non -transferred wastes and special wastes such as construction/demolition, land-clearing/inert debris, storage of tires, yard waste, asbestos, recyclable materials, etc. management of white goods and metals, recycling operations including plastic, mixed paper, glass, aluminum cans, automotive batteries & waste oil, C&D material and stockpiling of brush. Brush material will be ground into mulch and sold to the general public. 4. Operational procedures to manage waste in a sanitary manner; including wastewater, windblown waste, vector control, fire control, etc. Waste will be dumped directly into water tight containers. Material will be pumped and hauled to City of Marion's wastewater treatment facility. B. A catch fence approximately 16' high will be installed below the transfer area if conditions warrant. C. Because all transferred waste is containerized and hauled on a daily basis there will be no vector problems. D. In addition to several standard type fire extinguishers the owner has two rural fire departments within a five mile distance and will respond if summoned. E. Yard waste and brush will be stockpiled & ground on an "as needed" basis by a contract grinding operation. 5. Transition schedule including; a plan for submittal of permit application(s), if necessary, within 180 days of temporary approval for proposed permanent waste management activities or discontinuation of activities. 6. Determination that operation of these facilities will not interfere in any way with the closure and post -closure requirements of the MSWLF unit. As stated previously, disposal of solid waste within the MSWLF unit following closure shall be considered as non-compliance with closure/post-closure conditions. V. Additional Information For McDowell County Landfill A. Letter from McDowell County indicating that there is no zoning at the landfill. B. McDowell County then started the process of closing their Landfill. McDowell County had engineer's on site from Froehling and Robertson Inc., Engineering. Froehling and Robertson determined that on site soils would meet or exceed the requirements of permeability for the final Landfill cover. McDowell County personal began the task of installation of the final Landfill cover. Due to the excessive amount of rain and magnitude of the project, we soon realized that this task could not be accomplished with our present equipment and manpower. In August we contacted a number of firms for help in installing the final cover. McDowell County chose Burke Construction to install the final cover. Burke Construction started the installation on August 22, 1994. During the process of installation of the final cover, we had Froehling and Robertson, and Jensen Engineering on site doing density and soil tests. Burke Construction finished the installation of the final cover and the installation of the soil to sustain plant growth on September 23, 1994. McDowell County personnel, then began the seeding and erosion control as outlined in the closure plan. This was completed September 29, 1994. Reports presenting the results of this field testing have been forwarded to your office previously, and copies are also attached to this letter. Representative samples of the soils tested at each moisture -density measurement location were collected and placed in sealed glass jars for subsequent laboratory classification testing. On placement of final cover materials, a representative of this office collected random bulk samples for composite permeability testing. Results of that testing indicate an effective permeability of less than 8E-07 cm/sec at a compacted unit dry weight of equal to or greater than 95 percent of the maximum dry unit weight determined by ASTM D698 Standard Proctor methods. All permeability testing was performed in accordance with currently accepted standards of geotechnical engineering practice, and in accordance with the procedures required by ASTM D5084 Method C. By previous laboratory evaluation prior to construction, it was determined that the on -site borrow soils proposed for cover placement would be conditionally adequate to provide an effective permeability of 1 E-05 cm/sec or less. Conditions being the homogeneity of the borrow source, and cover installation methods. Results of our random analysis and testing indicates that these conditions of compaction and general hornlogeneity have been adequately met at the above project. During a site visit of 9/14/94, the undersigned observed placement of materials determined by field observations to be visually and texturally different from previously tested proper cover soils, and possibly inadequate for permeability control. Total coverage by that soil material was estimated to be less than 1/2 acre, near the crown of the cover area. Because this value did not meet project requirements, the undersigned re -visited the site and recommended to the McDowell County Solid Waste Supervisor that these materials must be removed from the cover and replaced with appropriate cover soil, or that the materials could remain as base and an additional 18 inches of proper cover materials could be placed over them. It was elected by McDowell County to place an additional 18 inches of proper materials over these soils of insufficient permeability control. Subsequent site visits by representatives of this office and the undersigned observed this option being carried out. Based on the results of observations and testing during and following the site cover placement efforts, it the opinion of this office that conditions have been adequately achieved to meet project cover requirements for permeability control.
