Subject: Disposal of Approximately 250-500 Pounds/Two Weeks of
Shot Blast Dust, Dirt & Scale at the McDowell County
Landfill, (Permit #56-01)
Dear Mr. Hussey:
The Solid Waste Management Division has received a request for
characterization of the subject waste. Based upon the submitted
information, the waste appears to be non -hazardous. The Solid
Waste Management Division has no objection to the sanitary landfill
disposal of this waste, if in accordance with the conditions listed
below:
1. The owner/operator of the landfill approves the disposal.
2. The waste contains no free liquids and can be confined,
compacted, and covered in accordance with the Solid Waste
Management Rules (15A NCAC 13B).
3. Renewal of this approval will require resubmittal of a
Waste Determination Form and current supportive
analytical data. Renewal is required prior to subsequent
disposal if the process generating the waste changes or
if the waste composition changes significantly.
Failure to meet these conditions may result in revocation of
this approval, and subsequently, an administrative penalty. The
approval is subject to change if new rules and/or regulations were
to prohibit this practice. If the process which generates the
waste changes or if the composition of the waste changes
significantly, this approval is void and re-evaluation of the waste

Re: Authorization To Construct An Additional Well At The Mcdowell
County Sanitary Landfill (Permit # 56-01).
Authorization to construct a "background" monitoring well is
granted with the understanding that the well shall be constructed
in a manner consistent with North Carolina Well Construction
Standards (15A NCAC 2C) as illustrated by the "Typical Monitoring
Well Schematic" enclosed. Well Completion Records and associated
boring logs shall be submitted to the Solid Waste Section upon well
completion.
Regarding screen placement, shallow monitoring wells must be
designed so that the water table always falls within the screen.
Actual screen depths should be determined in the field based on
stabilized water table information. The well should be constructed
using a 15 foot screen, unless the depth to rock limits the depth
of the boring and the water table is such that sufficient water can
be expected in a more shallow well even under seasonal low water
table conditions. The screen must be installed so that the top of
the slotted PVC well screen is just above the estimated seasonal
high water table, thus allowing for seasonal fluctuations. The sand
pack should extend no more than 2 feet above the screen. A
bentonite seal of at least 1.0 foot should be installed above the
screened interval. A complete and accurate Well Completion Record
(DHS 3342), boring log and Well Schematic Diagram should be
submitted to this office within 30 days of well installation.
Wells should be thoroughly developed after construction in
order to reduce the suspended solids, flush out the well, and re-
establish equilibrium with the aquifer. If you have any questions

Dear Mr. Coffee:
At this time McDowell County is in the process of installing
final cover on the portion of our sanitary landfill that lies
on the south side of the access road at the entrance. This
area was never filled to it's capacity. There will be some
deviation from the engineer's closure plan elevation
requirements. We will have an engineer come on -site to
advise the correct closure procedure. This area will be
closed to ensure proper drainage and erosion control. We
will also plant native grasses as a cover crop. This area
did not receive municipal solid waste after- the October 9,
1991 deadline. When all closure requirements are met, I will
notify your office and ask for an inspection at that time. I
am enclosing a plat that details the area that we propose
closing.

Dear Mr. Abernathy:
Thank you for your October 29, 1993 cover letter and
Resolution adopted by the McDowell County Board of Commissioners in
response to my memorandum of October 5, 1993 concerning
"Conditional Exemption of Small MSWLFs From Section .1600 Rules".
Attached to my memorandum was a copy of the temporary amendment of
Rule .1601 which detailed the new requirements .for exemptions to
Section .1600.
As acknowledged within your letter and stated in the
Resolution, the McDowell County Board of Commissioners intends to
evaluate the results of a Camp, Dresser and McGee feasibility study
before absolute commitment to stopping the receipt of waste at your
MSWLF unit (Permit Number 56-01). Unfortunately, as you have
already been informed by my staff, the requirements of Rule .1601
do not allow for such flexibility for extended decision -making.
Specifically, Rule .1601 Subpart (iv) requires that: "The MSWLF
unit owner and operator shall notify the Division by November 1,
1993, that they shall stop receiving waste at their MSWLF unit
before April 9, 1994.11
Therefore, we must inform you that the Division cannot accept
your Resolution based on noncompliance with Subpart (iv) of Rule
.1601. Consequently, your MSWLF unit will be subject to all the
requirements applicable to existing MSWLFs.

AMENDMENT TO A
RESOLUTION TO CLOSE THE
MCDOWELL COUN'.CY LANDFILL
WHEREAS, McDowell County submitted a resolution on October
29, 1993 expressing its intent to comply with Federal and
State imposed Subtitle D regulations, and
WHEREAS, the State of North Carolina notified McDowell
County that this resolution did not meet its requirements,
and
WUPIMS, the Environmental Protection Agency (EPA) has
previously established an effective date of October 9, 1993
for all Municipal Solid Waste Landfill Facilities (MSWLF)
to meet new federal MSWLF criteria (Subtitle D Rules), and
WHEREAS, the North Carolina Commission for health Services
adopted an amendment to 15A NCAC 13B Rule .1601 which extends
the effective date to April 9, 1994, for MSWLF units that
meet the conditions of Subparts (i) through (vi) of Mule .3601
as amended, and
WHEREAS, the MSWLF unit currently operated by McDowell
County under permit No. 56-01 meets the aforementioned
conditions for exemption,
NOW BE IT RESOLVED by the Board of Commissioners of
McDowell County, North Carolina, that the McDowell County
MSWLF unit shall cease receipt of solid waste prior to April
9, 1994, unless State Subtitle D deadlines and regulations
are Significantly extended or lessened.

BE IT FURTHER RESOLVED, that the McDowell County MSWLF
unit shall complete installation of the cap system in
accordance with the requirements of Rule .1627 of 15A NCAC
13B by October 9, 1994 or shall be subject to all requirements
of Section .1600 applicable to existing MSWLrs.

Subject: Disposal of Approximately 500 Pounds/Month of Dust, Dirt
and Scale from Shot Blasting at the McDowell County
Landfill, (Permit #56-01).
Dear Mr. Hussey:
The Solid Waste Management Division has received a request for
characterization of the subject waste. Based upon the submitted
information, the waste appears to be non -hazardous. The Solid
Waste Management Division has no objection to the sanitary landfill
disposal of this waste, if in accordance with the conditions listed
below:
1. The owner/operator of the landfill approves the disposal.
2. The waste contains no free liquids and can be confined,
compacted, and covered in accordance with the Solid Waste
Management Rules (15A NCAC 13B).
3. The waste shall be transported and disposed in a manner
which prevents a physical hazard from dust.
4. Renewal of this approval will require resubmittal of a
Waste Determination Form and current supportive
analytical data. Renewal is required prior to subsequent
disposal if the process generating the waste changes or
if the waste composition changes significantly.
Failure to meet these conditions may result in revocation of
this approval, and subsequently, an administrative penalty. The
approval is subject to change if new rules and/or regulations were
to prohibit this practice. If the process which generates the
waste changes or if the composition of the waste changes
significantly, this approval is void and re-evaluation of the waste
will be required prior to subsequent disposal. If you have further
